               This order will dispose of a bunch of above mentioned 50 appeals, as
\nthe same arise out of a common acquisition.\n<\/p>\n
               R.F.A. Nos. 1930, 1425 to 1430, 1434, 1787, 1788, 1927, 1928,
\n1929, 1931 to 1935, 2058 to 2060, 2063 and 2573 of 2005 have been filed by the
\nland owners seeking enhancement in the compensation for the acquired land.\n<\/p>\n
               R.F.A. Nos. 3079 to 3083, 3085 to 3106 of 2005 have been filed by
\n R.F.A. No.1930 of 2005                                            [7]<\/p>\n
Market Committee, Uklana seeking reduction in the compensation awarded to the
\nland owners.\n<\/p>\n
                 The facts have been extracted from R.F.A. No.1930 of 2005.
\n                 Briefly, the facts are that vide notification dated 7.11.1997, issued
\nunder Section 4 of the Land Acquisition Act, 1894 (for short, `the Act’), State of
\nHaryana acquired 60.02 acres in Village Surewala Hadbast No. 86, Tehsil and
\nDistrict Hissar for construction of New Grain Market, vegetable and fruit market at
\nSurewala and Budha Khera, District Hissar.             The same was followed by
\nnotification dated 8.6.1998 issued under Section 6 of the Act.             The Land
\nAcquisition Collector (for short, `the Collector’) vide his award dated 7.6.2000,
\ndetermined the market value at Rs. 2,00,000\/- per acre of land situated on road
\nupto one acre depth and after that @ Rs. 1,75,000\/- per acre for nehri, gair mumkin
\nland. The learned Additional        District Judge, on reference under Section 18 of
\nthe Act, awarded compensation @ Rs. 2,40,000\/- per acre of the land falling on
\nNational Highway upto the depth of one acre and Rs. 2,05,000\/- per acre for the
\ninterior land.\n<\/p>\n
                 Learned counsel for the land owners submitted that the evidence led
\nby the land owners in the present case has not been given due weight. The only
\nreliance was placed upon sale deed ( Ex. P4), whereas other sale deeds (Ex. P3 and
\nEx. P5) have been totally ignored. Further Ex. P6 and Ex. P7, the rates at which
\nthe plots were sold by the Marketing Board in the mandi, have also been ignored.
\nHe further referred to the evidence on record to state that the land is situated quite
\nclose to Uklana Mandi on a main road. 1\/3rd of the frontage of the acquired land is
\nopposite the abadi of village Surewala. The main crossing of Chandigarh-Hissar
\nHighway is approximately one kilometer away from the acquired land. Even the
\narea in between was also being developed and there was great potential for its
\ncommercial and residential use. In the vicinity of the land, there was service
\nstation, saw mills, sugar industries and other factories.\n<\/p>\n
                 On the other hand, learned counsel for the Market Committee
\nsubmitted that as far as reliance on sale deed (Ex. P4) by the learned Court below
\nis concerned, the same cannot be disputed for the reason that it forms part of the
\nacquired land. However, it was submitted that the cut applied by the learned court
\nbelow, i.e., 70% is lesser and cut to the extent of 85% should be applied for
\narriving at fair value of the acquired land on the date of notification. He further
\nsubmitted that there was no question of any further enhancement in the value of
\nthe land, as is sought to be claimed by the land owners. Learned counsel for the
\nState also supported the arguments raised by the learned counsel for the Market

Committee.\n<\/p>\n
               Heard learned counsel for the parties and with their assistance
\nperused the relevant referred record.\n<\/p>\n
               A perusal of site plan (Ex. P1) shows that the land forming part of
\nsale deed (Ex. P3) is located just at the crossing of roads leading from\/to Sirsa-
\nLudhiana- Chandigarh-Hissar. As far as land forming part of sale deed (Ex. P5) is
\nconcerned, that is situated on the road towards the acquired land from the aforesaid
\ncrossing and as far as land forming part of sale deed (Ex. P4) is concerned, the
\nsame is part of the acquired land located just at the beginning thereof. Even the
\nrates at which the land was sold in the three sale deeds (Ex. P3, Ex. P4 and Ex. P5)
\nis also corresponding to their location. The land at the crossing of road leading
\nfrom Sirsa-Ludhiana- Chandigarh-Hissar was dealt with at Rs. 15,60,000\/- per
\nacre, whereas the plot of 10 marlas of land which is part of the acquired land was
\ndealt with at Rs. 8,00,000\/- per acre and 10 marlas of land vide sale deed (Ex. P5)
\nwas dealt with at Rs. 12,80,000\/- per acre. This sale deed was executed much after
\nthe acquisition of the land on 1.8.2000, whereas the land was acquired in the year
\n1997 and the location is also in between the above two sale deeds.\n<\/p>\n
                As is evident from the impugned award, the State produced as many
\nas 63 sale deeds on record. The land forming part thereof in most of them were not
\nshown on the site plan or were at far off place. On a perusal of the material on
\nrecord, in my considered opinion, sale deed (Ex. P3) cannot possibly be considered
\nfor the purpose of determination of fair value of land for the reason of its strategic
\nlocation on the crossing of road leading from\/to Sirsa-Ludhiana-Chandigarh-
\nHissar. As far as sale deed (Ex. P5) is concerned, the same was registered on
\n1.8.2000 after the acquisition. Accordingly, it has no relevance. Similarly Ex. P6
\nand Ex. P7 also cannot be considered for the reason that the same were instances
\nof sale of plots in New Grain Market which was developed after the acquisition.
\nThe only sale deed which is most relevant piece of evidence is sale deed (Ex. P4)
\ndated 9.5.1995 which is a part of the acquired land. In this sale deed, merely one
\nmarla of land was sold for Rs. 5,000\/- at an average rate of Rs. 8,00,000\/- per acre.\n<\/p>\n
               Now the question is as to how much cut is to be applied for the
\npurpose of determination of fair value of the acquired land. The genuineness of
\nsale deed (Ex. P4) is not doubted by the State. However, the fact cannot be
\ndisputed that the transaction therein was for one marla of land which necessarily
\nwas for commercial purpose and situated on the main road. Consider the fact that
\nsale deed (Ex. P4) was executed on 9.5.1995 and the acquisition in the present is
\nnearly 2-1\/2 years thereafter, I deem it appropriate to grant 25% increase thereon
\n R.F.A. No.1930 of 2005                                             [9]<\/p>\n
for this period and take the value thereof on the date of acquisition at Rs.
\n10,00,000\/- per acre. As far as the cut applied by the learned Court below to the
\ntune of 70% is concerned, I do not find any infirmity therein keeping in view the
\nsale deed relied upon which is for one marla of land and the acquisition being
\n60.02 acres of land. Accordingly, applying cut of 70%, the value of the acquired
\nland upto the depth of one acre is assessed at Rs. 3,00,000\/- per acre as against Rs.
\n2,40,000\/- per acre, awarded by the learned court below. The value of the land
\nbehind that is increased in the same proportion as was assessed by the learned
\ncourt below and the same is assessed at Rs. 2,55,000\/- per acre. The land owners
\nshall also be entitled to the statutory benefits available under the Act.\n<\/p>\n
               For the reasons mentioned above, the appeals filed by the land
\nowners are allowed, whereas the appeals filed by the Market Committee are
\ndismissed.\n<\/p>\n
