Justice M.SASIDHARAN NAMBIAR\n\n Dated :18\/09\/2009\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.2529 of 2009\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioner is the first accused in S.C.No.<\/p>\n<p>26\/2006 on the file of Additional Sessions Court,<\/p>\n<p>Mavelikkara. This petition is filed under Section<\/p>\n<p>482  of  Code   of  Criminal  Procedure   to  quash<\/p>\n<p>Annexure-A1  complaint,  based  on  which,  learned<\/p>\n<p>Magistrate  has  taken  cognizance  and  thereafter<\/p>\n<p>committed the case to the Sessions Court, as the<\/p>\n<p>main case was committed to the Sessions Court.<\/p>\n<p>Learned Sessions Judge has taken cognizance for the<\/p>\n<p>offences under Sections 307, 451 and 506(ii) read<\/p>\n<p>with Section 34 of Indian Penal Code. Learned<\/p>\n<p>counsel appearing for the petitioner submitted that<\/p>\n<p>charge has already been framed by the learned<\/p>\n<p>Sessions Judge and the case is posted for evidence.<\/p>\n<p>    2.  Annexure-A1  complaint  is   sought  to  be<\/p>\n<p>quashed contending that earlier private complaint<\/p>\n<p>filed by the petitioner was dismissed for default<\/p>\n<p><span class=\"hidden_text\">CRMC 2529\/09              2<\/span><\/p>\n<p>under Section 203 of Code of Criminal Procedure and<\/p>\n<p>hence, a second complaint is not sustainable and<\/p>\n<p>therefore, learned Sessions Judge is not competent<\/p>\n<p>to proceed with the case.\n<\/p>\n<p>     3. Petitioner has not produced the order, by<\/p>\n<p>which, learned Magistrate has taken cognizance or<\/p>\n<p>by which, the case was committed to the Sessions<\/p>\n<p>Court or the charge framed by learned Sessions<\/p>\n<p>Judge. Even according to the petitioner, earlier<\/p>\n<p>private complaint was dismissed under Section 203<\/p>\n<p>of Code of Criminal Procedure for non prosecution<\/p>\n<p>and   was    not dismissed  on   merits.  In   such<\/p>\n<p>circumstances, the cognizance taken on the second<\/p>\n<p>complaint cannot be said to be illegal.
