No.44578 of 2010\n                      RAM ISHWAR SINGH, son of Late Ayodhya Singh\n                                           Versus\n                                    THE STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p>2   24.01.2011            Heard learned counsel for the petitioner<\/p>\n<p>                 as well as learned P.P. for the State.<\/p>\n<p>                              Petitioner seeks his bail in connection<\/p>\n<p>                 with G.R.P. Patna Case No.34 of 2007 registered<\/p>\n<p>                 under Sections 302, 201\/34 of the I.P.C.<\/p>\n<p>                              Petitioner is named in the F.I.R., but<\/p>\n<p>                 admittedly,         the   informant        has    not    seen     the<\/p>\n<p>                 actual killing of the deceased and furthermore<\/p>\n<p>                 it is an admitted position that the dead body of<\/p>\n<p>                 deceased was fond on railway track for which a<\/p>\n<p>                 U.D.     case       was     registered       against          unknown<\/p>\n<p>                 persons.      The    petitioner      and    others       have    been<\/p>\n<p>                 made accused in this case only on the ground<\/p>\n<p>                 that    in    the    year    1994    they        had    killed   the<\/p>\n<p>                 brother of the informant for which a Sessions<\/p>\n<p>                 Trial was pending and deceased wanted to depose<\/p>\n<p>                 in     the     above      stated     sessions          trial,     but<\/p>\n<p>                 petitioner          and    his      associates          had     given<\/p>\n<p>                 threatening          of    dire      consequences          to     the<\/p>\n<p>                 deceased.\n<\/p>\n<p>                              Learned      counsel     for        the    petitioner<\/p>\n<p>                 submits that informant had not given any Sanha<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>     to police about the above stated threatening nor<\/p>\n<p>     informed the court concerned for the so-called<\/p>\n<p>     threatening. He further submits that as a matter<\/p>\n<p>     of fact deceased died in a rail accident and<\/p>\n<p>     taking   the       advantage      of     previous    enmity,    the<\/p>\n<p>     petitioner and other accused have falsely been<\/p>\n<p>     implicated in this case.\n<\/p>\n<p>                Considering        the        aforesaid    facts     and<\/p>\n<p>     circumstances        as    well     as    submissions      of   the<\/p>\n<p>     parties petitioner, namely, Ram Ishwar Singh is<\/p>\n<p>     directed to be released on bail on furnishing<\/p>\n<p>     bail bonds of Rs.10,000\/-(ten thousand) with two<\/p>\n<p>     sureties      of     the    like       amount     each     to   the<\/p>\n<p>     satisfaction        of     Railway       Judicial    Magistrate,<\/p>\n<p>     Patna    in   connection       with       above   stated    G.R.P.<\/p>\n<p>     Patna Case No.34 of 2007.\n<\/p>\n<\/p>\n<p>                                 (Hemant Kumar Srivastava,J.)<br \/>\nPN\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ram Ishwar Singh vs The State Of Bihar on 24 January, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
