Shah waives service of Rule on behalf of the<br \/>\nrespondent &#8211; State.\n<\/p>\n<p>2.\tThis<br \/>\nis an application preferred under Section 439 of the Code of Criminal<br \/>\nProcedure by the applicant who came to be arrested in connection with<br \/>\nCR No. II- 3117 of 2011 registered at Prantij Police Station, for the<br \/>\noffence punishable under Sections 25(1) (B) of the Arms Act.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate for the applicant submitted that the applicant is an<br \/>\ninnocent person and he has been wrongly arraigned in the  offence. He<br \/>\nalso submitted that the applicant was accused in other offence and<br \/>\nrecovery was made in those offences, and the muddamal recovered in<br \/>\nthose offence, appears to have been shown as recovery in present<br \/>\noffence. Even the ingredients of the alleged offence are not<br \/>\nestablished against the present applicant. He also submitted that<br \/>\nco-accused has been enlarged on bail by this Court. Therefore,<br \/>\nconsidering the parity ground, the applicant may kindly be released<br \/>\non bail by imposing suitable conditions.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP Ms. Shah for the State submitted that considering the seriousness<br \/>\nof the offence, in which the applicant is involved, the application<br \/>\nof the applicant is required to be rejected. Even from the papers<br \/>\nincluding FIR, it appears that the applicant has played active role<br \/>\nin the commission of the offence. Therefore, discretion may not be<br \/>\nexercised in favour of the applicant.\n<\/p>\n<p>5.<br \/>\nHaving considered the rival submissions and on perusal of the role<br \/>\nattributed to the applicant as reflected in the FIR, police papers,<br \/>\nprovisions of Sections 25(1)(B) of the Arms Act and quantum of<br \/>\npunishment, I am of the view that the applicant deserve to be<br \/>\nenlarged on bail, as co-accused have been released by this Court.<br \/>\nThis court is not entering into the detail discussion of the evidence<br \/>\nat this stage of bail.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on bail in connection<br \/>\nwith CR No. II-3117 of 2011 registered at Prantij Police Station, on<br \/>\nhis executing a bond of Rs.10,000\/- [Rupees ten thousand only] with<br \/>\none surety of the like amount to the satisfaction of the Trial Court<br \/>\nand subject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tmark<br \/>\nhis presence at the concerned police station on last day of every<br \/>\nEnglish Calender month, at 11:00 a.m. till the trial is over;\n<\/p>\n<p>[f]<br \/>\n   furnish the present address of his residence to the I.O. and also<br \/>\nto the Court at the time of execution of the bond and shall not<br \/>\nchange his residence without prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>9.\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>10.\tRule<br \/>\nis made absolute to the aforesaid extent.
