It was submitted at the stage of admission hearing by learned<br \/>\ncounsel appearing for both the sides that, in the peculiar facts and<br \/>\ncircumstances of the case, the original reference case pending before<br \/>\nthe Industrial Tribunal was required to be expeditiously heard and<br \/>\ndisposed on merits, even as the contesting parties were agreeable to<br \/>\nco-operate in the earliest practicable resolution of the disputes by<br \/>\nthe Tribunal.  It was, however, submitted by learned counsel,<br \/>\nMr.Dave, that the observations made in the impugned judgment dated<br \/>\n09.10.2009 in the petition filed by the appellant Company would come<br \/>\nin the way of  full and appropriate adjudication of the dispute<br \/>\nbetween the parties. He, therefore, requested that the original<br \/>\npetition being Special<br \/>\nCivil Application  No.8975 of 2009 may be permitted to be<br \/>\nwithdrawn and the present appeal may be disposed with direction to<br \/>\nhear and dispose the main reference case pending before the Tribunal<br \/>\nas expeditiously as practicable and preferably within a period of<br \/>\nfour months. Learned counsel appearing for the respondents having no<br \/>\nobjection, the appellant  is permitted to withdraw the original<br \/>\nSpecial Civil<br \/>\nApplication  No.8975 of 2009 with liberty to approach the<br \/>\nTribunal for early hearing of the main reference case being Reference<br \/>\n(IT) No.9 of 2007, which is pending before the Industrial Tribunal at<br \/>\nNadiad.  By consent, the parties are directed to co-operate in the<br \/>\nearliest practicable hearing  and disposal of the said reference case<br \/>\non merits and in accordance with law without seeking any unnecessary<br \/>\nadjournment. The Tribunal shall be at liberty to impose cost upon the<br \/>\nparty seeking any adjournment, in its discretion,  as may be thought<br \/>\nfit. The appeal is disposed accordingly with the clarification that<br \/>\nthe parties shall be entitled to take all the legally available<br \/>\ncontentions before the Tribunal and the Tribunal shall hear and<br \/>\ndispose the aforesaid reference case as expeditiously as practicable<br \/>\nand preferably on or before 30th September, 2010. The<br \/>\noriginal Special Civil<br \/>\nApplication  No.8975 of 2009 shall stand disposed as<br \/>\nwithdrawn, without any order on merits.
