Srivastava\nRespondent Counsel :- C.S.C.,Rajesh Tripathi\n\nHon'ble Sheo Kumar Singh,J.\n<\/pre>\n<p>Hon&#8217;ble Rajesh Chandra,J.\n<\/p>\n<p>Heard learned counsel for the petitioner, learned counsel who appears<br \/>\nfor the Corporation and learned Standing Counsel.<br \/>\nChallenge in this petition is recovery proceeding by which a particular<br \/>\namount is sought to be recovered from the petitioner.<br \/>\nCounsel for the petitioner has made statement at the bar that this is<br \/>\nthe first writ petition against the recovery proceeding and this fact has<br \/>\nalso been stated in the writ petition.\n<\/p>\n<p>Submission is that if reasonable time is allowed to pay the amount<br \/>\nsought to be recovered, petitioner may be able to pay the same and<br \/>\nirreparable injury on account of arrest and auction of property may be<br \/>\navoided.\n<\/p>\n<p>To the aforesaid, learned counsel appearing for Corporation submits<br \/>\nthat intention of the respondent Corporation has been never to cause<br \/>\nany irreparable injury to the loanee rather the loan amount was<br \/>\nadvanced with the purpose to improve the petitioner&#8217;s future prospects<br \/>\nand thus if for justifiable reason the amount in terms of the agreement<br \/>\nhas not been paid and now petitioner has bonafide intention to pay the<br \/>\namount within a reasonable time then if that liberty is given, it will serve<br \/>\nthe interest of both sides i.e. petitioner may be saved from the riggers<br \/>\nof coercive process i.e. arrest, auction of the properties and at the<br \/>\nsame time respondent Corporation will get its full amount with interest.<br \/>\nThus for grant of reasonable time, if that is to advance justice,<br \/>\nrespondents may not have any objection.\n<\/p>\n<p>In view of aforesaid, this Court feels in the ends of justice that amount<br \/>\nsought to be recovered be permitted to be deposited.<br \/>\nAccordingly, this petition is disposed of with the following directions :\n<\/p>\n<p>i) Petitioner is to deposit an amount of Rs. 50,000\/- directly in the<br \/>\nconcerned Corporation within a period of one month from today to<br \/>\nshow bonafide on his part.\n<\/p>\n<p>ii) If petitioner deposits the above amount within the time so allowed<br \/>\nthen he is permitted to deposit the remaining amount directly in<br \/>\nconcerned corporation in three equal quarterly instalments. In<br \/>\ncalculating the arrears the amount (if any) already paid will be<br \/>\nadjusted.\n<\/p>\n<p>iii) The first instalment may be deposited by 31st October, 2010,<br \/>\nsecond instalment by 31st January, 2011 and third by 30th April, 2011.<br \/>\nThese deposits may be made before the Corporation. In case<br \/>\ninstalments are deposited in the Corporation then 50% of the recovery<br \/>\n charges will be recovered.\n<\/p>\n<p>iv) During period of deposit the recovery proceedings will be kept in<br \/>\nabeyance. In case petitioner defaults in depositing any of the<br \/>\ninstalments within the above stipulated time, it will be open to the<br \/>\nrespondents to start recovery proceedings again by taking coercive<br \/>\nprocess at once.\n<\/p>\n<p>v) Petitioner may file an application for supply of statement of account<br \/>\nalong with duly stamped self addressed envelope. In case any such<br \/>\napplication is filed, the Corporation will give the same to the petitioner<br \/>\nafter deposit of first instalment within fifteen days.\n<\/p>\n<p>vi) This order will not affect any auction if it has already taken place. In<br \/>\nthat event the petitioner may take appropriate legal proceedings to set<br \/>\naside the auction under U.P.Z.A. &amp; L.R. Act and Rules ,1952 or file a<br \/>\nsuit in accordance with law.\n<\/p>\n<p>vii) It is clarified that this order will not be operative and will not come<br \/>\nin way of recovery process in any manner, if any other writ petition has<br \/>\nbeen filed before this Court against the recovery proceeding for the<br \/>\nloan amount.\n<\/p>\n<p>viii) If any fact given from the side of the petitioner is found to be<br \/>\nincorrect by the Corporation authorities, it will be open for them to<br \/>\nmove an application for modification\/recall of the order.<br \/>\nWith the aforesaid writ petition stands disposed of.<br \/>\nOrder Date :- 2.8.2010<br \/>\nSachdeva\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Kalicharan vs State Of U.P. &amp; Others on 2 August, 2010 Court No. &#8211; 36 Case :- WRIT &#8211; C No. &#8211; 44701 of 2010 Petitioner :- Kalicharan Respondent :- State Of U.P. &amp; Others Petitioner Counsel :- Rajendra Ku.
