     ORAL JUDGMENT [Per A.H. Joshi, J.]:\n<\/p>\n
     1.        This is a State appeal against acquittal.\n<\/p>\n
     2.        The accused were tried for offence of gang rape<\/p>\n
     punishable under Section 376 (g), Indian Penal Code.\n<\/p>\n
     3.        Heard learned APP Mr. M.J. Khan for the appellant-\n<\/p>\n
     State   and    learned    Adv.     Mr.       P.B.   Patil         for    respondents-\n<\/p>\n
     accused persons and perused the record.\n<\/p>\n
     4.        Prosecution has relied upon different witnesses,<\/p>\n
     i.e.,   parents     of   prosecutrix          Manisha,         and      the    victim      –\n<\/p>\n
     Manisha, apart from the shopkeeper who had sold condoms to<\/p>\n
     the accused persons, the Medical Officer etc.<\/p>\n
     5.        PW    1   –    Manisha    narrates            entire       incident        which<\/p>\n
     tends to prove the alleged gang rape.\n<\/p>\n

                   In the cross-examination, effort has been made to<\/p>\n
     create a doubt in PW 1 – Manisha’s testimony on account of<\/p>\n
     delay    in    lodging      the    report      and    a    possibility         of    her<\/p>\n
     statement being totally false.                  PW 1 has deposed that she<\/p>\n
     was gagged and was unable to shout, and narrated the story<\/p>\n
     of    use     of   condoms    by    the       accused      in   the     process        of<\/p>\n
     committing rape.\n<\/p>\n
     6.<\/p>\n
                   Prosecution     has    proved      sale      of   condoms        to    the<\/p>\n
     accused by examining the shopkeeper.\n<\/p>\n
     7.            The story of rape was sought to be corroborated by<\/p>\n
     the   prosecution      by    the    testimony        of    PW   6   –    Dr.    Sanjay<\/p>\n
     Kolte,      Medical    Officer.      Examination-in-Chief               of     Medical<\/p>\n
     Officer contained in para 1 reads as follows:-\n<\/p>\n
                   “1.      On 6-1-99 I was working as medical
\n                   officer at Civil Hospital, Buldana. That day
\n                   at   about   4   a.m.,   I   examined  Manisha<\/p>\n
                   Shrikrishna Ubale, aged 22 years, brought by
\n                   LPC, Buldana, on the allegations of rape, and
\n                            I had    issued   certificate  of  my
\n                   observation. Same is now shown to me.\n<\/p><\/blockquote>\n
                            It bears my signature. Its contents
\n                   are correct.\n<\/p><\/blockquote>\n
                            It is marked at Exh.45. No evidence<\/p>\n
                   of injuries were seen anywhere on her body.\n<\/p><\/blockquote>\n
                            It was not possible to comment as to
\n                   if alternate rape has been occurred or not.\n<\/p><\/blockquote>\n
                            Old hymen tear was seen. She was
\n                   habituated for intercourse.”\n<\/p><\/blockquote>\n

                   Though   Medical      Officer     had       testified      that     there<\/p>\n

     was no evidence of rape due to absence of anything in that<\/p>\n
     regard on the private part of the prosecutrix and absence<\/p>\n
     of other injuries on the body of prosecutrix, in the cross-\n<\/p>\n
     examination, Medical Officer in specific terms stated as<\/p>\n
     follows:-\n<\/p>\n
             “2.      ……………………………….
\n             ……….I had taken vaginal swab. C.A.
\n             report is now shown to me, and the report is<\/p>\n
             nil.\n<\/p><\/blockquote>\n
                      Appearance of semen on vaginal swab<\/p>\n
             is a positive evidence of intercourse.\n<\/p><\/blockquote>\n
                      As C.A. report is negative regarding
\n             presence of semen in the vaginal swab, it can
\n             be said that there was no intercourse in<\/p>\n
             immediate past without any contraceptive.\n<\/p><\/blockquote>\n
                      Otherwise also this is a doubtful
\n             case of rape.\n<\/p><\/blockquote>\n
                      I have seen the packet of Deluxe
\n             contraceptive. Its each packet contains only
\n             one contraceptive.\n<\/p><\/blockquote>\n
                      Any contraceptive may get torn while
\n             using it.\n<\/p><\/blockquote>\n
                      When the victim was referred for<\/p>\n
             medical examination, I was not informed that
\n             condoms were used in the incident.\n<\/p><\/blockquote>\n
                      In case the contraceptive has torn,
\n             C.A. Report will also be positive. …..”\n<\/p><\/blockquote>\n

     8.      Prosecution has not brought on record evidence to<\/p>\n
     prove that two used condoms found at the place of offence<\/p>\n
     were sent for chemical analysis. The remains of body fluids<\/p>\n
     on both sides of condoms could have been the best piece of<\/p>\n
     evidence to prove its use by the accused for intercourse<\/p>\n
     with the prosecutrix.\n<\/p>\n

     9.          It is obvious that due to use of condoms vaginal<\/p>\n
     swab could have been negative, however, as two condoms were<\/p>\n
     seen in torn condition, the vaginal swab could have shown<\/p>\n
     positive result.\n<\/p>\n
     10.         It is     not      made      clear    by   the    prosecution          as    to<\/p>\n
     what prevented it from getting done the chemical analysis<\/p>\n
     of the remains of body f1uids on the condoms.\n<\/p>\n
     11.         The   testing           of    condoms      in     a    laboratory           was<\/p>\n
     extremely necessary in the background that medical evidence<\/p>\n
     rendered a picture which was totally inconsistent with the<\/p>\n
     story couched by the prosecutrix.\n<\/p>\n
     12.         In the result, while on one hand, the statement of<\/p>\n
     prosecutrix       could        be     believed      in      absence       of     medical<\/p>\n
     evidence    as    well,     it      would   not     be    easy     to    believe        the<\/p>\n
     prosecutrix contrary to medical evidence.\n<\/p>\n
                 The case would stand on a different footing when<\/p>\n
     rape   is    sought       to     be      proved    solely         by    testimony        of<\/p>\n
     prosecutrix “in absence of medical evidence” as against the<\/p>\n
     case of testimony of prosecutrix contradicted by medical<\/p>\n
     evidence.\n<\/p>\n

     13.         It would, therefore, be impossible to believe the<\/p>\n
     prosecutrix, whose testimony, seen in isolation, seems to<\/p>\n
     be consistent, however, circumstances, namely while she was<\/p>\n
     laid down on ground over a pant, raped by accused persons<\/p>\n
     one after the other, no resistance, whatsoever, is offered<\/p>\n
     and no marks of resistance or other injuries are evident<\/p>\n
     from her body or private parts, bring her version under a<\/p>\n
     grave shadow of doubt.\n<\/p>\n
     14.         On    the   other   hand,   medical      opinion        is     that<\/p>\n
     prosecutrix is used to sexual intercourse.                   The story of<\/p>\n
     gang rape, therefore, comes under doubt. It would, thus, be<\/p>\n
     gravely risky to convict somebody on a doubt.\n<\/p>\n
     15.         In    the   given   situation,      no     interference            is<\/p>\n
     warranted in appeal against acquittal.\n<\/p>\n
                 Appeal is dismissed.\n<\/p>\n
