Notification  under  Section 3(1) of  the\tKerala\tLand<br \/>\nAcquisition Act, 1961 (Act 21 of 1962) was published in\t the<br \/>\nState Gazette on 21-3-1979.  The Collector under Section  11<br \/>\nthereof\t  passed  his  award  on  30-12-1980.\t Thereafter,<br \/>\npossession  of\tsome  land was taken on\t 15-1-1981  and\t the<br \/>\nbalance\t land on 13-3-1981.  The compensation was  deposited<br \/>\non  10-8-1981.\t On a reference under Section 18  the  civil<br \/>\ncourt  enhanced the compensation at Rs 5000 per cent in\t its<br \/>\naward and decree dated 28-2-1985.  The enhanced compensation<br \/>\nwas deposited on 20-10-1986 and 3-12-1986 respectively.\t The<br \/>\nHigh   Court  on  appeal,  while  confirming  the   enhanced<br \/>\ncompensation granted by the civil court disallowed  interest<br \/>\nunder  Sections 28 and 23(1-A) of the Land Acquisition\tAct,<br \/>\nas  amended by the Land Acquisition (Amendment) Act  (68  of<br \/>\n1984),\tfor short &#8220;the Amendment Act&#8221;.\tBy operation of\t the<br \/>\nAmendment  Act, which has come into force on 24-9-1984,\t the<br \/>\nKerala\tAct was repealed and thereby Central Act 1  of\t1894<br \/>\nbecame applicable as amended by the Amendment Act.   Section<br \/>\n15(b) and Section 18 of the Amendment Act amended Section 28<br \/>\nand  Section 23(2) of the Central Act 1 of 1894.   The\tHigh<br \/>\nCourt,\trelying\t upon sub-section (2) of Section 30  of\t the<br \/>\ntransitory  provisions\tof the Amendment Act has  held\tthat<br \/>\nsince the Award was made prior to the date the Amendment Act<br \/>\nhad  come  into\t force, the appellant  is  entitled  to\t the<br \/>\ninterest  under Section 30 of the Kerala Act at the rate  of<br \/>\n4%.   The question, therefore, is whether the  appellant  is<br \/>\nentitled to the enhanced interest as envisaged under Section<br \/>\n28 as amended under Section 18 of the Amendment Act.\n<\/p>\n<p>3.   It is contended for the State by Shri A.S. Nambiar, the<br \/>\nlearned\t Senior Counsel that in Union of India\tv.  Raghubir<br \/>\nSingh1\tthis  Court had given restricted  interpretation  to<br \/>\nSection 30(2) of the transitory provisions holding that only<br \/>\nif the award has been made between 30-4-1982 and  24-9-1984,<br \/>\nwould  the  claimant  be  entitled to  the  benefit  of\t the<br \/>\nenhanced solatium under Section 23(2) of the Principal\tAct.<br \/>\nOn  the\t parity of the ratio therein by\t operation  of\tsub-<br \/>\nsection\t (2) of Section 30 of the transitory  provisions  of<br \/>\nthe Amendment Act which includes Section 28 also, the  ratio<br \/>\ntherein\t would equally be applicable to the facts  of  these<br \/>\ncases.\t Since\tthe award was made by the  Court  after\t the<br \/>\nAmendment  Act\thad come into force, the  appellant  is\t not<br \/>\nentitled to the enhanced interest under the amended  Section<br \/>\n28  of the Principal Act.  We are unable to agree  with\t the<br \/>\nlearned counsel.  Section 30(2) reads :\n<\/p>\n<blockquote><p>\t      &#8221; 30. (2) The provisions of sub-section (2) of<br \/>\n\t      Section  23  and Section 28 of  the  Principal<br \/>\n\t      Act,  as amended by clause (b) of\t Section  15<br \/>\n\t      and Section 18 of this Act respectively, shall<br \/>\n\t      apply,  and shall be deemed to  have  applied,<br \/>\n\t      also to, and in relation to, any award made by<br \/>\n\t      the Collector or Court or to any order  passed<br \/>\n\t      by  the High Court or Supreme Court on  appeal<br \/>\n\t      against any such award under the provisions of<br \/>\n\t      the Principal Act<br \/>\n\t      1 (1989) 2 SCC 754<br \/>\n<span class=\"hidden_text\">\t      370<\/span><br \/>\n\t      after the 30th day of April, 1982 [the date of<br \/>\n\t      introduction    of   the\t Land\t Acquisition<br \/>\n\t      (Amendment)  Bill, 1982, in the House  of\t the<br \/>\n\t      People]  and before the commencement  of\tthis<br \/>\n\t      Act.&#8221;\n<\/p><\/blockquote>\n<p>This  Court  while noticing the effect of the  amendment  in<br \/>\nsub-section (2) of Section 30 in paragraph 31 considered the<br \/>\neffect thereof thus: (SCC pp. 779-780)<br \/>\n\t      &#8220;31.  In construing Section 30(2), it is\tjust<br \/>\n\t      as well to be clear that the award made by the<br \/>\n\t      Collector\t referred to here is the award\tmade<br \/>\n\t      by  the  Collector  under Section\t 11  of\t the<br \/>\n\t      parent Act, and the award made by the Court is<br \/>\n\t      the award made by the Principal Civil Court of<br \/>\n\t      Original Jurisdiction under Section 23 of\t the<br \/>\n\t      parent  Act on a reference made to it  by\t the<br \/>\n\t      Collector under Section 19 of the parent\tAct.