Petitioner No. 1 was the tenant of R-1 at 1, Ansari<br \/>\nRoad, Darya Ganj, Delhi. It seems that some disputes arose<br \/>\nbetween them and R-1 moved some application before the<br \/>\nCalcutta High Court in a pending proceedings between<br \/>\npetitioner No. 1 and Punjab National Bank which was rejected<br \/>\nby order dated 5.6.1996 with liberty to R-1 to take<br \/>\nappropriate eviction proceedings against petitioner under<br \/>\nlaw. Thereafter R-1 filed Suit No. 1778\/96 for possession<br \/>\nof first floor of the premises before this court in which<br \/>\nhe filed a replication allegedly admitting payment of rent<br \/>\nby petitioner up to April 1996. It is also alleged that R-1<br \/>\nadmitted in these proceedings that rent for the premises<br \/>\nwas tendered by money order up to March 1997 which was not<br \/>\naccepted but suppressing all these facts R-1 later filed an<br \/>\neviction petition before Additional Rent Controller for<br \/>\neviction of petitioner from the premises and had obtained<br \/>\neviction order dated 2.7.1999.\n<\/p>\n<p> 2. Petitioner&#8217;s case is that R-1 had misled the court<br \/>\nof Additional Rent Controller by withholding the<br \/>\nfacts\/documents and pleadings before Calcutta High Court<br \/>\nand this court and had filed a false application and<br \/>\naffidavit and obtained an ex-parte eviction order on the<br \/>\nground of non-payment of rent and by indulging in this had<br \/>\ncommitted a fraud on this court and that of Additional Rent<br \/>\nController and the Criminal contempt also.\n<\/p>\n<p> 3. R-1 who is said to have filed an application<br \/>\nbefore the Calcutta High Court and the suit before this<br \/>\ncourt had died meanwhile and R-2 is his daughter and was<br \/>\nhis general of attorney holder at the relevant time. She<br \/>\nhas filed a reply to this petition claiming that it had<br \/>\nbecome infructuous with the death of R-1 and in terms of<br \/>\nSection 20 of Contempt of Courts Act. Allegations of<br \/>\nindulging in any falsehood or committing any fraud on the<br \/>\ncourt of ARC or this court are denied by her. According to<br \/>\nher, R-1, had submitted the correct facts before ARC in his<br \/>\neviction petition and he was not obliged to plead anything<br \/>\nwith regard to any litigation with which he was not<br \/>\nconcerned or to which he was not a party.\n<\/p>\n<p> 4. L\/C for petitioner has pressed in service DB<br \/>\njudgment of this court in    Satish Khosla v. Ranbaxy<br \/>\nLimited    to show that non-disclosure of<br \/>\npendency of any earlier litigation between the parties and<br \/>\nwithholding or non-production of documents which was<br \/>\nrelevant to the litigation amounted to committing of a<br \/>\nfraud on the court and also contempt of court.\n<\/p>\n<p> 5. While this matter was under consideration, it<br \/>\ntranspired that petitioners had applied for setting aside<br \/>\nof the ex-parte eviction order before the Controller where<br \/>\nproceedings were pending. Apart from that, it does not<br \/>\nappear to us that R-1 could be rendered liable for any<br \/>\ncriminal contempt of this court even if it was assumed that<br \/>\nhe had failed to disclose the contents of any application<br \/>\nfiled by him before the Calcutta High Court or any<br \/>\nreplication in the suit before this court.\n<\/p>\n<p> 6. Criminal contempt as defined in Section 2 of<br \/>\ncontempt of Courts Act, 1971 connotes the publication of<br \/>\nany matter or doing of any other act which scandalises or<br \/>\ntends to scandalise, or lowers or tends to lower the<br \/>\nauthority of any court, prejudices or interferes or tends<br \/>\nto interfere with, the due course of any judicial<br \/>\nproceeding or interferes or tends to interfere with or<br \/>\nobstructs or tends to obstruct the administration of<br \/>\njustice in any manner. It is not petitioner&#8217;s case<br \/>\nthat alleged withholding some information or documents had<br \/>\ninterfered with judicial process or had obstructed the<br \/>\ncourse of justice or had lowered the authority of this<br \/>\ncourt of for that matter ARC. His only complaint is that<br \/>\nbut for this ARC would not have passed the eviction order<br \/>\nagainst him on the ground of non-payment of rent. This, in<br \/>\nour view, does not interfere with the judicial process or<br \/>\nproceedings nor would it obstruct the course of justice.<br \/>\nMore so because if petitioner&#8217;s contention was upheld, it<br \/>\nwould result in setting aside of the eviction order in an<br \/>\nappropriate remedy.\n<\/p>\n<p> 7. We have also examined the DB judgment of this<br \/>\ncourt relied upon by petitioner&#8217;s counsel which is wholly<br \/>\ndistinguishable because the court in that case before it<br \/>\nhad found a fraud having been committed by the litigating<br \/>\nparty in the fact and circumstances of the case. We have<br \/>\nnot come across any proposition laid down in this which<br \/>\nholds that non-disclosure or withholding of any information<br \/>\nor document in any allied or earlier litigation between the<br \/>\nparties amounted to a criminal contempt of court in all<br \/>\nevents and circumstances.\n<\/p>\n<p> 8. Considering all this and also that R-1, against<br \/>\nwhom petitioner had initiated the contempt action, had<br \/>\nsince died and petitioner had sought setting aside of<br \/>\nex-parte eviction order before the Controller, we find no<br \/>\nmerit in this petition.
