No.11666 of 2011\n                         VINOD KUMAR SINGH\n                                 Versus\n                         THE STATE OF BIHAR\n                                -----------\n<\/pre>\n<p>02.   27.04.2011             Petitioner is apprehending his arrest in a case<\/p>\n<p>                   registered under Sections 109, 120B of the I.P.C. Section<\/p>\n<p>                   13(I) (d) (II) read with Section 13(2) of the Prevention of<\/p>\n<p>                   Corruption Act and Section 135 and 138 of the Electricity<\/p>\n<p>                   Act.\n<\/p>\n<p>                              The accusation is of illegal consumption of<\/p>\n<p>                   electricity by tampering the meter by the owner and the<\/p>\n<p>                   tenant in the shop of Imam Shopping Centre. The<\/p>\n<p>                   accusation against this petitioner is that being Assistant<\/p>\n<p>                   Engineer in the Electricity Board he was in league with<\/p>\n<p>                   the    consumers   making    illegal   consumption   of   the<\/p>\n<p>                   electricity.\n<\/p>\n<p>                              It is submitted by learned counsel for the<\/p>\n<p>                   petitioner that petitioner reported about the illegal<\/p>\n<p>                   consumption and when the show cause was asked by the<\/p>\n<p>                   vigilance, petitioner submitted his show cause. Moreover<\/p>\n<p>                   for the theft of electricity, vigilance is not empowered to<\/p>\n<p>                   lodge the case which is a well settled law.<\/p>\n<p>                             Learned counsel for the vigilance submits that<\/p>\n<p>                   officials of the Electricity Board are equally responsible<\/p>\n<p>                   for illegal electricity consumption.<\/p>\n<p>                            Considering the fact that the thrust of accusation<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>          is against the consumers, let the petitioner namely Vinod<\/p>\n<p>          Kumar Singh, in the event of his arrest or surrender<\/p>\n<p>          before the Court below within a period of 12 weeks from<\/p>\n<p>          today, be released on anticipatory bail on furnishing bail<\/p>\n<p>          bond of Rs. 10,000\/-(ten thousand) with two sureties of<\/p>\n<p>          the like amount each to the satisfaction of Special Judge,<\/p>\n<p>          Vigilance, 1st, Patna in connection with Special Case No.<\/p>\n<p>          43 of 2006 arising out of Vigilance P.S.
