The District Court, Surendranagar has, by its<br \/>\n\tjudgment and order dated 30.04.2005 enhanced the compensation.<br \/>\n\tTherefore, as the petitioners had not preferred any reference, they<br \/>\n\tsubmitted their applications under Section 28-A of the Act.  Such<br \/>\n\tapplications are stated to have been made within the prescribed<br \/>\n\tperiod of limitation and since the aforesaid judgment and order of<br \/>\n\tthe District Court were already carried in appeal, in the group of<br \/>\n\tFirst Appeals No.1151 to 1231 of 2006 and some interim relief was<br \/>\n\tgranted in those appeals, the petitioners were tempted to directly<br \/>\n\tclaim the relief granted by this Court in the First Appeals.\n<\/p>\n<p>\tIt was,<br \/>\n\thowever, conceded that by now, the appeals have been dismissed by<br \/>\n\torder dated 29.11.2010 of learned Single Judge of this Court and the<br \/>\n\tapplications under Section 28-A of the petitioners, which are stated<br \/>\n\tto be pending, are required to be processed for redetermination of<br \/>\n\tthe amount of compensation.\n<\/p>\n<p>\tThe factual<br \/>\n\tstatement made by and on behalf of the petitioners are not<br \/>\n\tcontroverted and no reason is cited for not entertaining and<br \/>\n\tconsidering in accordance with law the applications under Section<br \/>\n\t28-A of the petitioners, which are stated to be pending.\n<\/p>\n<p>Therefore,<br \/>\n\twithout entertaining into merits of the applications of the<br \/>\n\tpetitioners, which are stated to be pending before the respondents,<br \/>\n\tthe petitions are disposed of with the direction that their<br \/>\n\tapplications under Section 28-A of the Land Acquisition Act shall be<br \/>\n\tduly processed and the additional compensation, if any, as may be<br \/>\n\tfound due and payable upon redetermination<br \/>\n\tof the amount of compensation shall be paid to the petitioners, in<br \/>\n\taccordance with law, as expeditiously as practicable.\n<\/p>\n<p>\tD.S.\n<\/p>\n<p>\tPermitted.\n<\/p>\n<p>\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t[D.
