Justice ANTONY DOMINIC\n\n Dated :23\/07\/2010\n\n O R D E R\n                  ANTONY DOMINIC, J.\n                  ~~~~~~~~~~~~~~~\n           W.P.(C) Nos.7473 &amp; 20728 of 2010\n           ~~~~~~~~~~~~~~~~~~~~~~~\n           Dated this the 23rd day of July 2010\n\n\n                      J U D G M E N T\n<\/pre>\n<p>     Ext.P1 is the proceedings of the 2nd respondent<\/p>\n<p>appointing the petitioner as a Physiotherapist in the scale of<\/p>\n<p>Rs.1640-2960 in the Rajiv Gandhi Sports Medicine Centre,<\/p>\n<p>Directorate of Sports &amp; Youth Affairs, Vellayambalam,<\/p>\n<p>Thiruvananthapuram. The appointment was on temporary<\/p>\n<p>basis for a period of 179 days or till a permanent hand join<\/p>\n<p>duty whichever is earlier.     The petitioner continued in<\/p>\n<p>service on that basis.    Subsequently, Ext.P2 order was<\/p>\n<p>issued on 12.10.1998 ratifying the action of the 2nd<\/p>\n<p>respondent having allowed the petitioner to continue in<\/p>\n<p>service and according sanction for utilizing his services on<\/p>\n<p>daily wages or contract basis, till a suitable hand from the<\/p>\n<p>Public Service Commission or Employment Exchange joins<\/p>\n<p>W.P.(C) Nos.7473 &amp; 20728 of 2010<\/p>\n<p><span class=\"hidden_text\">                                -: 2 :-<\/span><\/p>\n<p>duty.    Again Ext.P3 and Ext.P4 orders were issued on<\/p>\n<p>8.1.2003 and on 14.7.2008, reappointing the petitioner<\/p>\n<p>provisionally subject to the earlier conditions. On this basis,<\/p>\n<p>petitioner is continuing in service without any break.<\/p>\n<p>     2.    According to the petitioner, steps were being<\/p>\n<p>taken to terminate him and make fresh appointment<\/p>\n<p>through Employment Exchange. It was on that basis the<\/p>\n<p>writ   petition    was    filed   seeking an  order   for  his<\/p>\n<p>regularization and continuance in service. While admitting<\/p>\n<p>this writ petition taking note of the long continuance of the<\/p>\n<p>petitioner in service, this Court directed that he be retained<\/p>\n<p>in service until further orders.\n<\/p>\n<p>     3.    The additional 3rd respondent who got himself<\/p>\n<p>impleaded in this writ petition submits that by Ext.R3(a),<\/p>\n<p>the Employment Exchange invited applications from<\/p>\n<p>Physiotherapists and being an eligible candidate, he also<\/p>\n<p>submitted his application to the said post.      Referring to<\/p>\n<p>Ext.R3(b), the information obtained under the provisions of<\/p>\n<p>W.P.(C) Nos.7473 &amp; 20728 of 2010<\/p>\n<p><span class=\"hidden_text\">                                -: 3 :-<\/span><\/p>\n<p>Right to Information Act, it is stated that he has been<\/p>\n<p>sponsored for appointment under the 1st respondent against<\/p>\n<p>a post reserved for Ezhava\/Thiyya\/Billava category. It is<\/p>\n<p>contended that since the petitioner&#8217;s appointment was time<\/p>\n<p>bound and subject to the condition of being replaced by<\/p>\n<p>PSC\/Employment Exchange hands, and as the additional 3rd<\/p>\n<p>respondent has been sponsored, the petitioner is bound to<\/p>\n<p>vacate the post. The learned Government Pleader filed a<\/p>\n<p>counter affidavit on behalf of the 2nd respondent submits<\/p>\n<p>that though the petitioner was initially engaged from 1998,<\/p>\n<p>his continuance in the post was on account of the fact that<\/p>\n<p>despite notifying the post no suitable candidate could be<\/p>\n<p>selected.    It is stated that since the appointment was<\/p>\n<p>conditional and time bound, either on the satisfaction of the<\/p>\n<p>condition specified or on expiry of the period, the petitioner<\/p>\n<p>is bound to vacate the post.\n<\/p>\n<p>     4.    Even as on date, qualifications for the post has not<\/p>\n<p>been prescribed and therefore, posts that are created under<\/p>\n<p>W.P.(C) Nos.7473 &amp; 20728 of 2010<\/p>\n<p><span class=\"hidden_text\">                                -: 4 :-<\/span><\/p>\n<p>the 1st respondent have not been notified to the PSC for<\/p>\n<p>initiating recruitment process.        Therefore, until then the<\/p>\n<p>post will have to be occupied by persons sponsored by the<\/p>\n<p>Employment Exchange.              So far as the petitioner is<\/p>\n<p>concerned, though his continuance was subject to the<\/p>\n<p>conditions incorporated in the appointment orders, fact<\/p>\n<p>remains that he is continuing in service since 1998. He<\/p>\n<p>satisfies the qualification notified by the Employment<\/p>\n<p>Exchange and he was selected in an interview that was<\/p>\n<p>conducted      by   the    Employment      Exchange    and   his<\/p>\n<p>appointment is to a sanctioned post. Therefore, at best his<\/p>\n<p>appointment is an irregular one and is not illegal one.