JUSTICE NARENDRA KUMAR JAIN\n\n\nMr. KR Bishnoi, Public Prosecutor.\n                                ...\n\n\n      This application seeking leave to appeal to challenge the\n\njudgment dated 8.1.2010 passed by learned Additional Sessions\n\nJudge (Women Atrocity) Cases, Bhilwara in Sessions Case\n\nNo.52\/2006 is barred by limitation from 56 days.\n\n\n\n      An application as per provisions of Section 5 of the\n\nLimitation Act is preferred seeking condonation of delay in filing\n\nleave petition. As per the averments contained in application,\n\ncertified copy of the judgment impugned was received by the\n\nPublic Prosecutor on 18.1.2010. On 8.2.2010 entire record of the\n\ncase alongwith opinion of Public Prosecutor was remitted to the\n\nCollector, Bhilwara. The Collector, Bhilwara after considering the\n\nrecord made a recommendation to appeal the judgment. After\n\nthen, that was forwarded to the Department of Law for seeking\n\nnecessary approval. After receiving the approval, the record of\n\nthe case was kept in custody of a clerk, who was suffering from\n\nCancer and ultimately, died thereof. Ultimately, a sanction letter\n\nwas issued on 3.5.2010 and that was received in the office of\n\nGovernment Advocate on 5.6.2010. The leave application then\n\nwas filed on 10.6.2010.\n                                  2\n\n\n\n      It is stated that whatever delay caused, that is cause of\n\nadministrative reasons and that requires condonation.\n\n\n\n      Before     considering the application we also examined the\n\nrecord of the case. On merits, it is submitted by learned Public\n\nProsecutor that the court below erred while not appreciating the\n\ndefinite statements given by PW-6 Smt. Sunita who in detailed\n\nnarrated all the circumstances in which deceased was poisoned.\n\nIt is also submitted that as per Forensic Science Laboratory\n\nReport trace of insecticides were found positive in visceras.\n\n\n\n      On examination of statement of PW-6 Smt. Sunita, we are\n\nof the opinion that the statements given suffers from serious\n\ndoubts and on basis of such evidence, conviction cannot be\n\nprocured. So far as report of Forensic Science Laboratory is\n\nconcerned, it may at the most sufficient to hold homicidal death\n\nof Smt. Kaushalya, however, it is not a conclusive evidence to\n\nprove the charge against the respondents. It is also relevant to\n\nnote that in the First Information Report (Ex.D\/3) lodged by\n\nfather of deceased, no apprehension regarding any ill-happening\n\nwas disclosed.\n\n\n\n      In such circumstance, we do not find any wrong with the\n\nconclusion arrived by the trial court that reasonable doubt exists\n\nin believing the prosecution story.\n                                      3\n\n           Looking to this position and also for the reason that the\n\n      delay has not been satisfied, we are not inclined to grant the\n\n      application under Section 5 of the Limitation Act. Accordingly,\n\n      the application is dismissed. In the result, the leave to appeal\n\n      too stands dismissed.\n\n\n\n      (NARENDRA KUMAR JAIN ), J.
