S1.No.5 Veerabhadra\n\n  BR. and Si.No.1-4\u00bb Sampangappa have been\n\n'V\"=____\"\".\"isa;ued with appointment order or not. If upon\n\nulverifioatiora it is found that there are two unfilled posts\n\nand not one as stated in the reply siiaternent then, after\n\nconfirming the same in the manner stated herein, the\n\n\n\napplicant should be appointed against the second\n\nunfilled post on the basis of his name being includ-e_'cl_la--t\"\n\nSl.No.2 in the additional select list and  \n\ngranted three months time from the date-'ulof  ally'\n\ncertified copy of the said order for of\n\naforesaid direction.\n\n2. The respondent'l_l_ 'tiled Application\n\nNo.57\/2002 contendingavthlat   at Sl.No.2 in\nthe additional; jrlelsplecitive recruitment\nmade   post, a person at\nSl.No.   -- was given appointment.\n\nHowever, '*--though was another vacancy, the\n\n appljC}antr.was appointed though he was at Sl.No.2\n\n   select list and posts were available for\n\n The application was resisted by\n\n\u00abthe  contending that there was only one vacancy\n\n llleyiandlt-wherefore, the person at Sl.No.l A.V.Somashekar\n\n appointed and there is no other vacancy to which\n\n applicant could be appointed. Since the Tribunal,\n\nafter hearing the contention of the learned counsel for\n\nthe parties, in the absence of any speci\ufb01c material to\n\n\n\n\n\nnigh\n\nshow that there was only one vacancy amongst 21 posts\nfilled up in the year 1995 in which. person at S1.N'o.1 of\n\nadditional select list has been appointed and-\"the\n\napplicant before the Tribunal could u\n\naccommodated as he was at S1.No.2 and fo.if w_a.n't of V'\n\nvacancy, held that an enquiry  bee\n\nwhether two vacancies had, occu1*red\u00bb. as contended. in V'\n\nthe application and two perslon\ufb01sliiat S1.E\\Tos';SV-land  of\nthe main select list arel'V_ee;':ab,h'a.dra Shastri BR.\nand Sampangappa and  been issued\n\nappoinytinleiit aiid'-whefefore, if it is clear that\nthere  shall be given to the\n\napplicant    at S1.No.2 in the additional\n\n  zBeing\u00a7\"\"aggrieved by the said order of the\n\n  \"i.8\/ 12\/2009. this writ petition is filed by\n\nthe..pet1tvianie::stat.e.\n\n have heard the learned A.G.A. appealing for\n\n _ '' thepetitioner -- State.\n\n4. Learned A.G.A. for the petitioner W State\n\nV submitted that there was only one vacancy which\n\n\\;Q:\u00a7,.\/E .\n\n\n\noccurred amongst 21 recruitment made and the person\n\nat S1.No.l in the additional select list i.e., Sofna\u00e9hifliealii\ufb02p\n\nhas been appointed and the applicantafrwasilwl V'\n\nappointed as there was no vacancy' and \n\nlist has become inoperative.\n\n5. Learned Govt. Advocate'v\u00abalso_wants:to rely upon\nthe original register to show   no vacancies\nfor appointing the. applicanhtjasl directevdl the Tribunal.\n\n6. We  .clar.ei\";1il'~;:Consideration to the\ncontentiionns 'urged   and scrutinized\n\nthe material \u00abon  ' ''-~  \" \u00ab  \n\n.. 'V The material on record would clearly show that\n\n at Sl.No.2 in the additional list which\n\n iiildispute a.nd the fact that the applicant\n\ngat Sl\u00a7i\\lo\";V.1a  the additional list has already been\n\n tappoii-nted is also not in dispute. However, dispute is as\n\n._.li'r'toAA\"\u00e9.gvhether the persons at Si.
