No. 4944 of 2008\n           -------------------------------------------------\n        Dated this the 18th day of December, 2008\n\n                              ORDER\n<\/pre>\n<p>     The petitioner faces indictment in a prosecution under<\/p>\n<p>Sec.494 IPC.    Cognizance has already been taken by the<\/p>\n<p>learned Magistrate.     Trial has not commenced.            During the<\/p>\n<p>pendency of the proceedings, parties have settled their<\/p>\n<p>disputes.  It is prayed that the composition may be accepted<\/p>\n<p>and   the  proceedings       may     be    quashed      invoking  the<\/p>\n<p>extraordinary inherent jurisdiction under Sec.482 Cr.P.C.<\/p>\n<p>     2. I am not persuaded to agree. The offence is<\/p>\n<p>compoundable under Sec.320(2) Cr.P.C.            The parties can get<\/p>\n<p>the relief of composition by moving the learned Magistrate<\/p>\n<p>under Sec.320 Cr.P.C. I find absolutely no justification in the<\/p>\n<p>prayer to invoke the jurisdiction under Sec.482 Cr.P.C. to<\/p>\n<p>quash the proceedings.\n<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. No. 4944 of 2008 -: 2 :-<\/span><\/p>\n<p>      3. The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is not available in India and that if the personal<\/p>\n<p>presence of the petitioner were insisted by the learned<\/p>\n<p>Magistrate, that would cause unnecessary difficulties and<\/p>\n<p>hardship. I find no reason why such insistence must be made.<\/p>\n<p>This position has been clarified beyond doubt in the decision in<\/p>\n<p><a href=\"\/doc\/512921\/\">Baiju v. State of Kerala<\/a> (2007 (4) KLT 1082).<\/p>\n<p>      4. This Crl.M.C. is, in these circumstances, dismissed<\/p>\n<p>without any fetter on the rights of the parties to move      the<\/p>\n<p>learned   Magistrate     under   Sec.320     Cr.P.C.  to accept<\/p>\n<p>composition.\n<\/p>\n<\/p>\n<p>                                                  Sd\/-\n<\/p>\n<p>                                      (R.
