No.25083\/2010-I\n                ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n           Dated this the 20th day of August, 2010\n\n                      J U D G M E N T\n<\/pre>\n<p>    In this writ petition, the petitioner is a resident of<\/p>\n<p>Old Ward No.4 (presently new Ward No.2) of Pudunagaram<\/p>\n<p>Grama Panchayat.   The petitioner challenges the lot taken<\/p>\n<p>by which new ward No.2 is reserved as Scheduled Caste<\/p>\n<p>(General).  It is mainly contended that the new ward was<\/p>\n<p>formed carving out ward Nos.2 and 4 which were reserved one<\/p>\n<p>along with ward No.3 and, going by the percentage of<\/p>\n<p>voters, the combined strength will be 55%.  It is therefore<\/p>\n<p>submitted that the fixing of the said ward as reserved ward<\/p>\n<p>is illegal.\n<\/p>\n<p>    2.   The second respondent has filed a statement and a<\/p>\n<p>reply affidavit was filed by the petitioner also wherein<\/p>\n<p>the details of the percentage of the population are given<\/p>\n<p>in paragraph  (2)  which  is  above  50%    Thereafter,  an<\/p>\n<p>additional statement has been filed on behalf of the second<\/p>\n<p>respondent wherein it is stated that the District Election<\/p>\n<p>Officer has addressed a letter dated 19\/08\/2010 to the<\/p>\n<p>State Election Commission informing that there is mistake<\/p>\n<p>in the calculation of percentage of population that has<\/p>\n<p>come to the newly constituted ward No.2 and has requested<\/p>\n<p>the State Election Commission to intimate further steps to<\/p>\n<p>W.P.(C). No.25083\/2010<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>be taken in the matter.      Annexure-D is the copy of the said<\/p>\n<p>letter.\n<\/p>\n<p>     3.      Annexure-D   evidences  the   fact that  error   in<\/p>\n<p>calculating the percentage of distribution of population<\/p>\n<p>from the existing reservation constituencies of wards 2 and<\/p>\n<p>4  to    the    newly  delimited    constituency of  ward   No.2<\/p>\n<p>Thekkathivattaram was due to the mistake in identifying the<\/p>\n<p>residential\/non-residential        buildings   of   the    newly<\/p>\n<p>constituted ward 2, by the Secretary.       So the percentage of<\/p>\n<p>distribution       of   population   from   the   two   existing<\/p>\n<p>reservation constituencies to the newly constituted ward 2,<\/p>\n<p>Thekkathivattaram is more than 50%.\n<\/p>\n<p>     4.      The learned Standing Counsel for the Commission<\/p>\n<p>submitted      that   pursuant  to   Annexure-D,  the   Election<\/p>\n<p>Commission has already taken steps in the matter.       It will<\/p>\n<p>satisfy the demands of the petitioner obviously as steps<\/p>\n<p>will have to be taken to rectify the anomaly.             It is<\/p>\n<p>further pointed out that the date for taking a fresh<\/p>\n<p>decision is tentatively fixed on 30\/08\/2010.           The writ<\/p>\n<p>petition is accordingly, allowed recording the same.          No<\/p>\n<p>costs.\n<\/p>\n<\/p>\n<p>                            (T.R.
