Munsiff, Gadag, decreeing the suit \ufb01led for\n  V possession and mesne pro\ufb01ts.\n\n\n\nRSA No. I 538\/2008\n\nThis appeal coming on for admission, this day, the Court\ndelivered the following: \n\nJUDGMENT\n<\/pre>\n
1. This second appeal is directed against  and _ <\/p>\n
decree dated 03.04.2008 in R.A.No,74\/i_l994’\u00abppdismissing”i’the:\u00ab<\/p>\n
appeal filed by the appellant, _hereinA and cor;2′.iri11ing*y’thew’;<\/p>\n
judgment and decree passed”s<e.:l't:y the._i_tria11 "court in<\/p>\n
O.S.No.34\/1992.\n<\/p>\n
2. The suit O.S.No.3{l’;”1v992 ‘ wee ‘i’i1e\u00a7i”9,by the p1aintiff~
\nrespondent herein encroached portion of
\nthe suit prope1*tyi:— i\u00a7~\u00a7iainitiff\u00ab.eonteindedifthat he was the owner of
\nthe operihwell  site situated around it which<\/p>\n
formed partiiiof   Gadag town. According to the<\/p>\n
_._plaintiff, it was Ii the__ancestral property and his name was<\/p>\n
?__f=;ntered in the Survey Records. It was further alleged that<\/p>\n
   the lessee of an open site bearing CTS<\/p>\n
V –VNo.3\u00a7’f\/”ivvhich belonged to the Government and the<\/p>\n
it i * i”vde1’cndant”wanted to put up construction of a temporary cattle<\/p>\n
 which the Government granted permission on ground<\/p>\n
T  basis with a condition that she should only construct a<\/p>\n

temporary shed. However, the defendant constructed a<\/p>\n
permanent building contrary to the lease conditionvi~vvithout<\/p>\n
leaving any set backs and byxencroaching a portionroif   .<\/p>\n
property on the northern side. It isiprrthis .bac’l:\u00e9round;AVti1e_e <\/p>\n
possession of the encroached portion ‘was:_’sozughet,  <\/p>\n
3. The defendant denied theifavexrmeritsp niadr;irr._:the..plaint v T’<\/p>\n
and contended that the area is ivlgpasfii and she
\nhas put up construction. was  that plaintiff
\nwas not at all thel’oivner.-‘ofihthe ‘_ suit schedule
\nproperty and   family in<\/p>\n
whose name the i’po:rtion hwhe’19ein_ian open well shown to be in
\nexistenceivvcarne to lb:-}:fr.eco,rdeed”‘ini the City Survey Records.<\/p>\n
4. The trial , court-__franie\u00abd’if’necessary issues including as to<\/p>\n
-vlwhetlfieir  plainit”1ffv.p_ro’vved that he is the owner of the suit<\/p>\n
i”–sChiedu,le of the property and whether the defendant<\/p>\n
encr.oa’ehed it–h’e:said portion illegally and has taken unlawful<\/p>\n
‘possessioritrofi the Same. Both these issues were answered in<\/p>\n
‘then affirrnative and in favour of the plaintiff. The lower<\/p>\n
 court has re–appreciated the evidence both oral and<\/p>\n
RSA “No.1538\/2008<\/p>\n
documentary and has recorded a \ufb01nding that CTS No.308
\nbelonged to the family of Kadappanavar and that in the City<\/p>\n
Survey Records the name of Kadappanavar was recorded_.tev.en<\/p>\n
in respect of the portion where the well was situatedHsiholvvin:g*it’ .<\/p>\n
as Kadappanavara Bhavi (well). It wasualso noted banfcestial <\/p>\n
property. The contention urged by the defendant  <\/p>\n
undisputed point of time Charia-basapiipail’Kada.pi15E;n:avar_:\u00a7had <\/p>\n
himself given an application to  City ilvltlniicipalg Council
\nadmitting that there was spa<;eVi'ir;..__ex;istyence adjoining his
\nproperty and that he inten.de_d.V\/to._dig 'i'fhvei"viieVll'V" therein for the<\/p>\n
public use and  zscheduleii'portioriwis the said portion<\/p>\n
which   _to– lithe Government. One
\nChenabasappa yKad\u00a7p;\u00a7a\ufb01a:z\u00a7r\u00ab.had dug up the well and it is in<\/p>\n
this background was described as Kadappanavara<\/p>\n
,{'!'lghaVr;{{;ve;,'1) in the  Records and hence the plaintiff<\/p>\n
had _n\u00a2't–  'orAVc.pio,ssession over the same. The courts below<\/p>\n
have ._negative'd_. this defence taken by the defendant and have<\/p>\n
  recorded concurrent \ufb01ndings holding that the suit property was<\/p>\n
   308 which belonged to Kadappanavara family and<\/p>\n
if –..ii:the'y%C'I'S records disclosed that the property was entered in the<\/p>\n

name of the ancestors of the plaintiff. On these \ufb01ndings both<\/p>\n
the courts have held that the defendant had a'oso_lt1telyi_i'~no<\/p>\n
right, title or interest over the said portion of the   '7' <\/p>\n
5. Learned counsel for the appe11.ant..contendis if<\/p>\n
light of Ex.D.8 and Ex.D.7, the reprzeseritatiionis. <\/p>\n
Chanabasappa Kadappanavar  in  “i931 * if<\/p>\n
stating that the open space in questiorir.._belonged_to_the State
\nGovernment and that he i’r;t:en.ded to}  there, both the
\ncourts erred in laW*in_ hoad’i’n’g\u00abth-at”the_pr\u00a2per’tjflbelonged to the<\/p>\n
plaintiff. This. ‘will _not_\u00bb  lanjfirnanner further the<\/p>\n
defence takcn.,._b*y  their Written statement<\/p>\n
wherein they’ haiirel:t’specifi’cal’iy’asserted their right over the<\/p>\n
property.  fact :_that even as per Ex.D.8 and 9, the<\/p>\n
,v,defenda.nt”has  or interest over the suit schedule<\/p>\n
proper_ty…:_ ‘Tliat’*–apart, both the courts have held that much<\/p>\n
watelraphas’lillflowriilviafter 1931 and the documents that are<\/p>\n
~maintained’.thereafter disclosed that CTS 308 is the property<\/p>\n
uibelonged to the plaintiff and the defendant had no right<\/p>\n
._ jover the same.\n<\/p>\n

6. As can be seen from the \ufb01nding recorded by the trial<\/p>\n
court, the defendant has admitted the right and title.<\/p>\n
plaintiff over CTS 308. She has also admitted  t.<\/p>\n
that the government property lies beyondthe Well’.’–:She”Vcannot <\/p>\n
now contend that well was dug up in’\u00bb.the:;’pro’pe’1rty’Ab:e’1on\u00a7ing’*to<\/p>\n
the Government.\n<\/p>\n
7 . In the wake of these concurrent \ufb01ndings._ii:arrive\u00a7:l at both
\nthe courts a-)1:-felv after  the iexiidence on
\nrecord, both oral and docAL.J.rI1:t.i_1″i.tai”i–,\\.i\/’ix,  embark<\/p>\n
upon re–apprec\u00a7fiatiojnbVof ‘”‘saIne._itoi”arrive at a different<\/p>\n
conclusion f”in.AiAi’e::erc’i\u00a2se. of the ipowe1″s 11\/ s 100 of the CPC.
\nHence, Ii\ufb01tdo not ifindpiianyfsiibstantial question of law for<\/p>\n
