DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 17\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.I 98\/2010 with Lodhika Police Station, Rajkot,  for the<br \/>\n\toffences punishable under Sections 302, 147, 148, 149, 504, 506(2)<br \/>\n\tand 34 of IPC.\n<\/p>\n<p>It<br \/>\n\tis submitted that the allegations against the applicant are of<br \/>\n\twitnessing incident in question and the same is noticed by Learned<br \/>\n\tadditional Sessions Judge in the order dated 21st<br \/>\n\tJanuary, 2011 and considering the above fact, I am inclined to<br \/>\n\tenlarge the applicant on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP for the respondent &#8211; State.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith first information report registered at CR No.I 98\/2010 with<br \/>\n\tLodhika Police Station, Rajkot, on executing a bond of Rs.5,000\/-<br \/>\n\t(Rupees Five Thousand only) with one surety of the like amount to<br \/>\n\tthe satisfaction of the trial Court and subject to the conditions<br \/>\n\tthat he shall;\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender<br \/>\npassport, if any, to the lower court within a week;\n<\/p>\n<p>(d)\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>(e)\tmark<br \/>\npresence at the concerned police station on the first Sunday of every<br \/>\nmonth between 10.00 a.m. and 3.00 p.m. till the trial commences;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change the<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>The<br \/>\n\tAuthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
