    Petitioner filed Annexure 6 and 7 petitions<\/p>\n
(CMP  423\/2009  and  424\/2009)  before  Special<\/p>\n
Judge, Vigilance, Thrissur for interim custody<\/p>\n
of the documents seized by the Vigilance during<\/p>\n
investigation in V.C.1\/2008 and produced before<\/p>\n
the learned Special Judge, under section 451 of<\/p>\n
Code of Criminal Procedure.      By Annexure 8<\/p>\n
order, A6 petition was dismissed.   By Annexure<\/p>\n
9 order Annexure 7 petition was dismissed.<\/p>\n
This petition is filed under section 482 of<\/p>\n
Code of Criminal Procedure to quash Annexure 8<\/p>\n
and 9 orders.\n<\/p>\n
    2.    Learned  counsel  appearing  for  the<\/p>\n
petitioner and learned Public Prosecutor were<\/p>\n
heard.\n<\/p>\n
    3.    Petitioner  is  a  partnership  firm.<\/p>\n

There are two partners to the firm.       One Managing<\/p>\n
partner and M.S. Jayakumari.        M.S. Jayakumari is<\/p>\n
the     wife     of the  sole  accused in  V.C.1\/2008.<\/p>\n
Prosecution        case  is   that   accused      B.S.<\/p>\n
Radhakrishnan, a former Chief Engineer of KSEB<\/p>\n
amassed wealth disproportionate of his known source<\/p>\n
of income         and he thereby committed the offence<\/p>\n
under section 13(1)(e) punishable under section 13<\/p>\n
(2) of Prevention of Corruption Act. Annexure 6 and<\/p>\n
7 petitions are the petitions for release of the<\/p>\n
documents relating to the partnership firm, seized<\/p>\n
during the investigation.        Learned Special Judge<\/p>\n
dismissed Annexure 6 and 7 petitions finding that<\/p>\n
release of the vital documents at this stage would<\/p>\n
effect further investigation of the case.<\/p>\n
      4. On hearing the learned counsel appearing for<\/p>\n
the petitioner and the learned Public Prosecutor,<\/p>\n
it is clear that the learned Special Judge did not<\/p>\n
consider the application in the proper perspective.<\/p>\n
Learned Special Judge did not consider the question<\/p>\n

for what purpose the registered documents obtained<\/p>\n
by    the      firm,  under   which  properties  were<\/p>\n
purchased, are to be retained for the purpose of<\/p>\n
investigation and why a registration copy of the<\/p>\n
said      documents   will  not  serve  the   purpose.<\/p>\n
Similarly the question whether instead of retaining<\/p>\n
the original documents, retaining the certified<\/p>\n
copies of the documents would suffice for the<\/p>\n
purpose of investigation, was not considered by the<\/p>\n
learned Special Judge.       Learned counsel appearing<\/p>\n
for the petitioner submitted that petitioner is<\/p>\n
prepared to substitute certified copies of the<\/p>\n
entire documents and is also prepared to give<\/p>\n
undertaking       before  the court  below  that   the<\/p>\n
documents will be produced as and when required and<\/p>\n
in such circumstances the orders are to be quashed.<\/p>\n
        5. Learned Public Prosecutor pointed out that<\/p>\n
if after investigation it is to be found that the<\/p>\n
investment was that of the petitioner which is<\/p>\n
part of the disproportionate income of the accused,<\/p>\n

for the purpose of the trial the original documents<\/p>\n
will be necessary.\n<\/p>\n
      6. It is also submitted that for the purpose of<\/p>\n
proper investigation some of the original bills and<\/p>\n
vouchers and other documents will be necessary.      It<\/p>\n
is seen from Annexure A8 and A9 orders that these<\/p>\n
aspects were not considered by the learned Special<\/p>\n
Judge and without a speaking order observing that<\/p>\n
releasing the documents would effect the further<\/p>\n
investigation, the petitions were dismissed.<\/p>\n
      7. In the      circumstances of the case Annexure<\/p>\n
A8 and A9 orders are quashed.         The Special Judge<\/p>\n
(Vigilance) is directed to reconsider CMP 423\/2009<\/p>\n
and     424\/2009     and  pass  appropriate  orders  in<\/p>\n
accordance with law.          Investigating Officer is<\/p>\n
permitted to point out which are the original<\/p>\n
documents         necessary   for   the    purpose   of<\/p>\n
investigation.        The Special Judge is directed to<\/p>\n
consider        which  all     original  documents  are<\/p>\n
necessary       to  be  retained  for  the  purpose  of<\/p>\n

investigation. He shall also       consider whether by<\/p>\n
substituting the documents by certified copies, the<\/p>\n
documents could be released to the petitioner as<\/p>\n
sought      on sufficient conditions and undertaking.<\/p>\n
