RAMACHANDRA MENON, J.\n              ..............................................................................\n                       W.P.(C) No. 5616 OF 2010\n               .........................................................................\n                     Dated this the 19th February , 2010\n\n\n\n                                    J U D G M E N T\n<\/pre>\n<p>       The petitioner is challenging                             Exts.P7 and P7(a) orders<\/p>\n<p>passed by the         third respondent granting interim stay directing<\/p>\n<p>the petitioners to            deposit             the amount as specified therein<\/p>\n<p>towards tax and cess,                  as a condition to avail the benefit of<\/p>\n<p>interim stay during the pendency of the appeals.<\/p>\n<p>      2.  Subsequently, it appears that the petitioners                                        have<\/p>\n<p>approached the              appellate authority by filing petitions for<\/p>\n<p>extension of time to satisfy the condition till                                      28.02.2010 and<\/p>\n<p>after  considering the request, the appellate authority passed<\/p>\n<p>Exts. P8 sand              P8(a) orders whereby the time originally<\/p>\n<p>stipulated, i.e. 30.01.2010, was extended till 21.02.2010. The<\/p>\n<p>petitioners are admittedly still to satisfy the condition, including<\/p>\n<p>remittance of the due amount and                                  also to provide adequate<\/p>\n<p>security for the balance amount. The case of the petitioners is<\/p>\n<p>W.P.(C) No. 5616 OF 2010<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>that because of    the frustrating pecuniary    circumstances, the<\/p>\n<p>petitioners could not effect payment .\n<\/p>\n<p>      3.  Heard the learned Government Pleader as well, who<\/p>\n<p>submits on the basis of the materials         on record that, the<\/p>\n<p>amounts stipulated to be paid under Exts. P7 and P7 (a) are only<\/p>\n<p>on the basis of the admitted figures,         as furnished by the<\/p>\n<p>petitioners and further that the orders imposing the condition<\/p>\n<p>are   very much &#8216;speaking orders&#8217;, which do not call for any<\/p>\n<p>interference.      In any view of the       matter, there was no<\/p>\n<p>challenge for the petitioners against Exts.P7 and P7(a) orders<\/p>\n<p>dated 04.01.2010 earlier and the petitioners became aggrieved<\/p>\n<p>only after passing of    Exts.P8 and P8(a) orders, whereby the<\/p>\n<p>request for extension of time till 28.02.2010 was not allowed as<\/p>\n<p>such, but for extending the time only till 21.02.2010.<\/p>\n<p>      4. Considering the facts and circumstances, this Court does<\/p>\n<p>not find it as a fit case to exercise the discretionary jurisdiction<\/p>\n<p>under Article 226 of the Constitution of India. There is absolutely<\/p>\n<p>no merit or bonafides in the Writ Petition. However, considering<\/p>\n<p>the persuasive submission made by the learned Counsel for the<\/p>\n<p>W.P.(C) No. 5616 OF 2010<\/p>\n<p><span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>petitioners, the petitioners are permitted to satisfy the condition<\/p>\n<p>imposed    by the appellate authority\/the third respondent vide<\/p>\n<p>Exts. P7 and P7(a),      on or before 10.03.2010 remitting the<\/p>\n<p>balance tax and cess due and furnish adequate security for the<\/p>\n<p>balance amount. On satisfying the requirement as above, the<\/p>\n<p>petitioners will  continue to have the benefit     of interim stay<\/p>\n<p>granted by the appellate authority       vide Exts. P7 and P7(a).<\/p>\n<p>Subject to this, the recovery proceedings being pursued by the<\/p>\n<p>respondents against the petitioners shall be kept in abeyance.<\/p>\n<p>      The Writ Petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                 P.R.
