Joshi, learned advocate appearing for the petitioner and Mr.<br \/>\n\tRashesh Rindani, learned Assistant Government Pleader appearing for<br \/>\n\tthe respondent No.1 on an advance copy being served to the<br \/>\n\tGovernment Pleader&#8217;s office.\n<\/p>\n<p>\tIt is the case<br \/>\n\tof the petitioner that the petitioner was studying in the Second<br \/>\n\tYear Pharmacy in Tolani Institute of Pharmacy, Adiput   Kutch.<br \/>\n\tThe petitioner had already completed first year and had appeared in<br \/>\n\tthe examination of ATKT while studying in the second year. The<br \/>\n\tpetitioner in the first year cleared three subjects which are<br \/>\n\tBio-Chemistry, Human Anatomy and Health Education and was failed in<br \/>\n\tthree subjects which are Pharmaceutics, Pharmaceutical Chemistry and<br \/>\n\tPharmacognocy.\n<\/p>\n<p>\tIt is also the<br \/>\n\tcase of the petitioner that in the month of September 2009, the<br \/>\n\tpetitioner had appeared in three subjects in which the petitioner<br \/>\n\twas failed and on 19.09.2009, in the last paper, the checking squad<br \/>\n\thad recovered some literature from the petitioner and the petitioner<br \/>\n\twas asked to appear before Unfair Means Committee.  The said<br \/>\n\tCommittee found the petitioner guilty and punished the petitioner as<br \/>\n\tper Rule 3G and accordingly, the petitioner&#8217;s result was cancelled<br \/>\n\tand the petitioner was debarred to appear in subsequent examination.\n<\/p>\n<p>\tThe said<br \/>\n\tdecision of the Committee was challenged by the petitioner by filing<br \/>\n\tSpecial Civil Application No.258 of 2010.  The said petition was<br \/>\n\twithdrawn by the petitioner.  Thereafter, the petitioner made an<br \/>\n\tapplication on 17.02.2010 with specific prayer that exactly, what<br \/>\n\tpunishment was imposed on the petitioner and the petitioner was not<br \/>\n\tallowed to appear in which examination.  The said application was<br \/>\n\treplied to on 23.02.2010 and it was stated that the decision taken<br \/>\n\tearlier was just and proper and no reconsideration is necessary.\n<\/p>\n<p>\tMr. Joshi has<br \/>\n\tsubmitted that this is double jeopardy.  The petitioner&#8217;s result was<br \/>\n\tcancelled and again the petitioner was not permitted to appear in<br \/>\n\tthe examination.  He has, therefore, submitted that the indulgence<br \/>\n\tof this Court is necessary and necessary directions be issued to the<br \/>\n\trespondents so that the petitioner can appear in the examination at<br \/>\n\tleast for remedial examination which is scheduled to be held in<br \/>\n\tMarch, 2010.\n<\/p>\n<p>\tMr. Rashesh<br \/>\n\tRindani, learned advocate appearing for the respondent No.1, on the<br \/>\n\tother hand, has submitted that the punishment was imposed under Rule<br \/>\n\t3-G which is very clear.  It says that when the petitioner is found<br \/>\n\tto be guilty, the result is required to be declared fail in all the<br \/>\n\tsubjects for which he \/ she has appeared in the respective Semester<br \/>\n\tUniversity examination and he \/ she is not allowed to appear in the<br \/>\n\tnext same Semester regular examination.  For instance, a student is<br \/>\n\treported under UFM during Sem-II examination in the year June-09,<br \/>\n\tthen he\/she is not eligible to appear in next year i.e. June-10<br \/>\n\tSem-II regular examination.  In short, he\/she can appear in June-11<br \/>\n\tSem.-II regular examinations to be conducted by University.  He has,<br \/>\n\ttherefore, submitted that considering Rule 3-G, the petitioner&#8217;s<br \/>\n\tprayer for allowing her to appear in March, 2010 examination is<br \/>\n\tcontrary to the said Rule and the petitioner can appear in the<br \/>\n\texamination only in 2011.\n<\/p>\n<p>\tHaving<br \/>\n\tconsidered this fact and submissions of the parties, the Court is of<br \/>\n\tthe view that the decision taken by the respondent authorities does<br \/>\n\tnot call for any interference by this Court.  It is crystal clear<br \/>\n\tthat the petitioner can appear now only in 2011 examination and the<br \/>\n\tpetitioner&#8217;s challenge to the decision of the Committee was already<br \/>\n\trejected by this Court.\n<\/p>\n<p>Subject<br \/>\n\tto the above clarification, this petition is accordingly disposed<br \/>\n\tof.\n<\/p>\n<p>\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t\t[K.
