No. 659 of 1996)<br \/>\nMunna @ Narendra<br \/>\nV.\n<\/p>\n<p>State of Maharashtra<br \/>\n\t\t\t O R D E R<br \/>\n     Special leave in both the petitions granted.\n<\/p>\n<p>2.   These two criminal appeals are filed by accused Nos. 1,<br \/>\n4  and\t 7  (appellants)   challenging\tthe   legality\t and<br \/>\ncorrectness of the impugned judgment and order dated<br \/>\n15-2-1995 passed  by the High Court of Judicature at Bombay,<br \/>\nNagpur\tBench,\t affirming  conviction\tand  sentence  under<br \/>\nsections 147, 148, 302 read with 149 IPC. Both these appeals<br \/>\narise out of a common impugned judgment and, therefore, they<br \/>\nare being disposed of by this judgment.\n<\/p>\n<p>3.   The complainant  Raja Ram\tKolhe  is  the\tresident  of<br \/>\nvillage Mohgaon Bhadade. Chhatrasal (since deceased) was one<br \/>\nof the\tsons of said Raja Ram. The incident in question took<br \/>\nplace on  21-9-1991 at about 3.00 p.m. Fifteen days prior to<br \/>\nthe said  incident, a  quarrel took place between Chhatrasal<br \/>\nand Vasanta  (A-2) over\t liquor. On  21-9-1991 at about 3.00<br \/>\np.m. Chhatrasal\t had gone  to the  shop of Chindu (PW 5) for<br \/>\nshaving. At  that time, all the seven accused who were armed<br \/>\nwith deadly  weapons like  spear and bamboo sticks formed an<br \/>\nunlawful assembly  and assaulted  Chhatrasal and dragged him<br \/>\non the\troad. They  continued assaulting  Chhatrasal even on<br \/>\nthe  road.   Chhatrasal\t sustained   bleeding  injuries\t and<br \/>\ncollapsed on  the ground  and ultimately  succumbed  to\t the<br \/>\ninjuries. The  complaint about\tthe incident  was lodged  at<br \/>\nabout 2.00  a.m. on  22-9-1991.\t The  investigating  officer<br \/>\ncarried out  the necessary  investigation and  arrested\t the<br \/>\naccused. After\tcompleting the\tinvestigation, seven accused<br \/>\nwere put  up for  trial for  the offences  punishable  under<br \/>\nsections 147,  148, 302\t read with section 149 of the Indian<br \/>\nPenal Code.\n<\/p>\n<p>     The defence  of the  accused was  that of total denial.<br \/>\nThe defence,  however, examined\t Madhaorao Umathe (DW 1) and<br \/>\nPandurang Gathe (DW 2) as their defence witnesses.\n<\/p>\n<p>     The VIIth\tAddl. Sessions Judges Nagpur on appraisal of<br \/>\noral and  documentary evidence on record by his judgment and<br \/>\norder dated  19-6-1993 found  the appellants  and other four<br \/>\naccused guilty\tof offences  for which\tthey were tried. The<br \/>\nlearned trial  Judge accordingly  sentenced all\t the accused<br \/>\nfor various  terms of  rigorous imprisonment  including life<br \/>\nimprisonment.  Aggrieved  by  this  judgment  and  order  of<br \/>\nconvictions all\t the seven  accused preferred  one  criminal<br \/>\nappeal before the High Court of judicature at Bombay, Nagpur<br \/>\nBench. The  High Court\ton re-appraisal\t of the\t evidence on<br \/>\nrecord concurred  with the findings of guilt recorded by the<br \/>\nlearned Trial  Judge and  accordingly by  its  judgment\t and<br \/>\norder dated 15-2-1995 dismissed the appeal.\n<\/p>\n<p>4.   The appellants  aggrieved by  the\taforesaid  order  of<br \/>\nconviction and sentence preferred these two appeals.\n<\/p>\n<p>5.   Mr. Daga, learned Advocate appearing in support of both<br \/>\nthese appeals  urged that  the impugned\t order of conviction<br \/>\nand  sentence\tis  unsustainable.  He\tsubmitted  that\t the<br \/>\nevidence on  record does  not refer  to any overt-act on the<br \/>\npart of\t the appellants.  The appellants  were found  guilty<br \/>\nwith the aid of section 149 IPC, ignoring the fact that they<br \/>\nhad not\t participated in the said assault on Chhatrasal. The<br \/>\nlearned Advocate  further urged that evidence on record does<br \/>\nnot prove  beyond reasonable  doubt that the appellants were<br \/>\nmembers of an unlawful assembly sharing the common object to<br \/>\ncommit the  murder of  Chhatrasal and in prosecution thereof<br \/>\ncommitted his murder. Mr. Daga, therefore, urged that in the<br \/>\nabsence of proof of common object of an unlawful assembly to<br \/>\ncommit the  murder of  Chhatrasal, the\tappellants cannot be<br \/>\nconvicted under\t section 302  with the\taid of\t149 IPC.  He<br \/>\nurged that  assuming, that the appellants did participate in<br \/>\nthe said assault, with the bamboo sticks and as per the post<br \/>\nmortem examination  report, the\t injuries referable  to\t the<br \/>\nassault\t by   bamboo  stick   were  simple  in\tnature,\t the<br \/>\nconviction of the appellants under section 302 read with 149<br \/>\nIPC is illegal.