    Petitioner is the first accused in C.C.2671\/2008<\/p>\n
on the file of Judicial First Class Magistrate Court<\/p>\n
II, Thrissur taken cognizance for the offence under<\/p>\n
section 420 of Indian Penal Code, against the two<\/p>\n
accused upon Annexure -A1 complaint.  Petition is filed<\/p>\n
under section 482 of Code of Criminal Procedure to<\/p>\n
quash the proceedings wherein, steps were initiated<\/p>\n
under section 82 and 83 of Code of Criminal Procedure<\/p>\n
for the failure of the petitioner to appear.<\/p>\n
    2.   Learned counsel appearing for the petitioner<\/p>\n
and the learned Public Prosecutor were heard.<\/p>\n
    3.    Learned counsel appearing for the petitioner<\/p>\n
submitted that ingredients of an offence under section<\/p>\n
420 of Indian Penal Code is not attracted, as is clear<\/p>\n
from  Annexure-A1   complaint  and   therefore  learned<\/p>\n
Magistrate was not justified in taking cognizance of<\/p>\n
the offence  as against the petitioner.    It is argued<\/p>\n
that  cognizance was taken on the allegation that first<\/p>\n
accused issued a post-dated cheque which was later<\/p>\n

dishonoured and it was found that it was not issued in the<\/p>\n
account maintained by the first accused but second accused<\/p>\n
and even if that allegation is correct it will not attract<\/p>\n
an offence as against the petitioner.    Learned counsel also<\/p>\n
submitted     that  due  to the  mistake  in    communication<\/p>\n
between the petitioner and the counsel, and as he was not<\/p>\n
aware of the posting date,      he could not appear and it<\/p>\n
resulted in initiating steps under section 82 and 83 of<\/p>\n
Code of Criminal Procedure.\n<\/p>\n
      4.   Annexure A1 complaint shows that the allegation is<\/p>\n
that    the    two  accused approached    first   respondent,<\/p>\n
complainant and borrowed Rs.1,00,000\/- for their business<\/p>\n
purpose promising to repay the same within one week and<\/p>\n
before the expiry of the period first accused came to his<\/p>\n
shop    and   handed over  a cheque  issued  in  the  account<\/p>\n
maintained in Perumbavoor Urban Co-operative Bank and when<\/p>\n
it was presented for encashment it was found that it was<\/p>\n
not issued in the account maintained by the first accused<\/p>\n
but by the second accused and signed by petitioner and<\/p>\n
therefore both the accused committed the offence under<\/p>\n
sections 406, 420, 468 read with section 34 of Indian Penal<\/p>\n
Code.    The main crux of the allegation is that as promised<\/p>\n
later first accused approached    first respondent and handed<\/p>\n
over a cheque for repayment of the money borrowed and later<\/p>\n
it was found out that the said cheque was signed by first<\/p>\n
accused in the account maintained by the second accused and<\/p>\n

both the accused thereby committed the offence.      There is<\/p>\n
no specific allegation that when the amount was borrowed<\/p>\n
there was a dishonest intention to cheat.     The argument of<\/p>\n
the learned counsel is that         in such circumstances as<\/p>\n
cheque was issued from the account of the second accused<\/p>\n
petitioner cannot be proceeded with.\n<\/p>\n
      5.     Petitioner is entitled to raise the contention<\/p>\n
before    the    learned Magistrate  and  seek  an  order   of<\/p>\n
discharge under section 245 of Code of Criminal Procedure.<\/p>\n
Petitioner      is  also  entitled  to  file  an   application<\/p>\n
explaining the reason why he did not appear when the case<\/p>\n
was posted for appearance and to recall the warrant issued.<\/p>\n
I find no reason to believe that         Magistrate will not<\/p>\n
recall the warrant or will not release him on bail, if a<\/p>\n
petition is filed for bail.     When an accused surrenders and<\/p>\n
files an application for bail, Magistrate is expected to<\/p>\n
pass orders in the application without delay.         In such<\/p>\n
circumstance, I find that no direction is warranted.<\/p>\n
      Petition is disposed granting liberty to the petitioner<\/p>\n
to approach the learned Magistrate to recall the warrant<\/p>\n
and also to release him on bail and to file a petition<\/p>\n
under section      245  of Code  of  Criminal  Procedure,  for<\/p>\n
discharge raising all the contentions raised herein.<\/p>\n
