Mr. Kartik Pandya,<br \/>\nLd. APP waives service of rule on behalf of the opponents.\n<\/p>\n<p>2.\t\tThe applicant &#8211;\n<\/p>\n<p>convict, who vide judgment and order dated 06\/12\/2008 rendered by the<br \/>\nLd. Addl. Sessions Judge, Fast Track Court No. 4,   Ahemdabad, in<br \/>\nSessions Case No. 164\/2006 has been convicted for the offences<br \/>\npunishable under sections 395, etc., of the Indian Penal Code and<br \/>\nsentenced to undergo rigorous imprisonment for 10 years, has filed<br \/>\nthis application through  his wife, seeking temporary bail of 30 days<br \/>\non the ground of performing after death ceremony of aunt of the<br \/>\nconvict prisoner.\n<\/p>\n<p>3.\t\tThe jail remark sheet<br \/>\nsupplied by the Ld. APP at the time of hearing of the  application,<br \/>\nreveals that the applicant convict has undergone about 4 years and 8<br \/>\nmonths&#8217; imprisonment in the jail and during this period the applicant<br \/>\nconvict was released twice on temporary bail, on one occasion for 17<br \/>\ndays in the month of  June\/July 2010 and on second occasion for 21<br \/>\ndays in the month of  December 2010\/ January 2011, he surrendered in<br \/>\ntime and that he has not enjoyed any furlough or parole leave.\n<\/p>\n<p>4.\t\tPerusing the application<br \/>\nand death certificate annexed with the  application, it transpires<br \/>\nthat Humaliben expired on 18\/6\/2011.  It further transpires  that<br \/>\npersonal presence of the convict is required to perform after death<br \/>\nceremony of his aunt.   Considering the facts and circumstances of<br \/>\nthe case, so also the jail remark sheet, we deem it expedient to<br \/>\npartly allow this application.\n<\/p>\n<p>5.\t\tThe application succeeds<br \/>\nin part and accordingly it is partly allowed. The convict is ordered<br \/>\nto be released on temporary bail for the period of 10 days from the<br \/>\ndate of his actual release upon his furnishing personal bond in the<br \/>\nsum of Rs.5,000\/- before the jail authority. The convict shall not<br \/>\ntake disadvantage of his liberty and shall maintain law and order.\n<\/p>\n<p>\t\tRule is made absolute<br \/>\naccordingly.\n<\/p>\n<p>[ D.H.
