Application in the matter of Criminal Misc. Application<br \/>\n\t\tNo.1810 of 2011.\n<\/p>\n<p>(B)<br \/>\n\t\t Your Lordship may be pleased to issue writ of mandamus or any<br \/>\n\t\tother appropriate writ, order or direction in the nature of<br \/>\n\t\tmandamus by quashing and setting aside FIR dated 23rd<br \/>\n\t\tDecember, 2010 annexed at Annexure-A bearing C.R. No.I-191\/2010<br \/>\n\t\tregistered before the Kheda town Police Station, Dist. Kheda.\n<\/p>\n<p>(C)<br \/>\n\t\t Your Lordship may be pleased to set aside the oral order passed by<br \/>\n\t\tHon&#8217;ble Court on 6th April, 2011.\n<\/p>\n<p>(D)<br \/>\n\t\t Pending, admission, hearing and final disposal of this<br \/>\n\t\tapplication, Your Lordships may be pleased to grant ad-interim<br \/>\n\t\trelief in terms of restraining the respondent No.2 to stay the<br \/>\n\t\tinvestigation in connection of the FIR dated 23rd<br \/>\n\t\tDecember, 2010 annexed at Annexure-A bearing C.R. No.I-191\/2010<br \/>\n\t\tU\/s.366 of the I.P.C. Registered before Kheda Police Station, Dist.<br \/>\n\t\tKheda.\n<\/p>\n<p>(E)<br \/>\n\t\tYour Lordship may be pleased to pass an order and direction for the<br \/>\n\t\trecord of statement of applicant before any Magistrate or Judge of<br \/>\n\t\tAhmedabad City Courts, in connection of the FIR dated 23rd<br \/>\n\t\tDecember, 2010 annexed at Annexure-A bearing C.R. No.I-191\/2010<br \/>\n\t\tU\/s. 366 of the IPC registered before Kheda Police Station, Dist.<br \/>\n\t\tKheda, and direction may be given to Police Commissioner Ahmedabad<br \/>\n\t\tfor providing police protection during the time of statement of<br \/>\n\t\tapplicant.\n<\/p>\n<p>(F)<br \/>\n\t\tYour Lordships may be pleased to pass the order and direction may<br \/>\n\t\tbe given to police authority for providing protection to petitioner<br \/>\n\t\tduring the mark her presence before this Hon&#8217;ble Court for making<br \/>\n\t\ther statement.\n<\/p>\n<p>(G)<br \/>\n\t\t The applicant has not filed any other application before this<br \/>\n\t\tCourt and Hon&#8217;ble Supreme Court of India.\n<\/p>\n<p>\tAlongwith this petition<br \/>\n\taffidavit of Hetalben was also placed on record which is at<br \/>\n\tAnnexure-B to the petition. The present petitioner has filed another<br \/>\n\tpetition being Criminal Misc. Application No.1810 of 2011 making<br \/>\n\tfollowing identical prayers :-\n<\/p>\n<p>(A)<br \/>\n\t\tYour Lordships may be pleased to admit and allow this Misc.<br \/>\n\t\tCriminal Application.\n<\/p>\n<p>(B)<br \/>\n\t\t Your Lordships may be pleased to issue writ of mandamus or any<br \/>\n\t\tother appropriate writ, order or direction in the nature of<br \/>\n\t\tmandamus by quashing and setting aside the FIR dated 23.12.2010<br \/>\n\t\tannexed at Annexure-A bearing C.R No.I-191\/2010 registered before<br \/>\n\t\tthe Kheda Town Police Station, Dist. Kheda.\n<\/p>\n<p>(C)<br \/>\n\t\t Pending admission, hearing and final disposal of this application<br \/>\n\t\tYour Lordships may be pleased to grant ad-interim relief in terms<br \/>\n\t\tof restraining the respondent No.2 from arresting the applicant in<br \/>\n\t\tconnection of the FIR dated 23.12.2010 annexed at Annexure-A<br \/>\n\t\tbearing C.R.No.I-191\/2010 registered before the Kheda Police<br \/>\n\t\tStation, Dist. Kheda.\n<\/p>\n<p>(D)<br \/>\n\t\t Grant such other and further reliefs that may be deemed fit and<br \/>\n\t\tprayer in the facts and circumstances of the case.&#8221;\n<\/p>\n<p>\tConsidering the prayers<br \/>\n\tmade by the present petitioner in Criminal Misc. Application No.1810<br \/>\n\tof 2011 and considering the affidavit of Hetalben, in opinion of<br \/>\n\tthis Court present Misc. Criminal Application is not tenable.
