NO. 2215  OF  2007\n\n              -------------------------------------------------\n\n              Dated this the   11th   day of July, 2007\n\n\n\n                                 ORDER\n<\/pre>\n<p>      The   petitioner   faces   indictment   in   a   prosecution   for<\/p>\n<p>offences   punishable,   inter   alia,   under   Sec.332   read   with<\/p>\n<p>Sec.149   of   the   IPC.      Investigation   is     complete.     Cognizance<\/p>\n<p>has been taken.   But consequent to the non-appearance of the<\/p>\n<p>petitioner before the learned Magistrate,  the petitioner finds a<\/p>\n<p>warrant of arrest issued by the learned Magistrate chasing him<\/p>\n<p>now.       According to the petitioner, he is   absolutely innocent.\n<\/p>\n<p>His   non-appearance   was   not   wilful   or   deliberate.     The<\/p>\n<p>petitioner is willing to surrender before the learned Magistrate<\/p>\n<p>and   co-operate   with   the   court   for   the   expeditious   disposal   of<\/p>\n<p>the   case   against   him.    The   petitioner   apprehends   that   his<\/p>\n<p>application   for   regular   bail   may   not   be   considered   by   the<\/p>\n<p>learned   Magistrate   on   merits   in   accordance   with   law   and<\/p>\n<p>expeditiously.  It is, in these circumstances,  that the petitioner<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. NO. 2215  OF  2007 -: 2 :-<\/span><\/p>\n<p>has come to this Court for a direction to the learned Magistrate<\/p>\n<p>to   release   him   on   bail   when   he   appears   before   the   learned<\/p>\n<p>Magistrate.\n<\/p>\n<p>        2.       It   is   for   the   petitioner   to   appear   before   the   learned<\/p>\n<p>Magistrate   and   explain   to   the   learned   Magistrate   the<\/p>\n<p>circumstances   under   which   he   could   not   earlier   appear   before<\/p>\n<p>the   learned   Magistrate.     I   have   no   reason   to   assume   that   the<\/p>\n<p>learned   Magistrate   would   not   consider   the   petitioner&#8217;s<\/p>\n<p>application for regular bail on merits in accordance with law and<\/p>\n<p>expeditiously.       No   special   or   specific   directions   appear   to   be<\/p>\n<p>necessary.     Every   court   must   do   the   same.       Sufficient   general<\/p>\n<p>directions on this aspect have already been issued in the decision<\/p>\n<p>reported in <a href=\"\/doc\/147290035\/\">Alice George v. Deputy Superintendent of Police<\/a><\/p>\n<p>(2003 (1) KLT 339).\n<\/p>\n<p>        3.      In the  result, this  Crl.M.C. is  dismissed; but with  the<\/p>\n<p>observation  that if  the petitioner surrenders before  the  learned<\/p>\n<p>Magistrate   and   seeks  bail   after   giving   sufficient   prior   notice   to<\/p>\n<p>the   Prosecutor   in   charge   of   the   case,   the   learned   Magistrate<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. NO. 2215  OF  2007 -: 3 :-<\/span><\/p>\n<p>must   proceed   to   pass   appropriate   orders   on   merits   and<\/p>\n<p>expeditiously &#8211; on the date of surrender itself.\n<\/p>\n<p>                                                         Sd\/-\n<\/p>\n<p>                                               (R.