<\/p>\n<p>     5.    Petitioner having continued in service for more<\/p>\n<p>than 10 years and that too without any intervention of the<\/p>\n<p>court, prima facie, in my view, this is a case entitled to the<\/p>\n<p>exemption indicated by the Apex Court in Paragraph 44 of<\/p>\n<p>the judgment reported in <a href=\"\/doc\/1591733\/\">Secretary, State of Karnataka<\/p>\n<p>&amp; Ors. v. Umadevi &amp; Ors.<\/a> [A.I.R 2006 SC 1806] which<\/p>\n<p>W.P.(C) Nos.7473 &amp; 20728 of 2010<\/p>\n<p><span class=\"hidden_text\">                                -: 5 :-<\/span><\/p>\n<p>reads as thus :-\n<\/p>\n<blockquote><p>     &#8220;One aspect needs to be clarified. There may be<\/p>\n<p>     cases where irregular appointments (not illegal<\/p>\n<p>     appointments) as explained in S.V.Narayanappa<\/p>\n<p>     (Supra),      R.N.Nanjundappa          (Supra),  and<\/p>\n<p>     B.N.Nagrajan      (Supra),       and  referred to in<\/p>\n<p>     paragraph 15 above, of duly qualified persons in<\/p>\n<p>     duly sanctioned vacant posts might have been<\/p>\n<p>     made and the employees have continued to work<\/p>\n<p>     for ten years or more but without the intervention<\/p>\n<p>     of orders of courts or of tribunals. The question<\/p>\n<p>     of   regularization      of   the   services of such<\/p>\n<p>     employees may have to be considered on merits<\/p>\n<p>     in the light of the principles settled by this Court<\/p>\n<p>     in the cases above referred to and in the light of<\/p>\n<p>     this judgment.       In that context, the Union of<\/p>\n<p>     India,    the    State     Governments      and their<\/p>\n<p>     instrumentalities should take steps to regularize<\/p>\n<p>     as a one time measure, the services of such<\/p>\n<p>     irregularly appointed, who have worked for ten<\/p>\n<p>     years or more in duly sanctioned posts but not<\/p>\n<p>     under cover of orders of courts or of tribunals and<\/p>\n<p>     should further ensure that regular recruitments<\/p>\n<p>     are undertaken to fill those vacant sanctioned<\/p>\n<p>W.P.(C) Nos.7473 &amp; 20728 of 2010<\/p>\n<p><span class=\"hidden_text\">                                -: 6 :-<\/span><\/p>\n<p>     posts that require to be filled up, in cases where<\/p>\n<p>     temporary employees or daily wagers are being<\/p>\n<p>     now employed.          The process must be set in<\/p>\n<p>     motion within six months from this date. We also<\/p>\n<p>     clarify that regularization, if any already made,<\/p>\n<p>     but not sub judice, need not be reopened based<\/p>\n<p>     on this judgment, but there should be no further<\/p>\n<p>     by-passing of the constitutional requirement and<\/p>\n<p>     regularizing or making permanent, those not duly<\/p>\n<p>     appointed as per the constitutional scheme.&#8221;<\/p>\n<\/blockquote>\n<p>Therefore, I direct the 1st respondent to consider the case of<\/p>\n<p>the petitioner for regularization of him in the manner as<\/p>\n<p>indicated in paragraph 44 of the judgment referred to<\/p>\n<p>above. This shall be done as expeditiously as possible, at<\/p>\n<p>any rate, within 3 months from the date of production of a<\/p>\n<p>copy of this judgment and in the meanwhile status quo as on<\/p>\n<p>date in so far as his continuance of service shall be<\/p>\n<p>maintained.\n<\/p>\n<p>     6.    In so far as, additional 3rd respondent is<\/p>\n<p>concerned, he has also filed Writ Petition No.20728 of 2010<\/p>\n<p>W.P.(C) Nos.7473 &amp; 20728 of 2010<\/p>\n<p><span class=\"hidden_text\">                                -: 7 :-<\/span><\/p>\n<p>praying that he shall be appointed to the post of<\/p>\n<p>Physiotherapist under the 1st respondent mentioned above.<\/p>\n<p>Now with the aforesaid direction in favour of the petitioner<\/p>\n<p>in W.P.(C) No.7473\/2010 has been issued, as far as the<\/p>\n<p>petitioner in W.P.(C) No.20728\/2010 is concerned, it is<\/p>\n<p>directed that his case for appointment will be considered by<\/p>\n<p>the 2nd respondent if there is a vacant post existing and<\/p>\n<p>without disturbing the petitioner in W.P.(C) No.7473 of<\/p>\n<p>2010.\n<\/p>\n<p>           Writ petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                 ANTONY DOMINIC, JUDGE.\n<\/p>\n<p>\nJvt<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Arun P.V.