\n<\/p>\n<p>6.   Mr. Jadhav, learned Advocate appearing for the State of<br \/>\nMaharashtra supported the impugned judgment.\n<\/p>\n<p>7.   We have  carefully perused\t the judgment  of the  trial<br \/>\ncourt as  well as  the High Court. We have also gone through<br \/>\nthe materials  on record.  It is  not and cannot be disputed<br \/>\nthat Chhatrasal had sustained as many as six injuries out of<br \/>\nwhich three injuries were punctured wounds and the remaining<br \/>\nwere contusions\t over the vital parts of the body. Dr. Ashok<br \/>\nPanbudey (PW  6) who  performed the autopsy on the dead body<br \/>\nof Chhatrasal  opined that  the cause  of death\t was due  to<br \/>\nshock and  haemorrhage and  due to  injuries to\t the  middle<br \/>\ncranial fossa  (right side)  and injuries  to the  liver and<br \/>\nright kidney.  Dr. Ashok Panbudey (PW 6) further opined that<br \/>\nthese injuries\twere ante mortem and they were sufficient to<br \/>\ncause the  death of  Chhatrasal. We  see  no  hesitation  in<br \/>\naccepting the  finding of  the courts  below that Chhatrasal<br \/>\ndied because  of the  injuries sustained  by him  during the<br \/>\nassault in question on 21-9-1991.\n<\/p>\n<p>8.   Coming  to\t  the  complicity  of  the  appellants,\t the<br \/>\nprosecution case principally rests on the evidence of Chindu<br \/>\n(PW 5)\twho runs a barber shop where Chhatrasal had gone for<br \/>\nshaving. He  is an eye witness to the entire incident and at<br \/>\nthe earliest opportunity, he had disclosed all details about<br \/>\nthe assault  to Raja  Ram (PW 1) father of Chhatrasal and Om<br \/>\nNarayan (PW  4). We have gone through the evidence of Chindu<br \/>\nand in our opinion, the Courts below have committed no error<br \/>\nin accepting  the evidence of Chindu (PW 5) as trust worthy.<br \/>\nWe have\t also gone  through the\t evidence of Raja Ram (PW 1)<br \/>\nand Om\tNarayan (PW 4) who have again consistently supported<br \/>\nthe prosecution story. On the basis of the evidence of these<br \/>\nwitnesses, the\tcourts below  have held\t that the appellants<br \/>\nand other  four accused\t had come  together to\tthe shop  of<br \/>\nChindu (PW  5) and  assaulted Chhatrasal  at  the  shop\t and<br \/>\nthereafter dragged  him on the road and continued to assault<br \/>\nhim. The  evidence of  the above  prosecution witnesses also<br \/>\nfinds support  from the medical evidence. We, therefore, see<br \/>\nno infirmity in the findings recorded by the courts below as<br \/>\nregards the  complicity of  the appellants  alongwith  other<br \/>\nfour accused.  The appellants  were the\t members of unlawful<br \/>\nassembly and  shared common  object to\tcommit the murder of<br \/>\nChhatrasal.\n<\/p>\n<p>9.   Mr. Daga strenuously urged that there is no evidence on<br \/>\nthe record  to hold  that the  appellants  shared  a  common<br \/>\nobject alongwith  Vasanta accused  No. 2 who caused injuries<br \/>\nby spear  resulting in\tto the\tdeath of  Chhatrasal. In the<br \/>\nabsence of  any positive  evidence on  record. counsel urged<br \/>\nthat the  appellants are  entitled for\tbenefit of doubt and<br \/>\nthey be acquitted of an offence punishable under section 302<br \/>\nread with  149 of  the Indian  Penal code. We do not see any<br \/>\nsubstance in  this contention because the evidence on record<br \/>\nis to  the contrary.  The contention of the learned advocate<br \/>\nfor the\t appellants that there is no overt-act attributed to<br \/>\nthe appellants\tby the\tprosecution witnesses  in untenable.<br \/>\nThe evidence on record clearly establishes the common object<br \/>\nof the unlawful assembly to commit murder of Chhatrasal. The<br \/>\npreparation with  Which they  came together  and  thereafter<br \/>\nassaulted Chhatrasal  leaves no\t manner of doubt about their<br \/>\ncommon object.\tIt is  not possible  to accept\tany  of\t the<br \/>\ncontentions raised  by Mr. Daga on behalf of the appellants.<br \/>\nThere is  no substance\tin both\t the  appeals.\tAppeals\t are<br \/>\naccordingly dismissed.\tIf  the\t appellants\/accused  are  on<br \/>\nbail, they  shall surrender  to their bailbonds forthwith to<br \/>\nserve out their respective remaining terms of sentences.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Prem Raj And Anr vs State Of Maharashtra on 7 May, 1996 Equivalent citations: JT 1996 (6), 117 1996 SCALE (4)252 Author: M M.K.
