SHAH\n\t\t\n\t\n\n \n\nDate\n: 26\/08\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tPresent<br \/>\nSpecial Criminal Application has been preferred by the petitioner &#8211;<br \/>\noriginal complainant for the following reliefs:\n<\/p>\n<p>7(A)\tThat this<br \/>\nHonourable Court will be pleased to issue appropriate writ, order or<br \/>\ndirection in the nature of mandamus or certiorari or any other<br \/>\nappropriate writ, order or direction to direct respondent No.1 to<br \/>\norder to transfer the investigation of the offence being C.R. No.I-84<br \/>\nof 2011 A.D. registered with Bopal Police Station to State CID<br \/>\n(Crime) or to any other independent Police Agency or to the Central<br \/>\nBureau of Investigation;\n<\/p>\n<p>(B)\t That this<br \/>\nHonourable Court will be pleased to stay the further investigation<br \/>\ninto the offence by the Investigating Agency of Bopal Police Station<br \/>\ninto the offence being C.R. No.I-84 of 2011 A.D. Registered with<br \/>\nBopal Police Station till and pending hearing and final disposal of<br \/>\nthis petition;\n<\/p>\n<p>(C)\t That this<br \/>\nHonourable Court will be pleased to restrain the respondents or their<br \/>\nagents from submitting any report before the competent Magistrate<br \/>\nCourt either for taking cognizance or praying for a Summary of A, B<br \/>\nor C under section 158 or 169 of the Criminal Procedure Code or<br \/>\notherwise in connection with C.R.No.I 84 of 2011 registered with<br \/>\nBopal Police Station, till and pending hearing and final disposal of<br \/>\nthe petition;\n<\/p>\n<p>2.\tAt the outset<br \/>\nit is required to be noted that as the FIR has been  lodged only on<br \/>\nor about 8th August 2011, sufficient time it to be given<br \/>\nto the concerned Investigating Officer to investigate into the case<br \/>\nand if thereafter it is found that the investigation has not been<br \/>\nconducted in a fair and impartial manner and\/or in the right<br \/>\ndirection, the prayer of the petitioner can be considered.<br \/>\nConsidering the above, present Special Criminal Application is not<br \/>\nentertained at this stage.  However, in the facts and circumstances<br \/>\nof the case and considering the case on behalf of the petitioner that<br \/>\nthe FIR was lodged only after the order passed by this Court in<br \/>\nSpecial Criminal Application No.1809\/2011 and the concerned I.O.<br \/>\nmight not investigate the case properly and\/or in right direction, it<br \/>\nis directed that the investigation of the said FIR be supervised by<br \/>\nthe higher Officer not below the rank of Dy.S.P., Ahmedabad (Rural)<br \/>\nand no final report shall be submitted by the concerned I.O. without<br \/>\nprior approval of the said Officer.\n<\/p>\n<p>3.\tWith this,<br \/>\npresent Special Criminal Application is disposed of at this stage.<br \/>\nDirect service is permitted.\n<\/p>\n<p>\t\t\t\t\t\t\t\t(M.R.\n<\/p>\n<p>Shah, J.)<\/p>\n<p>*menon<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Gambhirsinh vs State on 26 August, 2011 Author: M.R.
