Justice V.K.MOHANAN\n\n Dated :28\/10\/2009\n\n O R D E R\n           C.N.RAMACHANDRAN NAIR &amp;\n                   V.K.MOHANAN, JJ.\n          ---------------------------------------------\n                I.T.A.Nos. 27 of 2003 &amp;\n                             513 of 2009\n          ---------------------------------------------\n        Dated this the 28th day of October, 2009\n\n                     J U D G M E N T\n<\/pre>\n<p>Ramachandran Nair,J:\n<\/p>\n<p>          The question raised in the connected cases<\/p>\n<p>pertaining to assessment of L.I.C.Development Officers is<\/p>\n<p>whether the Tribunal was justified in holding that 35% of<\/p>\n<p>the Incentive Bonus paid by the L.I.C. to the development<\/p>\n<p>officers is exempted from income tax based on the<\/p>\n<p>Incentive Bonus Scheme, 1997 and Reimbursement of<\/p>\n<p>Expenses Scheme, 1997 framed by the L.I.C. of India.<\/p>\n<p>The issue came up before this Court on an earlier<\/p>\n<p>occasion and in the decision reported in C.I.T v.<\/p>\n<p>T.K.Ginarajan, Development Officer, L.I.C. of India<\/p>\n<p>(253 ITR 463), this Court held that incentive bonus<\/p>\n<p>constitutes salary and the deduction admissible to<\/p>\n<p>salaried employees is only standard deduction provided<\/p>\n<p>under Section 16(1) of the Income Tax Act, 1961.<\/p>\n<p>I.T.A. Nos.27 of 2003 and 513 of 2009<\/p>\n<p>                                     :-2-:\n<\/p>\n<p>However, it was left open to the LIC to provide<\/p>\n<p>reimbursement of actual expenditure incurred in the<\/p>\n<p>carrying on the activities of the Development Officers.<\/p>\n<p>The L.I.C. has framed the above schemes wherein without<\/p>\n<p>providing for reimbursement of actual expenditure, they<\/p>\n<p>have provided that 35% of the incentive bonus paid is<\/p>\n<p>treated as actual expenditure. Even though originally the<\/p>\n<p>assessing officers allowed the claim, it was later re-<\/p>\n<p>opened by the Commissioner under Section 263.            The<\/p>\n<p>Tribunal,       however,        set   aside the orders of the<\/p>\n<p>Commissioner and held that the LIC Scheme should be<\/p>\n<p>followed for the purpose of the assessment of incentive<\/p>\n<p>bonus given to the Development Officers. We sought a<\/p>\n<p>clarification from the Central Board which has conveyed<\/p>\n<p>its opinion that the LIC Scheme on incentive bonus is not<\/p>\n<p>consistent with the provisions of the Income Tax Act and<\/p>\n<p>Rules. In other words, there is conflict between the two<\/p>\n<p>Departments of the very same ministry viz., the Finance<\/p>\n<p>I.T.A. Nos.27 of 2003 and 513 of 2009<\/p>\n<p>                                     :-3-:\n<\/p>\n<p>Ministry. In our view, this is not a matter which should be<\/p>\n<p>left to the court for decision or before departmental<\/p>\n<p>authorities and it should be sorted out by the Ministry<\/p>\n<p>itself. We are further of the view that it would not be fair<\/p>\n<p>to reopen the assessments completed granting tax<\/p>\n<p>benefits in terms of the scheme framed by the LIC.
