Mr.<br \/>\nThakkar, learned advocate  further submitted that during the period<br \/>\nfrom April, 1996 to March, 1997, the respondent again remained<br \/>\nabsent.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner has not given any detail about the date on which the<br \/>\nrespondent remained absent during the aforesaid period nor any<br \/>\nmaterial to establish his alleged absence appears to have been<br \/>\nproduced before the learned Labour Court. Except said letter dated<br \/>\n10.5.1997, no other material or evidence appears to have been<br \/>\nproduced before the learned Labour Court to establish the  alleged<br \/>\nabsenteeism of the respondent during the aforesaid period. Mr.<br \/>\nThakkar, learned advocate tried to rely upon the cross-examination of<br \/>\nthe respondent to demonstrate that the respondent had admitted his<br \/>\nabsence, however, said cross-examination does not refer to any date<br \/>\nor period of absence and that therefore, it is not possible to<br \/>\nco-relate the so called admission with the details mentioned in the<br \/>\nletter dated 10.5.1997.\n<\/p>\n<p>3.\tIt<br \/>\nis not in dispute that no inquiry was conducted about the alleged<br \/>\nabsence of the respondent and that the retrenchment compensation was<br \/>\nnot paid. Thus, it appears that even if the allegation of absenteeism<br \/>\nis presumed to be true, then also respondent&#8217;s termination was<br \/>\nwithout complying with the procedure of law.\n<\/p>\n<p>4.\tConsidering<br \/>\nthis aspect, the learned Labour Court has held the termination<br \/>\nillegal and passed direction for reinstatement with continuity of<br \/>\nservice. Mr. Thakkar, learned advocate submitted that the petitioner<br \/>\nis not challenging the direction regarding reinstatement and the<br \/>\npetitioner is ready and willing to reinstate the petitioner.
