of\u00a0tenancy\u00a0created\u00a0by\u00a0Respondent\u00a0No.\u00a04\u00ad\u00a0Santhal\u00a0Pargana\u00a0Khadi\u00a0Gram\u00a0Udyog\u00a0Samiti,\u00a0<br \/>\n             Deoghar.\u00a0\n<\/p>\n<p>                     The \u00a0 submission \u00a0 is \u00a0 that \u00a0 the \u00a0 petitioners \u00a0 are \u00a0 in \u00a0 occupation \u00a0 of \u00a0 the \u00a0 shops\u00a0<br \/>\n             constructed\u00a0by\u00a0Respondent\u00a0No.\u00a04\u00a0on\u00a0the\u00a0land\u00a0leased\u00a0out\u00a0by\u00a0the\u00a0State\u00a0Government\u00a0<br \/>\n             after \u00a0 the \u00a0 expiry \u00a0 of \u00a0 lease. \u00a0 Respondent \u00a0 No. \u00a0 4, \u00a0 who \u00a0 was \u00a0 permitted \u00a0 to \u00a0 continue \u00a0 in\u00a0<br \/>\n             possession\u00a0and\u00a0the\u00a0shops\u00a0were\u00a0constructed\u00a0and\u00a0given\u00a0out\u00a0on\u00a0rent.\u00a0The\u00a0argument\u00a0is\u00a0<br \/>\n             that\u00a0the\u00a0order\u00a0of\u00a0eviction\u00a0passed\u00a0by\u00a0Sub\u00adDivisional\u00a0Officer,\u00a0is\u00a0without\u00a0jurisdiction.\u00a0\n<\/p>\n<p>                     The \u00a0 State \u00a0 counsel \u00a0 has \u00a0 prayed \u00a0 for \u00a0 and \u00a0 is \u00a0 allowed \u00a0 four \u00a0 weeks&#8217; \u00a0 time \u00a0 to \u00a0 file\u00a0<br \/>\n             counter\u00a0affidavit.\u00a0\n<\/p>\n<p>                     Issue\u00a0notice\u00a0to\u00a0Respondent\u00a0No.\u00a04.\n<\/p>\n<p>                     Returnable\u00a0at\u00a0an\u00a0early\u00a0date.\u00a0\u00a0\n<\/p>\n<p> The\u00a0petitioners\u00a0have\u00a0preferred\u00a0the\u00a0Title\u00a0Suit\u00a0no.\u00a048\u00a0of\u00a02008,\u00a0which\u00a0is\u00a0pending\u00a0<br \/>\n          before\u00a0the\u00a0trial\u00a0court\u00a0and\u00a0an\u00a0application\u00a0for\u00a0interim\u00a0injunction\u00a0under\u00a0Order\u00a039\u00a0Rule\u00a0<br \/>\n          1\u00a0and\u00a02\u00a0C.P.C.\u00a0was\u00a0moved\u00a0to\u00a0restrain\u00a0the\u00a0respondent\u00a0from\u00a0making\u00a0any\u00a0construction\u00a0<br \/>\n          adjacent\u00a0to\u00a0the\u00a0boundary\u00a0wall\u00a0of\u00a0the\u00a0suit\u00a0property.\u00a0\n<\/p>\n<p>                  The\u00a0grievance\u00a0of\u00a0the\u00a0petitioner\u00a0is\u00a0that\u00a0no\u00a0place\u00a0is\u00a0left\u00a0beyond\u00a0the\u00a0boundary\u00a0<br \/>\n          wall\u00a0of\u00a0the\u00a0petitioner\u00a0and\u00a0there\u00a0might\u00a0be\u00a0an\u00a0occasion,\u00a0the\u00a0petitioner\u00a0would\u00a0want\u00a0to\u00a0<br \/>\n          open\u00a0a\u00a0gate\u00a0or\u00a0do\u00a0anything\u00a0else\u00a0adjacent\u00a0to\u00a0the\u00a0suit\u00a0property\u00a0and\u00a0then,\u00a0it\u00a0will\u00a0be\u00a0<br \/>\n          difficult \u00a0 for \u00a0 them \u00a0 to \u00a0 do \u00a0 so. \u00a0 Even \u00a0 if \u00a0 the \u00a0 road \u00a0 is \u00a0 to \u00a0 be \u00a0 constructed, \u00a0 it \u00a0 will \u00a0 cause\u00a0<br \/>\n          difficulty\u00a0and,\u00a0therefore,\u00a0the\u00a0injunction\u00a0application.\u00a0The\u00a0said\u00a0application\u00a0was\u00a0rejected\u00a0<br \/>\n          by\u00a0the\u00a0trial\u00a0court\u00a0and\u00a0it\u00a0was\u00a0challenged\u00a0in\u00a0the\u00a0Miscellaneous\u00a0Appeal,\u00a0which\u00a0has\u00a0also\u00a0<br \/>\n          been\u00a0rejected.