DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 01\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\npetitioner &#8211; externee has filed this petition under Article 226<br \/>\nof the Constitution of India read with Section 56 of the Bombay<br \/>\nPolice Act with the following main prayers :-\n<\/p>\n<p>&#8220;(A)\tBe<br \/>\npleased to issue a writ of mandamus or any other writ quashing or<br \/>\nsetting aside the order at Annxure B of the Deputy Police<br \/>\nCommissioner, Zone 1, Surat City passed on 26.08.2010.\n<\/p>\n<p>(B)\tPending<br \/>\nadmission, hearing and final disposal of this petition, the execution<br \/>\nand operation of the order at Annexure B of the Deputy Police<br \/>\nCommissioner, Zone 1, Surat City passed on 26.08.2010 be stayed and<br \/>\nthe petitioner be permitted to enter Surat city limits.&#8221;\n<\/p>\n<p>2.\tMr.H.B.Shethna,<br \/>\nlearned counsel for the petitioner would contend that for the<br \/>\noffences registered under sections 454, 457, 380, 114 &amp; 411 of<br \/>\nthe Indian Penal Code vide CR No.I-284\/2009 at Varachha Police<br \/>\nStation on 25.08.2009, a show cause notice under section 56 of the<br \/>\nBombay Police Act, 1951 Act is given on 10.04.2010 after a period of<br \/>\nabout 5\u00bd months and there is no proximity with the  cause for<br \/>\nwhich powers have been exercised by the authority.  Learned counsel<br \/>\nwould also contend that the allegations levelled against the externee<br \/>\nare restricted for very small area of Surat city and externing the<br \/>\npetitioner from adjoining districts of Surat city is also<br \/>\ndisproportionate to the alleged illegal activities and the order<br \/>\npassed by the competent authority on 26.08.2010 is served upon the<br \/>\nexternee on 14.12.2010 much after the period of appeal to be<br \/>\npreferred before the appellate authority  and under section 60 of the<br \/>\nAct, has lapsed and expired.  In the above circumstances, writ<br \/>\npetition may be considered to be maintainable and not barred by<br \/>\nefficacious alternative remedy.  In support of his arguments, learned<br \/>\ncounsel for the petitioner relied upon the following decisions:\n<\/p>\n<p>[1]\t<a href=\"\/doc\/479518\/\">Jawahar<br \/>\nPanalal v. Sub Divisional Magistrate<\/a> \t[1963(1) Cri. \tL.J. 263<br \/>\n(Vol.66, C.N.74)]<\/p>\n<p>[2]\t<a href=\"\/doc\/1506559\/\">Koli<br \/>\n Dana  Nathu v. G.Ghosh, Sub-Div. Mag. Rajkot<\/a> \t[1973 GLR \t209]<\/p>\n<p>[3]\tSudhir<br \/>\nMakanji Kanar v. Dy. Commissioner of Police [1991(2) \tGLH (U.J.) 24]<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Desai, learned APP submits that powers have been exercised by the<br \/>\ncompetent authority and provisions of appeal under section 60 of the<br \/>\nBombay Police Act would make this Court loath in exercising<br \/>\njurisdiction under section 226 of the Constitution of India.  In<br \/>\naddition to the above, it is submitted that offences were registered<br \/>\nand statements of certain witnesses recoded on 30.03.2010 would show<br \/>\nthat activities of the petitioner were prejudicial not only to the<br \/>\nlaw and order but to the public order and, therefore, the authority<br \/>\nhas exercised powers in accordance with law.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned advocates for the parties, on perusal of record of the<br \/>\ncase and the decisions relied upon by the learned counsel for the<br \/>\npetitioner, exercise of powers by writ court in a given case was held<br \/>\nto be just and proper when powers exercised by the authority and<br \/>\norder passed are ultra vires.  Even considering the submissions on<br \/>\nmerit about delay in passing the order dated 26.08.2010 by the<br \/>\ncompetent authority under the Act after about 5\u00bd months would<br \/>\ngo to show that such exercise of powers is at a very belated stage<br \/>\nwhen the cause no more existed to extern the petitioner and thus<br \/>\ndepriving his right to life and liberty.  The statements dated<br \/>\n30.03.2010 recorded by unknown witnesses are nothing but a recital<br \/>\nabout alleged illegal activities for which the petitioner could not<br \/>\nhave been externed from about six adjoining district of Surat for a<br \/>\nperiod of 2 years.  The above aspect would go show that when the area<br \/>\nof alleged illegal activities was within the city limits of Surat,<br \/>\nexterning the petitioner from adjoining six districts is not<br \/>\njustified.  Therefore, considering the law laid down by the court in<br \/>\nthe above decisions, I am inclined to quash and set aside the order<br \/>\ndated 26.08.2010 passed by the Deputy Police Commissioner, Zone 1,<br \/>\nSurat and is hereby quashed and set aside.\n<\/p>\n<p>\tAccordingly,<br \/>\nthis petition is allowed.  Rule is made absolute to the aforesaid<br \/>\nextent only.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>[Anant<br \/>\nS.
