           Plaintiff Attam Parkash filed a suit for possession of the<\/p>\n
property in dispute and the same was dismissed by the Additional<\/p>\n
Senior Sub Judge, Gohana vide judgment and decree dated<\/p>\n
24.8.1993. In appeal, the said judgment and decree were set aside<\/p>\n
by Additional District Judge, Sonepat vide judgment and decree<\/p>\n
dated 30.11.1995 and the suit of the plaintiff was decreed with costs.<\/p>\n
Hence, the present appeal by the defendant.\n<\/p>\n
 R.S.A.No. 113 of 1996                                           2<\/span><\/p>\n
           Brief facts of the case, as noticed by the lower appellate<\/p>\n
Court in para Nos. 2 and 3 of its judgment, are as under:-<\/p>\n
            “2.          Undoubtedly, the plaintiff was a tenant under<\/p>\n
            the defendant qua the godown at the rental of Rs.55\/- per<\/p>\n
            mensem, which was allegedly put on fire by the defendant<\/p>\n
            and his son Om Parkash on the night intervening                  1\/<\/p>\n
            2.5.1984. As a result thereof, many rafters of the godown<\/p>\n
            were damaged, which required replacement.                       The<\/p>\n
            defendant, after having replaced the same, put his lock<\/p>\n
            thereon, which he agreed to remove only if he withdraws<\/p>\n
            his police case.\n<\/p><\/blockquote>\n
            3.           The defendant admitted the factum of fire but<\/p>\n
            disputed that he had a hand therein. He further admitted<\/p>\n
            the registration of the case against him which, on enquiry,<\/p>\n
            was found to be false. He further admitted the factum of<\/p>\n
            handing over the key by the plaintiff to him which,<\/p>\n
            according to him, was given in pursuance of a<\/p>\n
            compromise arrived at with the intervention of the<\/p>\n
            panchayat.        The defendant has accordingly set up the<\/p>\n
            plea of estoppel and further claimed special damage from<\/p>\n
            the plaintiff.”<\/p><\/blockquote>\n
           On the pleadings of the parties, following issues were<\/p>\n
framed by the trial Court:-\n<\/p>\n
            “1.          Whether     the   plaintiff   is   entitled   to   the
\n R.S.A.No. 113 of 1996                                        3<\/span><\/p>\n
             possession of the suit property? OPP<\/p>\n<\/blockquote>\n
             2.         Whether the suit is barred by limitation? OPD<\/p>\n<\/blockquote>\n
             3.         Whether the suit is not maintainable in the<\/p>\n
             present form? OPD<\/p>\n<\/blockquote>\n
             4.         Whether the plaintiff is estopped by his own<\/p>\n
             act and conduct to file the present suit? OPD<\/p>\n<\/blockquote>\n
             5.         Whether the defendant is entitled to special<\/p>\n
             costs u\/s 35A CPC? OPD<\/p>\n<\/blockquote>\n
             6.         Relief. “<\/p><\/blockquote>\n
             After hearing learned counsel for the parties, I am of the<\/p>\n
opinion that the present appeal deserves to be allowed.<\/p>\n
             The substantial question of law involved in this case is<\/p>\n
” whether the lower Appellate Court has drawn wrong inferences from<\/p>\n
the unproved facts and based its findings on mere conjectures and<\/p>\n
surmises?”\n<\/p>\n
             Plaintiff-Attam Parkash had filed a suit for possession on<\/p>\n
the ground that he was a tenant over the property in dispute and had<\/p>\n
handed over the keys of the same to the defendant landlord to get<\/p>\n
the same repaired. The case of defendant Sambhu Ram, on the<\/p>\n
other hand, was that the tenancy had come to an end and due to this<\/p>\n
reason, the plaintiff had handed over the keys of the demised<\/p>\n
premises to him.\n<\/p>\n
             Parties had led oral evidence in support of their case. So<\/p>\n
far as the plaintiff is concerned, he himself appeared in the witness
\n R.S.A.No. 113 of 1996                                     4<\/span><\/p>\n
box as PW-1 and closed his evidence. The defendant, on the other<\/p>\n
hand, himself appeared in the witness box as DW-1 and examined<\/p>\n
DW-2 Sahib Singh and DW-3 Keso Ram. There is no rent deed on<\/p>\n
record to establish the terms and conditions of the tenancy.<\/p>\n
Admittedly, plaintiff had taken the godown in dispute on rent from the<\/p>\n
defendant. A fire broke out in the said premises and the plaintiff<\/p>\n
handed over the keys to the defendant. The question that requires<\/p>\n
consideration is as to whether on handing over of the keys by the<\/p>\n
plaintiff to the defendant, the tenancy had come to an end or whether<\/p>\n
the keys had been handed over by the plaintiff to the defendant for<\/p>\n
the purposes of repair of the godown in question.<\/p>\n
             In this regard there is no documentary evidence on<\/p>\n
record. Plaintiff, while appearing in the witness box had deposed as<\/p>\n
per the contents of the plaint. However, the statement of the plaintiff<\/p>\n
is not corroborated by any other evidence. On the other hand, while<\/p>\n
appearing in the witness box as DW-1, the defendant had deposed<\/p>\n
as per the contents of the written statement.       DW-2 Keso Ram<\/p>\n
deposed that in the Panchayat it was decided that both the parties<\/p>\n
will bear their own loses.   A reading of cross-examination of the<\/p>\n
plaintiff also reveals that some agreement was entered between the<\/p>\n
parties in the panchayat. The matter was also reported to the police.<\/p>\n
However, the said proceedings had not been proved on record by the<\/p>\n
plaintiff.   In the absence of any written terms and conditions<\/p>\n
regarding the tenancy and any evidence corroborating the oral

statement of the plaintiff, the lower Appellate Court had based its<\/p>\n
findings on mere conjectures and surmises. In fact, the plaintiff had<\/p>\n
failed to prove his case. Since the plaintiff had handed over the keys<\/p>\n
of the godown in question to the defendant, it raises a presumption<\/p>\n
that the same were handed over with a view to put an end to the<\/p>\n
tenancy as there are no written terms and conditions of the tenancy<\/p>\n
on record to hold otherwise.\n<\/p>\n
           It is a settled proposition of law that the plaintiff has to<\/p>\n
plead and prove his case and has to stand on his legs and cannot<\/p>\n
draw any benefit from the weakness in evidence led by the<\/p>\n
defendant. Lower Appellate Court in the facts and circumstances of<\/p>\n
the present case had, thus, erred in decreeing the suit of the plaintiff<\/p>\n
merely on the basis of uncorroborated oral testimony of the plaintiff<\/p>\n
and had, thus, drawn wrong inferences from the facts, which were<\/p>\n
never proved on record and had based its findings on mere<\/p>\n
conjectures and surmises. Hence, the substantial question of law<\/p>\n
arising in this appeal is answered accordingly.<\/p>\n
           Consequently, this appeal is allowed.        The impugned<\/p>\n
judgment and decree of the lower Appellate Court are set aside and<\/p>\n
the judgment and decree of the trial Court are upheld.<\/p>\n
           No order as to costs.\n<\/p>\n<\/p>\n
