However, he<br \/>\nsubmitted that the role attributed with particular weapon and the<br \/>\ninjury is narrated in the First Information Report itself whereas<br \/>\nthe applicants<br \/>\nwho are alleged to have armed with sticks are said to have been<br \/>\nmentioned in the First Information Report with rest of the persons<br \/>\nassaulted with sticks. He submitted, that, therefore, other<br \/>\nco-accused with a similar role have been released as per order passed<br \/>\nin Criminal Miscellaneous Application No.10414 of 2010 vide order<br \/>\ndated 15.09.2010, and, therefore, present application may be allowed.\n<\/p>\n<p>4.\tLearned<br \/>\nAdditional Public Prosecutor Mr.D.C.Sejpal for State resisted the<br \/>\napplication and submitted that though they are all alleged to have<br \/>\nassaulted with sticks, present application may not be entertained as<br \/>\noffence is punishable under section 302 of Indian Penal Code.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned advocate Mr.Tejas Barot for applicants and Mr.Sejpal,<br \/>\nlearned APP for State and having considered the nature of offence,<br \/>\nmanner in which it is alleged to have been committed, role attributed<br \/>\nparticularly referring to the role attributed to other co-accused who<br \/>\nhave assaulted with a particular weapon are not released but the<br \/>\nother co-accused with a similar role alleged to have armed with<br \/>\nsticks, have been released as per order passed in Criminal<br \/>\nMiscellaneous Application No.10414 of 2010 vide order dated<br \/>\n15.09.2010, and also considering the fact that other co-accused have<br \/>\nbeen released and the similar role attributed to the applicants<br \/>\nherein, present application deserves to be allowed.\n<\/p>\n<p>6.\tAccordingly,<br \/>\npresent application stands allowed. The applicant is ordered to be<br \/>\nreleased on regular bail in connection with FIR being I-C.R.No.46 of<br \/>\n2010 registered with Dakor<br \/>\nPolice Station on their executing bond of Rs.5,000\/- (Rupees Five<br \/>\nThousand) each with one solvent surety each of the like amount to the<br \/>\nsatisfaction of the lower Court and subject to the conditions that<br \/>\nthey shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\ntheir presence before concerned Police Station on every 1st<br \/>\nMonday of English calender month between 11:00 AM to 2:00 PM till the<br \/>\ntrial commences.\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of their residence to the Investigating Officer and also<br \/>\nto the Court at the time of execution of the bond and shall not<br \/>\nchange their residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\ntheir passport, if any, to the lower Court, within a week.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute to the aforesaid extent.
