No.13451 of 2009<\/p>\n<p>             Application allowed, written statement is taken on record.<\/p>\n<p>CWP No.10296 of 2009<\/p>\n<p>             This writ petition has been filed to lay challenge to the notice<\/p>\n<p>issued by the respondent-Bank under Section 13(4) of the Securitization and<\/p>\n<p>Reconstruction of Financial Assets and Enforcement of Security Interest<\/p>\n<p>Act, 2002.    On 15.7.2009, when notice of motion was issued, it was<\/p>\n<p>observed as under:-\n<\/p>\n<blockquote><p>                   &#8220;By filing this writ petition, petitioner has laid challenge<br \/>\n             to notice issued by the respondent Bank under Section 13(4) of<br \/>\n             the Securitization and Reconstruction of Financial Assets and<br \/>\n             Enforcement of Security Interest Act, 2002. Counsel for the<br \/>\n             petitioner states that the petitioner is interested in saving its<br \/>\n             property.   To show its bonafide, the petitioner is ready to<br \/>\n             deposit an amount of Rs.4,00,000\/- with the respondent- Bank<br \/>\n             within a period of three weeks from today and remaining<br \/>\n             amount shall be paid within 6 to 9 months, as per the payment<br \/>\n             schedule fixed by the respondent- Bank.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> Civil Writ Petition No.10296 of 2009                                         2<\/span><\/p>\n<blockquote><p>                     Notice of motion for August 12, 2009. The respondent &#8211;<br \/>\n               Bank is restrained from taking any further coercive action<br \/>\n               against the petitioner till the next date of hearing. It is made<br \/>\n               clear that if the petitioner fails to deposit the money, as<br \/>\n               undertaken today in Court, this writ petition shall be<br \/>\n               dismissed.&#8221;<\/p><\/blockquote>\n<p>               Counsel for the petitioner states that the petitioner has failed to<\/p>\n<p>deposit the amount, as undertaken by the petitioner on 15.7.2009.
