The State of Rajasthan \n\nDate of Order :::  24.05.2010\n\nHon'ble Mr. Justice Mohammad Rafiq\n\nShri\tSanjay Mehrishi, Counsel for petitioner\nShri\tAmit Punia, Public Prosecutor\n####\n\nBy the Court:-<\/pre>\n<p>Heard learned counsel for petitioner as well as learned Public Prosecutor and perused the material made available to me during the arguments of the case.\n<\/p>\n<p>Contention of learned counsel for petitioner is that accused-petitioner Prem Narain was in love with deceased Puja, aged about 18 years; her mother used to scold her for that reason and it would be evident from the statements of Smt. Krishna Kanwar, landlady, in whose house her mother Rajesh was tenant and another co-tenant in the same house Smt. Meena that it was at the instigation of her mother Rajesh that deceased Puja was driven to take such an extreme step of committing suicide. When investigation was proceeding in that direction, the mother of deceased in order to divert the focus from her, filed FIR ten days after the incident. Challan has already been filed in the matter; petitioner is in jail since 6th January, 2010; trial of the case is likely to take a long.\n<\/p>\n<p>Learned Public Prosecutor opposed the bail application.\n<\/p>\n<p>After considering all the facts and circumstances of the case and without expressing any opinion on its merits and demerits, I deem it just and proper to release the accused-petitioner, namely, Prem Narain Son of Shri Mahendrapal on bail under Section 439 Cr.P.C., in FIR No.9\/2010, Police Station Kunhadi, provided he furnishes a personal bond in the sum of Rs.30,000\/- with two sureties of Rs.15000\/- each to the satisfaction of the trial court for his appearance on all subsequent dates of hearing and as and when called upon to do so.\n<\/p>\n<p>The bail application stands disposed of.\n<\/p>\n<p>(Mohammad Rafiq) J.\n<\/p>\n<p>\/\/Jaiman\/\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court Prem Narain vs State Of Rajasthan on 24 May, 2010 IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR ORDER IN S.B.
