Mr. H.L.\n<\/p>\n<p>Jani, learned Additional Public Prosecutor, waives service of rule on<br \/>\nbehalf of the respondent. At the request of the learned counsel<br \/>\nappearing for the parties, this application is taken up for hearing<br \/>\ntoday.\n<\/p>\n<p>2.\tThis application is<br \/>\nfiled under section 439 of the Code of Criminal Procedure in<br \/>\nconnection with First Information Report registered as I-C.R. No.-26<br \/>\nof 2008 dated  26.6.2008  filed before the Nalia Police Station, for<br \/>\nthe offences punishable under Sections 420 and 511 of the Indian<br \/>\nPenal Code.\n<\/p>\n<p>3.\tLearned advocate<br \/>\nfor the applicant submitted that on perusal of the First Information<br \/>\nReport at Annexure-A to the petition, the applicant has been falsely<br \/>\nimplicated  for the offence. False case is foisted on the applicant.<br \/>\nThe applicant has not acted in any overt manner so as to be roped in<br \/>\nfor the offences punishable under Sections 420 and 511 of Indian<br \/>\nPenal Code.  In view of above, learned advocate for the applicant<br \/>\nsubmitted that it is fit case for enlarging the applicant on regular<br \/>\nbail.\n<\/p>\n<p>4.\tLearned Additional<br \/>\nPublic Prosecutor representing the State submitted that on perusal of<br \/>\nthe First Information Report at Annexure-A to the application, the<br \/>\napplicant has been charged for the offences punishable under Sections<br \/>\n420 and 511 of the Indian Penal Code. Considering the role attributed<br \/>\nto the applicant and the manner in which he made an attempt to dupe<br \/>\nthe complainant, it is a fit case where the application for bail<br \/>\ndeserves to be rejected.\n<\/p>\n<p>5.\tConsidering the<br \/>\nrival contentions and on perusal of the First Information Report at<br \/>\nAnnexure-A to the petition, the applicant is booked for the offences<br \/>\npunishable under Sections 420 and 511 of the Indian Penal Code. I<br \/>\nhave considered the role attributed to the applicant and the manner<br \/>\nin which alleged offence is prima facie committed by the applicant.<br \/>\nHowever, without entering into the merits of the case, I am inclined<br \/>\nto exercise my discretion in favour of the applicant.\n<\/p>\n<p>6.\tIn the facts and<br \/>\ncircumstances of the case, the application is allowed and the<br \/>\napplicant is ordered to be enlarged on bail in connection with I-C.R.<br \/>\nNo.26 of 2008 registered at Nalia Police Station on executing a bond<br \/>\nof Rs.10,000\/- [Rupees ten thousand only] with one surety of the like<br \/>\namount to the satisfaction of the trial court and subject to the<br \/>\nconditions that he shall:\n<\/p>\n<p>[a]\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b].\tnot act in a<br \/>\nmanner injurious to the interest of the prosecution;\n<\/p>\n<p>[c].\tsurrender his<br \/>\npassport, if any, to the lower court within a week;\n<\/p>\n<p>[d].\tnot leave the<br \/>\nState of Gujarat without the prior permission of the Sessions court<br \/>\nconcerned;\n<\/p>\n<p>[e].\tmark his presence<br \/>\nat Nalia police station on 1st and 15th day of<br \/>\nEnglish calendar month between 9.00 AM and 2.00 PM. till the trial is<br \/>\nover;\n<\/p>\n<p>[f].\tfurnish the<br \/>\npresent address of his residence to the I.O. and also to the Court at<br \/>\nthe time of execution of the bond and shall not change his residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>[g].\tmaintain law and<br \/>\norder.\n<\/p>\n<p>7.\tIf breach of any of<br \/>\nthe above conditions is committed, the Sessions Judge concerned will<br \/>\nbe free to issue warrant or to take appropriate action in the matter.\n<\/p>\n<p>8.\tBail bond to be<br \/>\nexecuted before the lower Court having jurisdiction to try the case.\n<\/p>\n<p>9.\tAt the trial, the<br \/>\ntrial Court shall not be influenced by the observations of<br \/>\npreliminary nature, qua the evidence at this stage, made by this<br \/>\nCourt while enlarging the applicant on bail.\n<\/p>\n<p>10.\tRule is made<br \/>\nabsolute.\tDirect Service is permitted.\n<\/p>\n<p>                         [H.B.ANTANI, J.]<\/p>\n<p>sudhir<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Paresh vs State on 5 August, 2008 Author: H.B.Antani,&amp;Nbsp;
