Saiyed, learned counsel for the appellants and Mr.H.L. Jani,<br \/>\n\tlearned Additional<br \/>\n\tPublic Prosecutor for respondent-State.\n<\/p>\n<p>Mr.Saiyed<br \/>\n\thas produced on record authority letter of the appellants, viz.<br \/>\n\tDashrathbhai Keshavbhai Vankar and Jadiben Keshavbhai Vankar and<br \/>\n\tcontended that the appellants have filed two appeals, i.e. Criminal<br \/>\n\tAppeal No.961 of 2000 and Criminal Appeal No.971 of 2000, against<br \/>\n\tthe judgment and order dated 20th October, 2000 passed by<br \/>\n\tthe learned 3rd Joint District Judge, Kheda at Nadiad.<br \/>\n\tThe appellants also submitted in their letter that first they had<br \/>\n\tfiled Criminal Appeal No.961 of 2000 and subsequently Criminal<br \/>\n\tAppeal No.971 of 2000 was filed. Therefore, the appellants seek<br \/>\n\tpermission to withdraw the present appeal. Mr.Saiyed has contended<br \/>\n\tthat the said authority letter is also sent to Mr.U.I. Vyas, learned<br \/>\n\tcounsel for the appellants in the present appeal through RPAD as<br \/>\n\twell as Courier.\n<\/p>\n<p>I<br \/>\n\thave perused the letter of the appellants as also receipt of RPAD<br \/>\n\tand courier. It appears that both the appeals, i.e. Criminal Appeal<br \/>\n\tNo.961 of 2000 and Criminal Appeal No.971 of 2000, are filed against<br \/>\n\tthe judgment and order dated 20th October, 2000 passed by<br \/>\n\tthe learned 3rd Joint District Judge, Kheda at Nadiad.\n<\/p>\n<p>Hence,<br \/>\n\tprayer as prayed for by the appellants, is granted. Present appeal<br \/>\n\tbeing Criminal Appeal No.971 of 2000 is hereby disposed of as<br \/>\n\twithdrawn.
