Justice ANTONY DOMINIC\n\n Dated :21\/11\/2007\n\n O R D E R\n                  ANTONY DOMINIC, J\n                        -------------------\n                   W.P.(C). 34072\/2007\n                       --------------------\n        Dated this the 21st day of November, 2007\n\n                        JUDGMENT\n<\/pre>\n<p>      Housing loan was availed of by the petitioner and<\/p>\n<p>default    was committed and that resulted in the<\/p>\n<p>proceedings under the Secrutisation and Reconstruction<\/p>\n<p>of Financial Assets and Enforcement of Security Interest<\/p>\n<p>Act at the instance of the first respondent for realising the<\/p>\n<p>dues.\n<\/p>\n<\/p>\n<p>2.    This case was adjourned for the counsel for the first<\/p>\n<p>respondent to get instructions. Today, when the matter<\/p>\n<p>was    taken up for consideration, learned counsel, on<\/p>\n<p>instruction, submitted that after availing of loan from the<\/p>\n<p>Bank, default was committed and therefore, loan was<\/p>\n<p>recalled and that thereafter impugned proceedings were<\/p>\n<p>initiated. Counsel also submits that if the petitioner so<\/p>\n<p>desires he can still be given a chance to regularize the<\/p>\n<p>account and revive the transaction.<\/p>\n<p>3.    Taking into account the submissions made by both<\/p>\n<p>sides, though I do not find anything irregular in the action<\/p>\n<p>W.P.(C).34072\/2007<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>taken by the Bank warranting to be interfered, I feel that<\/p>\n<p>the offer made by the Bank to regularise the account, is<\/p>\n<p>the best that the petitioner can get.<\/p>\n<p>4.    Accordingly, I direct that if the petitioner clears<\/p>\n<p>the entire arrears as of now, that may be remitted to<\/p>\n<p>the Bank within one month from today, in which event<\/p>\n<p>Bank will regularise the account. Thereafter the dues of<\/p>\n<p>the petitioner may be rescheduled by the Bank and the<\/p>\n<p>petitioner may be permitted to pay the balance amount<\/p>\n<p>instalments as rescheduled by the Bank.<\/p>\n<p>5.
