As a result of<br \/>\nhearing and perusal of records, this court is of the opinion that<br \/>\ninstead of entertaining\/interfering the matter at admission stage,<br \/>\ninterest of justice will be served if the appellate court is directed<br \/>\nto expedite the hearing of the appeal.\n<\/p>\n<p>3.\tIn<br \/>\nthe premises aforesaid, the following order is passed:\n<\/p>\n<p>The<br \/>\n\tpetitioners shall prefer an application before the appellate court<br \/>\n\tfor expediting the appeal along with a copy of this court&#8217;s order.\n<\/p>\n<p>On<br \/>\n\tsuch application being made, the appellate court shall hear and<br \/>\n\tdecide the appeal at the earliest preferably on a day to day basis.\n<\/p>\n<p>This<br \/>\n\tcourt has not entered into the merits of the matter and therefore<br \/>\n\tthe courts below shall not be influenced by the order of this court.\n<\/p>\n<p>It<br \/>\n\tis made clear that the trial court while hearing the suit shall not<br \/>\n\tbe influenced by the order of the appellate court at interlocutory<br \/>\n\tstage.\n<\/p>\n<p>4.\tWith<br \/>\nthe above directions, petition stands disposed of.\n<\/p>\n<p>(K.S.\n<\/p>\n<p>JHAVERI, J.)<\/p>\n<p>Divya\/\/<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Gayatri vs State on 4 February, 2011 Author: Ks Jhaveri,&amp;Nbsp;
