The appellant had relied<br \/>\n\tupon his letter dated 25.03.2003 which was alleged to have been sent<br \/>\n\tunder Certificate of Posting, and again relied upon it to submit<br \/>\n\tthat the respondent could not have legally accepted the proposal<br \/>\n\tafter its withdrawal was communicated in writing.  Learned Single<br \/>\n\tJudge has clearly held that in absence of any evidence to the<br \/>\n\tcontrary, that communication dated 25.03.2003 appear to be an<br \/>\n\tafter-thought and a concocted document.  In view of the repeated<br \/>\n\tagitation on the same issue of fact, this Court (Coram :- Hon&#8217;ble<br \/>\n\tMr. Justice Bhagwati Prasad, as His Lordship then was, and Hon&#8217;ble<br \/>\n\tMr. Justice Bankim N. Mehta) appears to have verified the facts<br \/>\n\tpursuant to which following order dated 19.02.2010 was made herein<br \/>\n\t:-\n<\/p>\n<p>&#8220;An<br \/>\naffidavit was filed on behalf of the appellant that two employees,<br \/>\nnamely Shri J.D. Joshi, Branch Manager, and Shri C.S. Jadav, Record<br \/>\nClerk, have admitted before him that the document in question, i.e.<br \/>\nhis withdrawal from VRS, is on record of the office of the Oriental<br \/>\nInsurance Company, Palanpur Branch. Both the officers were called in<br \/>\nthe Court. They are present in the Court. They denied of having<br \/>\nadmitted<br \/>\nthe existence of application before the appellant. Consequence of the<br \/>\naffidavit and their  denial will be seen at the time of hearing of<br \/>\nthe appeal.\n<\/p>\n<p>Record<br \/>\nwas also brought to our notice by learned counsel of the Oriental<br \/>\nInsurance Company. The record, as produced, does not contain the<br \/>\ndocument in question.\n<\/p>\n<p>All<br \/>\nthese facts  will be considered at the time of hearing of the<br \/>\nappeal.&#8221;\n<\/p>\n<p>After<br \/>\n\thearing learned Senior Counsel Mr. K. B. Pujara at length, it was<br \/>\n\tclear that the respondent did not receive the so-called<br \/>\n\tcommunication dated 25.03.2003 and the appellant is by now already<br \/>\n\tretired and has already received the benefits under the Special<br \/>\n\tVoluntary Retirement Scheme.  We do not find any reason to take a<br \/>\n\tview different from the view taken by learned Single Judge.  In<br \/>\n\tfact, the above order has buttressed the finding that the respondent<br \/>\n\thad not received any communication dated 25.03.2003 as alleged and<br \/>\n\tin fact, such communication addressed to the Branch Manager, even if<br \/>\n\treceived, could not have been effective as held by learned Single<br \/>\n\tJudge.\n<\/p>\n<p>In<br \/>\n\tthe above facts and circumstances, we do not find any merit in the<br \/>\n\tappeal and hence, it is dismissed with no further order as to costs.\n<\/p>\n<p>Civil<br \/>\n\tApplication does not survive in view of the above order and stands<br \/>\n\tdisposed accordingly.\n<\/p>\n<p>\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t[D.
