No. 28720 of 2011\n                  Sonu Kumar @ Sonu Singh son of Late Sri Ram Singh\n                                        Versus\n                                  The State Of Bihar\n                                       -----------\n<\/pre>\n
3\/   17.10.2011                    Heard learned counsel for the petitioners and the State.<\/p>\n
                                   The petitioners seek bail in a case instituted for the<\/p>\n
                      offence under sections 363 and 365 of the Indian Penal Code.<\/p>\n
                                   The prosecution case is that one Manish and Ajit were<\/p>\n
                      kidnapped by unknown miscreants. Later, Manish was set free but<\/p>\n
                      whereabouts of Ajit was not found.\n<\/p>\n
                                   During investigation, it transpired that, in fact, Manish<\/p>\n
                      himself was involved in the kidnapping of Ajit. Some accused<\/p>\n
                      persons,    who      were    apprehended,     also   confessed.   Some<\/p>\n
                      witnesses also stated that they had seen the accused persons forcibly<\/p>\n
                      making Ajit sit in the BOLERO car whereafter he was not<\/p>\n
                      found alive. There is circumstantial evidence also since on the<\/p>\n
                      discovery statement of the co-accused Manish, cycle of Ajit was<\/p>\n
                      recovered from his uncle’s house.\n<\/p>\n
                                  Considering the nature of allegation, I am not inclined to<\/p>\n
                      grant bail to petitioners.\n<\/p>\n
                                  Prayer for bail is rejected.\n<\/p>\n
                                  The trial court is directed to expedite the trial in view of<\/p>\n
                      the serious nature of the offence.\n<\/p>\n<\/p>\n
