Electricity Board on 4 February, 2002<\/div>\n<\/p>\n<pre><\/pre>\n<p>ORDER<\/p>\n<p>  J.K. Mehra, J. Member    <\/p>\n<p> 1. This Revision Petition arises out of the decision of<br \/>\nM.P. State Consumer Disputes Redressal Commission. The facts in<br \/>\nbrief are that the Petitioner has a small scale industry having<br \/>\nan electric connection for running a 70 horse power machine. The<br \/>\npremises of the petitioner were visited by the Respondent&#8217;s<br \/>\nofficers who found that the meter was faulty and that one phase<br \/>\nwas not giving reading on the meter. a copy of the inspection<br \/>\nreport was given to the petitioner. Thereafter, bills for<br \/>\nRs. 11,082\/- and Rs. 6,628\/- were sent to the Petitioner herein for<br \/>\npayment. Feeling aggrieved by this, the Petitioner filed a<br \/>\ncomplaint. The plea of the Respondent was that since one phase<br \/>\nwas not recording any reading on the meter the additional charges<br \/>\nwere calculated in respect of the said phase on the basis of the<br \/>\nbill for two phases already charged in the regular bill and on a<br \/>\nrequest from the Petitioner only, the Respondent agreed to take<br \/>\nthe average for three moths prior to December, 1993 which worked<br \/>\nout to Rs. 11,501\/- Out of this, the Respondents deducted<br \/>\nRs. 4,873\/- already paid by the Appellant (petitioner herein) and<br \/>\na bill for the balance of Rs. 6,628\/- was sent to the petitioner.<br \/>\nThe plea of the Respondent is that they have not overcharged or<br \/>\ncharged anything extra. The complaint was dismissed by the<br \/>\nDistrict Forum with costs and so was the appeal. The Petitioner<br \/>\nbefore us has raised a plea that if the meter is found faulty,<br \/>\nthe Respondent could not raise a supplementary bill without<br \/>\nreferring the matter to the electrical inspector which had<br \/>\nadmittedly not ben done in the present case. He has placed<br \/>\nreliance upon the case of <a href=\"\/doc\/877880\/\">M.P.E.B. and Ors. v. Basantibai<\/a> reported as AIR 1988 SC 71 and <a href=\"\/doc\/1714329\/\">S.N. Sunderson (Minerals)<br \/>\nLtd. (M\/s.) v. Junior Engineer, M.P.E.B. M.P. No.<\/a> 1878 of 1990<br \/>\n(J), decided on 1.4.1997, which also reiterate this fact. In the<br \/>\nlight of this clear position, the Revision Petition is accepted<br \/>\nand the orders of the District Forum as well as the State<br \/>\nCommission are set aside. The Respondent is directed to proceed<br \/>\nin accordance with the provisions of Section 26(6) of Electricity<br \/>\nAct, 1910. The supplementary bill could be raised by them only<br \/>\nafter obtaining report from the Electrical Inspector, if that<br \/>\nhappens to be adverse to the Petitioner. Meanwhile, if the<br \/>\namount has already been recorded, credit shall be given to the<br \/>\nRespondent for that amount and it will be adjusted in the future<br \/>\nbills.
