               The petitioner-defendant No.2 in the instant revision has<\/p>\n
impugned order dated 4.10.2005 passed by the trial court whereby an<\/p>\n
application filed by him for setting aside the ex parte judgment and<\/p>\n
decree dated 11.3.2002        was dismissed and also the order dated<\/p>\n
4.10.2007 vide which, on appeal, that order was affirmed by the lower<\/p>\n
appellate court.\n<\/p>\n
               The plaintiff-respondent had filed a suit for permanent<\/p>\n
injunction claiming himself to be the owner in possession of the suit
\n CR No. 5872 of 2007                               -2-<\/span><\/p>\n
property on the basis of the sale deed dated 20.3.1995 which was<\/p>\n
decreed by the trial court ex parte on 11.3.2002. Defendant No.2 then<\/p>\n
filed an application for setting aside the ex parte judgment and decree<\/p>\n
on the ground that he had no knowledge about the pendency of the suit<\/p>\n
as he was never served.\n<\/p>\n
            The trial court on the application filed by the petitioner-<\/p>\n
defendant No.2 for setting aside the ex parte judgment and decree<\/p>\n
dated 11.3.2002 framed the following issues:-<\/p>\n
                   “1.    Whether the ex parte proceedings taken<\/p>\n
                          against the applicant are illegal, baseless and<\/p>\n
                          are liable to be set aside, as alleged in the<\/p>\n
                          application? OPA<\/p>\n<\/blockquote>\n
                   2.     Whether the impugned order and decree dated<\/p>\n
                          11.3.2002 is wrong against law and facts and<\/p>\n
                          liable to be set aside as alleged in the<\/p>\n
                          plaint?OPA<\/p>\n<\/blockquote>\n
                   3.     Relief.”<\/p><\/blockquote>\n
            Issues No.1 and 2 being material for the decision of the<\/p>\n
application were taken up together and on appreciation of the evidence<\/p>\n
led by the parties, the trial court held that the ex parte proceedings and<\/p>\n
the judgment and decree dated 11.3.2002 against defendant No.2 were<\/p>\n
perfectly legal. Accordingly, the trial court vide order dated 4.10.2005<\/p>\n
dismissed the said application. Feeling aggrieved, defendant No.2 took<\/p>\n
the matter in appeal and the lower appellate court vide order dated<\/p>\n
4.10.2007 affirmed the order passed by the trial court and dismissed the<\/p>\n
appeal.\n<\/p>\n

             I have heard the learned counsel for the parties and have<\/p>\n
perused the file with their assistance.\n<\/p>\n
             On a query being put by the Court as to what was the right<\/p>\n
of defendant No.2 in the suit property, learned counsel for the petitioner-<\/p>\n
defendant No.2 submitted that he is claiming the right on the basis of<\/p>\n
adverse possession. Learned counsel, however, submitted that the<\/p>\n
findings recorded by the courts below on issues No. 1 and 2 were<\/p>\n
erroneous and against the record and, thus, were liable to be set aside.<\/p>\n
             On the other hand, learned counsel for the plaintiff-<\/p>\n
respondent submitted that both the courts on appreciation of the<\/p>\n
evidence led by the parties concluded that there was no ground to set<\/p>\n
aside the ex parte judgment and decree dated 11.3.2002 and, therefore,<\/p>\n
the application filed by defendant No.2 in that regard was rightly<\/p>\n
dismissed by the courts below.\n<\/p>\n
             The trial court while dismissing the application of the<\/p>\n
petitioner vide order dated 4.10.2005, in paras 8 and 9 of its order,<\/p>\n
observed as under:-\n<\/p>\n
                   “8.    From the perusal of the records of the case, it<\/p>\n
                   is observed that the respondent\/plaintiff Kulbir had<\/p>\n
                   instituted civil suit No. 616 on 31.3.95 against Ram<\/p>\n
                   Singh and Baldev Singh both sons of Tahal Singh.<\/p>\n
                   As per order dated 31.3.95, it is observed that both<\/p>\n
                   the defendants were ordered to be summoned on the<\/p>\n
                   very first day.    On 24.4.95, the summons of the<\/p>\n
                   applicant\/defendant    No.2    were    received    back<\/p>\n
                   improperly served and, therefore, he was ordered to
\n CR No. 5872 of 2007                            -4-<\/span><\/p>\n
               be summoned again for 14.6.95. On that day, his<\/p>\n
               summons were received back with the report that he<\/p>\n
               had refused to accept the same and, therefore, he<\/p>\n
               was ordered to be summoned by way of munadi for<\/p>\n
               12.10.95. The munadi was returned duly served but<\/p>\n
               no one came forward to contest the case on behalf of<\/p>\n
               the applicant and he was consequently proceeded<\/p>\n
               against ex parte.     The matter was contested by<\/p>\n
               defendant No.1 and ultimately, the suit was decreed<\/p>\n
               in favour of the respondent\/plaintiff vide judgment<\/p>\n
               and decree dated 11.3.2002.\n<\/p><\/blockquote>\n
               9.     The original summons are available on record<\/p>\n
               and it is observed that two defendants Ram Singh<\/p>\n
               and Baldev Singh are real brothers.      That on the<\/p>\n
               summons for 24.4.95, it has been reported that when<\/p>\n
               Baldev was given the summons, he had refused to<\/p>\n
               accept the same and, therefore, a copy of the<\/p>\n
               summons along with the copy of the plaint had been<\/p>\n
               pasted on his residence. On the basis of this report,<\/p>\n
               fresh summons were ordered to be issued for<\/p>\n
               14.6.94. The summons were again received with the<\/p>\n
               report that his premises were found locked.          Both<\/p>\n
               these reports have been attested by Sardul Singh,<\/p>\n
               Chowkidar and Pyare Lal, Chowkidar respectively.<\/p>\n
               Thereafter,   the   applicant   was   ordered   to    be<\/p>\n
               summoned through Munadi which has been received
\n CR No. 5872 of 2007                                -5-<\/span><\/p>\n
                   back duly served for 12.10.95. Though no specific<\/p>\n
                   order for issuance of a registered notice had been<\/p>\n
                   issued, a registered notice has also been issued to<\/p>\n
                   the applicant and the postal receipts are available on<\/p>\n
                   record.\n<\/p><\/blockquote>\n
                         It is evident from the above returned summons<\/p>\n
                   that the court had taken all proper measures to<\/p>\n
                   ensure that the applicant was duly served. Service of<\/p>\n
                   notice was effected upon the applicant not only by<\/p>\n
                   means of summons, but also by beat of drum,<\/p>\n
                   affixation as well as by registered notice. It is, thus,<\/p>\n
                   obvious      that the court was perfectly justified in<\/p>\n
                   proceeding against ex parte against the applicant on<\/p>\n
                   12.10.95.”<\/p><\/blockquote>\n
            The order of the trial court on appeal had been upheld by<\/p>\n
the lower appellate court.\n<\/p>\n
            In view of the above, no illegality or perversity could be<\/p>\n
pointed out by the learned counsel for the petitioner-defendant No.2 in<\/p>\n
the orders passed by the courts below which may warrant interference<\/p>\n
by this Court in exercise of its jurisdiction under Article 227 of the<\/p>\n
Constitution of India.   Accordingly, there is no merit in this revision<\/p>\n
petition and the same is hereby dismissed.\n<\/p>\n<\/p>\n
