       The petitioner is presently working as<\/p>\n
a  Pharmacist    in     the     Taluk       Headquarters<\/p>\n
Hospital, Kodungallur. His wife is employed in<\/p>\n
the Military as a Military Nursing Officer.<\/p>\n
The petitioner is the only son of his parents.<\/p>\n
His father passed away in 2007. His mother is<\/p>\n
aged 60 years.      Apparently, his presence in<\/p>\n
Pathanamthitta District is highly necessary,<\/p>\n
he contends. This is mainly for the reason<\/p>\n
that his two sons are being looked after by<\/p>\n
his aged and ailing mother at Thiruvalla.           The<\/p>\n
petitioner   sought        for      a      posting   in<\/p>\n
Pathanamthitta   District,        on     inter-district<\/p>\n
transfer and the same was actually granted to<\/p>\n
him as per Ext.P3 dated 23.5.2002. For want of<\/p>\n
vacancies,  he    could      not    be    accommodated.<\/p>\n
Exts.P4 and P5 are subsequent applications<\/p>\n
submitted by the petitioner. Pursuant to the<\/p>\n
direction issued in Ext.P6 judgment, Ext.P7<\/p>\n
W.P.(C).NO.20521\/08<\/p>\n
                     :: 2 ::\n<\/p>\n
\norder was passed by the Additional Director<\/p>\n
of   Health   Services,     stating  that   the<\/p>\n
petitioner’s request could be considered only<\/p>\n
when  vacancies   of inter-district    transfer<\/p>\n
arise in Pathanamthitta District.     The same<\/p>\n
has been challenged in this writ petition.<\/p>\n
       2. In the facts and circumstances of<\/p>\n
the case, the Government Pleader was directed<\/p>\n
to get instructions whether there is an open<\/p>\n
vacancy in the post of Pharmacist in the<\/p>\n
Health Services Department, available in the<\/p>\n
Primary Health Centre at Konni, taking note<\/p>\n
of the submission made by the learned counsel<\/p>\n
for the petitioner.\n<\/p>\n
       3.   Learned  Government    Pleader, on<\/p>\n
instructions, submits that there is a vacancy<\/p>\n
in Konni brought about by the deputation of<\/p>\n
an incumbent to the Kerala Medical Services<\/p>\n
Corporation, Palakkad. This is borne out by<\/p>\n
Exts.P13 and P14 produced by the petitioner,<\/p>\n
along with I.A.No.8929\/08.<\/p>\n

       4. In the circumstances, the writ<\/p>\n
petition   is   disposed     of  directing  the<\/p>\n
Director of Health Services-2nd respondent to<\/p>\n
pass orders posting the petitioner against<\/p>\n
the  vacancy   in  the     post of   Pharmacist,<\/p>\n
currently available at Primary Health Centre,<\/p>\n
Konni, brought about by the deputation of<\/p>\n
Sri.A.Haridasan    to    the    Kerala  Medical<\/p>\n
Services Corporation, Palakkad, as evidenced<\/p>\n
by Ext.P13. The 2nd respondent shall pass<\/p>\n
orders posting the petitioner at Konni at the<\/p>\n
earliest, at any rate, within two weeks from<\/p>\n
the  date  of   receipt of     a copy of   this<\/p>\n
judgment.   It   is   made    clear   that   the<\/p>\n
petitioner would be vulnerable to be relieved<\/p>\n
from Konni, if the deputationist is brought<\/p>\n
back,   either    on   cancellation    of    the<\/p>\n
deputation or on the expiry of the period of<\/p>\n
deputation.\n<\/p>\n
         In the meanwhile, the petitioner’s<\/p>\n
request   for    posting     in   Pathanamthitta<\/p>\n
District, on inter-district transfer, shall<\/p>\n
W.P.(C).NO.20521\/08<\/p>\n
                      :: 4 ::\n<\/p>\n
\nbe considered by the Government and a fresh<\/p>\n
order may be passed, in that regard, on<\/p>\n
Ext.P12, within a period of three months from<\/p>\n
the  date  of   receipt of     a copy of   this<\/p>\n
judgment. The Government shall take note of<\/p>\n
Ext.P3  order,   whereby     his eligibility to<\/p>\n
inter-district transfer to Pathanamthitta has<\/p>\n
been  found  in   his  favour,    while  passing<\/p>\n
orders on Ext.P12.\n<\/p>\n
       The petitioner shall produce a copy<\/p>\n
of this judgment along with a copy of the<\/p>\n
writ petition before respondents 1 and 2 for<\/p>\n
compliance.\n<\/p>\n<\/p>\n