\n<\/p>\n<p>                  I\u00a0have\u00a0perused\u00a0the\u00a0impugned\u00a0order,\u00a0it\u00a0is\u00a0an\u00a0admitted\u00a0case\u00a0of\u00a0the\u00a0petitioner\u00a0<br \/>\n          that\u00a0the\u00a0injunction\u00a0is\u00a0being\u00a0sought\u00a0on\u00a0the\u00a0land\u00a0which\u00a0is\u00a0adjacent\u00a0to\u00a0the\u00a0suit\u00a0property\u00a0<br \/>\n          and\u00a0not\u00a0owned\u00a0by\u00a0the\u00a0plaintiff\u00a0himself.\u00a0The\u00a0insistence\u00a0is\u00a0that\u00a0the\u00a0construction\u00a0work\u00a0<br \/>\n          carried\u00a0out\u00a0by\u00a0the\u00a0State\u00a0Government\u00a0may\u00a0at\u00a0least\u00a0be\u00a0shifted\u00a020\u00a0feet\u00a0away\u00a0of\u00a0the\u00a0<br \/>\n          boundary\u00a0wall\u00a0of\u00a0the\u00a0petitioner\u00a0so\u00a0that\u00a0in\u00a0future,\u00a0if\u00a0road\u00a0etc.\u00a0is\u00a0to\u00a0be\u00a0constructed,\u00a0<br \/>\n          there\u00a0will\u00a0be\u00a0no\u00a0difficulty.\u00a0Thus,\u00a0the\u00a0injunction\u00a0sought\u00a0is\u00a0for\u00a0a\u00a0possible\u00a0construction\u00a0<br \/>\n          in\u00a0near\u00a0future.\u00a0The\u00a0learned\u00a0District\u00a0Judge\u00a0has\u00a0refused\u00a0the\u00a0prayer\u00a0of\u00a0the\u00a0plaintiff\u00a0on\u00a0<br \/>\n          the\u00a0ground,\u00a0if\u00a0at\u00a0all,\u00a0the\u00a0petitioner\u00a0has\u00a0any\u00a0grievance\u00a0that\u00a0the\u00a0municipal\u00a0laws\u00a0are\u00a0<br \/>\n          being\u00a0violated\u00a0then,\u00a0the\u00a0plaintiff\u00a0should\u00a0approach\u00a0the\u00a0municipal\u00a0authority\u00a0and\u00a0raise\u00a0<br \/>\n          his\u00a0grievance\u00a0under\u00a0the\u00a0municipal\u00a0laws.\u00a0It\u00a0goes\u00a0without\u00a0saying\u00a0that\u00a0the\u00a0right\u00a0to\u00a0raise\u00a0<br \/>\n          his\u00a0 objection \u00a0before \u00a0 the \u00a0 municipal \u00a0 authority \u00a0 is\u00a0 not \u00a0hampered \u00a0 by \u00a0refusal \u00a0 to \u00a0 grant\u00a0<br \/>\n          temporary\u00a0injunction.\u00a0\n<\/p>\n<p>                  I\u00a0do\u00a0not\u00a0find\u00a0any\u00a0error\u00a0in\u00a0the\u00a0impugned\u00a0judgment.\u00a0The\u00a0petitioner\u00a0has\u00a0not\u00a0been\u00a0<br \/>\n          able\u00a0to\u00a0make\u00a0out\u00a0a\u00a0case\u00a0for\u00a0interim\u00a0injunction\u00a0or\u00a0any\u00a0right\u00a0on\u00a0the\u00a0property\u00a0on\u00a0which\u00a0<br \/>\n          the\u00a0interim\u00a0injunction\u00a0is\u00a0being\u00a0claimed.\u00a0In\u00a0absence\u00a0of\u00a0any\u00a0right,\u00a0there\u00a0is\u00a0no\u00a0question\u00a0<br \/>\n          of\u00a0irreparable\u00a0loss\u00a0or\u00a0any\u00a0other\u00a0loss\u00a0in\u00a0terms\u00a0of\u00a0money\u00a0which\u00a0cannot\u00a0be\u00a0compensated\u00a0<br \/>\n         in\u00a0future\u00a0and\u00a0regarding\u00a0balance\u00a0of\u00a0convenience\u00a0as\u00a0well.\u00a0In\u00a0view\u00a0of\u00a0the\u00a0absence\u00a0of\u00a0all\u00a0<br \/>\n         these\u00a0three\u00a0cardinal\u00a0requirement\u00a0for\u00a0grant\u00a0of\u00a0interim\u00a0injunction,\u00a0I\u00a0am\u00a0of\u00a0considered\u00a0<br \/>\n