<br \/>\n\t      There can be no doubt that the benefit of\t the<br \/>\n\t      enhanced solatium is intended by Section 30(2)<br \/>\n\t      in  respect of an award made by the  Collector<br \/>\n\t      between April 30, 1982 and September 24, 1984.<br \/>\n\t\t\t    Likewise  the benefit of the enhanced  solatiu<br \/>\nm<br \/>\n\t      is extended by Section 30(2) to the case of an<br \/>\n\t      award made by the Court between April 30, 1982<br \/>\n\t      and September 24, 1984, even though it be upon<br \/>\n\t      reference from an award made before April\t 30,<br \/>\n\t      1982.&#8221;\n<\/p>\n<p>4.   This  Court  thereby  clearly held\t that  even  in\t the<br \/>\npending reference made before 30-4-1982, if the civil  court<br \/>\nmakes  an  award between 30-4-1982  and\t 24-9-1984,  Section<br \/>\n30(2)  gets attracted and thereby the enhanced solatium\t was<br \/>\navailable to the claimants.  Since Section 30(2) deals\twith<br \/>\nboth  the amendments to Section 23(2) and Section 28 of\t the<br \/>\nPrincipal Act by Section 15(b) and Section 18, respectively,<br \/>\nof  the\t Amendment Act by parity of the reasoning  the\tsame<br \/>\nratio applies to the awards made by the civil court  between<br \/>\nthose  dates.\tThe  conflict of  decisions  as\t to  whether<br \/>\nSection\t 23(2) as amended by Section 15(b) of the  Amendment<br \/>\nAct through Section 30(2) of the transitory provisions would<br \/>\nbe  applicable to the pending appeals in the High Court\t and<br \/>\nthe  Supreme Court was resolved in Raghubir Singh case 1  by<br \/>\nthe  Constitution  Bench  holding  that\t the  award  of\t the<br \/>\nCollector or the court made between 13-4-1982 and  24-9-1984<br \/>\nwould alone get attracted to Section 30(2) of the transitory<br \/>\nprovision.   The  restricted interpretation  should  not  be<br \/>\nunderstood to mean that Section 23(2) would not apply to the<br \/>\naward  of the civil court pending at the time when  the\t Act<br \/>\ncame into force or thereafter.\tIn this case, admittedly the<br \/>\naward  of  the civil court was made after the Act  had\tcome<br \/>\ninto force, namely, 28-2-1985.\n<\/p>\n<p>5.   Therefore,\t if  the sum which, in the  opinion  of\t the<br \/>\ncourt, the Collector ought to have awarded as  compensation,<br \/>\nis  in\texcess of the sum which the Collector did  award  as<br \/>\ncompensation,  the court shall direct the Collector  to\t pay<br \/>\ninterest on such excess at the rate of 9% per annum from the<br \/>\ndate  on which the Collector took possession of the land  to<br \/>\nthe  date  of  payment of such excess into  the\t court.\t  By<br \/>\noperation of the proviso, if such excess or any part thereof<br \/>\nis paid into the court after the date of expiry of a  period<br \/>\nof  one\t year from the date on which  possession  is  taken,<br \/>\ninterest at the rate of 15% per annum shall be payable\tfrom<br \/>\nthe date of expiry of the said period of one<br \/>\n<span class=\"hidden_text\">371<\/span><br \/>\nyear on the amount of such excess or part thereof which\t has<br \/>\nnot been paid into the court before the date of such expiry.<br \/>\nAccordingly,  the  appellant  is entitled  to  the  enhanced<br \/>\ninterest  @ 9% from the date of taking\tpossession,  namely,<br \/>\n15-1-1981  and\t11-3-1981  respectively\t for  one  year\t and<br \/>\nthereafter  @ 15% till the date of the deposit made  by\t the<br \/>\nCollector.    Admittedly,  the\tdeposit\t of   the   enhanced<br \/>\ncompensation   was   made  on\t20-10-1986   and   3-121986.<br \/>\nTherefore, the interest shall be calculated at the  enhanced<br \/>\nrates for the aforesaid period.\n<\/p>\n<p>6.   The question relating to the payment of 12%  additional<br \/>\ncompensation   under   Section\t23(1-A)\t over\tthe   excess<br \/>\ncompensation  has already been covered by  the\tConstitution<br \/>\nBench  judgment\t of this Court in K.S.\tParipoornan  (1)  v.<br \/>\nState of Kerala2.  Therefore, the appellant is not  entitled<br \/>\nto this benefit as the Collector made the award prior to the<br \/>\ndate of the Amendment Act came into force.\n<\/p>\n<p>7.   The appeals are accordingly allowed in part but in\t the<br \/>\ncircumstances,\tthe parties are directed to bear  their\t own<br \/>\ncosts.\n<\/p>\n<p><span class=\"hidden_text\">372<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India K.S.
