Special Civil Application No. 10559 of 2002\n          MR BS PATEL for Petitioner No. 1-2\n          MRS RANJAN B PATEL for Petitioner No. 1-2\n          MS MANISHA LAVKUMAR, AGP, for Respondent No. 1-2\n          NOTICE SERVED BY DS for Respondent No. 3\n\n\n     --------------------------------------------------------------\n\n\n              CORAM : MR.JUSTICE M.S.SHAH\n\n\n              Date of Order: 25\/11\/2002\n\n\nORAL ORDER<\/pre>\n<p>     The    petitioner-Cooperative   Society  and its<br \/>\n     Chairman have filed this petition under Article 226 of<br \/>\n     the Constitution for challenging show cause notice dated<br \/>\n     8-10-2002 (Annexure A) issued by the Joint Commissioner<br \/>\n     (Textile), Cottage and Village Industries, Gujarat State<br \/>\n     under Section 81 (1) of the Gujarat Cooperative Societies<br \/>\n     Act, 1961 (hereinafter referred to as &#8220;the Act&#8221;) calling<br \/>\n     upon    the petitioner-Society to show cause why the<br \/>\n     Managing Committee of the petitioner-Society should not<br \/>\n     be    superseded   in view of the persistent defaults<br \/>\n     mentioned in the notice.      The petitioners have also<br \/>\n     prayed    for    a  writ   of   mandamus  to direct the<br \/>\n     respondent-authorities to release the grant       already<br \/>\n     sanctioned in favour of the petitioner-Society vide order<br \/>\n     dated 26-3-2002 passed by the Commissioner of Cottage and<br \/>\n     Village Industries.\n<\/p>\n<p>     2.Mr BS Patel learned counsel for the petitioners<br \/>\n     has submitted that earlier similar show cause notice<br \/>\n     dated   8-4-2002   came   to   be issued by the Joint<br \/>\n     Commissioner and this Court passed order dated 3-7-2002<br \/>\n     in Special Civil Application No.4193 of 2002 directing<br \/>\n     the authorities to consider the petitioners&#8217; reply and to<br \/>\n decide the matter.   However, instead     of deciding the<br \/>\nmatter, respondent No.1 has issued       another show cause<br \/>\nnotice dated 8-10-2002 for the same      alleged defaults.<br \/>\nThe contention regarding jurisdiction    of respondent No.1<br \/>\nto issue the show cause notice is also   raised.   So also<br \/>\nthe contention is raised that the         present committee<br \/>\ncannot be superseded for the defaults     of the previous<br \/>\ncommittee.\n<\/p>\n<p>3.Ms Manisha Lavkumar, learned AGP appearing for<br \/>\nthe respondent-authorities has     submitted   that   the<br \/>\nimpugned show cause notice dated 8-10-2002 has five<br \/>\ngrounds out of which only three grounds were subject<br \/>\nmatter of the previous show cause notice dated 8-4-2002.<br \/>\nThereafter, additional material was available with the<br \/>\nauthorities and, therefore, it is specifically mentioned<br \/>\nin the impugned notice dated 8-10-2002 that pursuant to<br \/>\nthe audit notes in the recent audit, the Committee is<br \/>\nalso required to be heard in respect of other matters and<br \/>\nalso representations are received from the Gujarat State<br \/>\nCooperative Societies Employees Union, Petlad and Shri<br \/>\nBabubhai Becharbhai Patel. It is, therefore, submitted<br \/>\nthat no interference of this Court is called for at this<br \/>\nstage.\n<\/p>\n<p>As regards the other contentions, it is submitted<br \/>\nthat similar other contentions were urged in the previous<br \/>\npetition still this Court required the petitioners to<br \/>\nappear before the authority issuing the show cause notice<br \/>\nand to make their submissions there and that, therefore,<br \/>\nthere is no reason to take a different view in the<br \/>\npresent matter.\n<\/p>\n<p>4.Having heard the learned counsel for the parties,<br \/>\nit is clear that although there are some common grounds<br \/>\nin the notices dated 8-4-2002 and 8-10-2002, there are<br \/>\nalso additional grounds in the impugned notice dated<br \/>\n8-10-2002.   So also the question of jurisdiction and the<br \/>\nliability of the present committee for the defaults of<br \/>\nthe previous committee, all these contentions can be<br \/>\nraised before the Commissioner\/ Joint Commissioner of<br \/>\nCottage and Village Industries. The present petition is,<br \/>\ntherefore, disposed of in terms of the order dated<br \/>\n3-7-2002.\n<\/p>\n<p>5.Accordingly, the petition is disposed of in terms<br \/>\nof the following directions:-\n<\/p>\n<p>(i) If the petitioners file reply to the show cause<br \/>\n        notice within one month from today, the authority<br \/>\n        shall consider the same and take appropriate<br \/>\n                 decision in accordance with law after extending<br \/>\n                opportunity of hearing to the petitioners.\n<\/p>\n<p>        (ii) While taking decision in pursuance of the show<br \/>\n                cause notice, the authority shall deal with all<br \/>\n                the submissions raised before it by a reasoned<br \/>\n                order    including   the   contention   regarding<br \/>\n                jurisdiction.   The authority shall take      the<br \/>\n                decision in the matter as early as possible and<br \/>\n                not later than three months after the receipt of<br \/>\n                the reply to the show cause notice.\n<\/p>\n<p>        (iii) If  the said decision is adverse, then        the<br \/>\n                petitioner will be at liberty to challenge the<br \/>\n                same by way of appropriate proceedings before an<br \/>\n                appropriate forum.     If the said decision is<br \/>\n                adverse to the petitioner, then the same shall<br \/>\n                not be implemented for a period of two weeks from<br \/>\n                the   date   of    communication thereof to the<br \/>\n                petitioner.\n<\/p>\n<p>        As regards the grievance about non-release of<br \/>\n        grant sanctioned by the order dated 26-3-2002, it will be<br \/>\n        open to the petitioner to make a grievance about the same<br \/>\n        by a separate representation to the authority which has<br \/>\n        issued the show cause notice and the authority shall look<br \/>\n        into the same and take appropriate decision within one<br \/>\n        month from the date of receipt of the application\/<br \/>\n        representation.\n<\/p>\n<p>        6.With these observations and directions, this<br \/>\n        petition is disposed of at this stage without going into<br \/>\n        the merits of the case. Notice is discharged.
