It is the case of the appellant that he has spent\n\nconsiderable amount towards conveyance, nourishing\n\nfood and attendant cha es including medical expenses\n\n'__H__\"__H__,,i,_,.\u00bb\n\n\n\nand other incidental expenses and therefore, he\n\nbe Compensated reasonably.\n\n4. On account of the injuries\"'lsustained \n\naccident, the appellant  clairn.xpletitionwujnder\"'it\n\nSection 166 of the.\u00bb .Motor\"\"{leh.icles  before the\nTribunal, seeking  sum of ?06.00\nlakhs   claim petition\nhad come'  the Tribunal on\n261\"    after considering the\nrelevant  file and after appreciation\n\nof the oral\"and .dc-Curnenltary evidence, allowed the claim\n\n  inn part,\"\"awarding a sum of \"'\\'75,910\/- with\n\n  i'1;.tere:st\u00bb..,at4V\"6%_j..per annum from the date of petition till\n\nthe realization. Being dissatisfied with the\n\n quanttifn of compensation awarded by the Tribunal, the\n\nldtpapplellant is in appeal before this Court, seeking\n\n \u00bb. .._..enhancement of compensation.\n\n%M\n\n\n\n5. 'We have heard learned counsel for appellant\n\nand learned counsel for Insurance Company' \n\nconsiderable length of time.\n\n6. After hearing learnediecounsell\u00e9'--fo'r._'the\"parties\n\nand after perusal of the _iu.dgr___11ent\" awardsppassegdlibyih't,\n\nTribunal including the original hgefore us,\nwe are of the View  assessing the\noral and doc1;menta13;:'_ \" other relevant\nmaterial    iawarded just and\n\u00ab \/-- towards pain\nand  'towards medical expenses,\n$10,506  cogrwes\/ance, nourishing food and\n S,O00\/- towards future medical\n\\\u00bb 61;.ees  a sum of ?910\/ -- towards paper\nH  it does not call for interference.\n\nit , \"However, the Tribunal erred while awarding\n\nQ \"'c.ompensati'oi'ii' towards loss of income during treatment\n\n' \"and further erred in not awarding any\n\nilcoimpensation towards loss of future income and loss of\n\namenities, discomforts and unhappiness on account of\n\n\/\/\nwW_\"_W__H___a._....\n\nI\n\n\n\ndisability. 'i'here is no dispute regarding the occiirrience\n\nof accident and the resultant injuries   \n\nappellant. 01': account of the irgjziries  lh'e7has\n\ntaken treatment for a total periodni 105_--v_days \n\nHospital and underwent th3.*ee:l\"surgeries.'~e.{ii  the it\n\ngravity of the irzjm-'ies_ \"-and thesurgeries\nundergone, we infer  bed rest\nand foHow--t;:'pl'treat1rientleat 2 period of four\nmonths.  disability at 107% in\nrespect  respect of whole body.\nHavingregard to  of injuries sustained, we re-\n\nassess the lwho1e.'l'bodyl'disability at 36% by dividing 107\n\n   being aged about only 38 years, at\n\n   Eu:-cident, has to go through this ordeal for\n\nthe--- rest'  life and he cannot do his coolie work as\n\n   Wassdoing before. The Tribunal has assessed his\n\nl l\"Vrlnorithly income of the appellant at ?1,500\/~ at the rate\n\nl V' \"of ?50\/~ per day, which is on the lower side and needs\n\nto be reassessed. Having regard to the age, avocation\n\nand the year of accident, we re~assess his monthly\n\n\/4..._.....\n\n\n\nBangalore Rural District, Bangalore, is hereby \n\nawarding a sum of ?2,49,280\/-- as against\"  \n\nawarded by Tribunal, with interest 'at.5\u00a2f;  on\n\nthe enhanced sum, from the date'.of-petitionitili \n\nof realization.
