Ltd. Petition against<br \/>\n\ta Private Limited Company is not maintainable and hence present<br \/>\n\tpetition is dismissed as having not maintainable.\n<\/p>\n<p>In<br \/>\n\tthe petition, the appellants made following prayers:\n<\/p>\n<p> (A)\tThis<br \/>\n\tHonourable Court may be pleased to admit this petition;\n<\/p>\n<p>(B)<br \/>\n\tThis Honourable Court may be pleased to issue writ of mandamus or<br \/>\n\tany other writ, order or direction by directing the<br \/>\n\trespondent-company to pay legitimate dues like Provident Fund,<br \/>\n\tGratuity, Leave Pay etc. with appropriate interest to the<br \/>\n\tpetitioners;\n<\/p>\n<p>(C)<br \/>\n\tThis Honourable Court may be pleased to pass such other and further<br \/>\n\trelief, as the nature and circumstances of the present case may<br \/>\n\trequire.\n<\/p>\n<p>Before<br \/>\n\tfiling the petition, the appellants had given a notice to the<br \/>\n\trespondent, in reply to which, the respondent raised the contention<br \/>\n\tthat the petitioners were not in employment but were working on<br \/>\n\tcontractual basis.\n<\/p>\n<p>Learned<br \/>\n\tadvocate, Mr.Paul, for the appellants submitted that the<br \/>\n\tpetitioners&#8217; petition has been dismissed in limine on technical<br \/>\n\tground of maintainability. He relied on following judgments  to<br \/>\n\tsupport his case that the petition was maintainable:\n<\/p>\n<p>i)<br \/>\n\tWhirlpool  Corporation Vs. Registrar of Trade Marks, Mumbai and<br \/>\n\tOthers, (1998)8 SCC page 1;\n<\/p>\n<p>ii)<br \/>\n\tHarbanslal Sahnia and Another Vs. Indian Oil Corpn. Ltd. and Others,<br \/>\n\t(2003)2 SCC page 107; and<\/p>\n<p>iii)<br \/>\n\tShri Anadi Mukta Sadguru Shree Muktajee Vandasjiswami Suvarna<br \/>\n\tJayanti Mahotsav Vs. V.R. Rudani and others, AIR 1989 SC page 1607.\n<\/p>\n<p>Mr.Paul<br \/>\n\tsubmitted that a petition against a private party would be<br \/>\n\tmaintainable to protect an individual&#8217;s fundamental right and,<br \/>\n\ttherefore,  the petition ought to have been entertained by the<br \/>\n\tlearned Single Judge. It is submitted that the appeal may,<br \/>\n\ttherefore, be entertained.\n<\/p>\n<p>Learned<br \/>\n\tadvocate, Ms.Vijayalakshmi, for the respondent has opposed this<br \/>\n\tappeal. According to her, the impugned order is correct. No<br \/>\n\tfundamental right of the petitioners is violated. A petition against<br \/>\n\ta private party would not be maintainable and, therefore, this<br \/>\n\tappeal may be dismissed.\n<\/p>\n<p>We<br \/>\n\thave examined rival submissions. From the record it is found that<br \/>\n\tthe prayer of the appellants was for issuance of a writ of mandamus<br \/>\n\tor any other writ, order or direction directing the respondent<br \/>\n\tCompany to pay legitimate dues like Provident Fund, Gratuity, Leave<br \/>\n\tPay, etc.  with appropriate interest to the petitioners. The fact<br \/>\n\tthat the respondent is a Private Company is revealed from the cause<br \/>\n\ttitle as well as the prayer clause and is not in dispute. The<br \/>\n\tannexures to the  appeal also would go to show that the respondent<br \/>\n\tCompany is engaged in the business of advertisement and was not<br \/>\n\tengaged in performing any public duty. With this undisputed facts,<br \/>\n\tin our view, learned Judge was right in dismissing the petition on<br \/>\n\tthe ground of maintainability.\n<\/p>\n<p>Learned<br \/>\n\tadvocate, Mr.Paul, has relied on certain judgments. They are in<br \/>\n\trespect of maintainability of a writ petition where an alternative<br \/>\n\tremedy is available and Courts have said that it cannot be said that<br \/>\n\tjurisdiction of the Court is divested where there is an alternative<br \/>\n\tremedy available or differently put, it cannot be said that the<br \/>\n\tCourt should not exercise jurisdiction where an alternative remedy<br \/>\n\tis available. The Court certainly  can use its writ jurisdiction<br \/>\n\tprovided other parameters for maintainability of writ petition are<br \/>\n\tsatisfied.\n<\/p>\n<p>In<br \/>\n\tcase of Shri Anadi Mukta Sadguru Shree Muktajee Vandasjiswami<br \/>\n\tSuvarna Jayanti Mahotsav(supra) relied upon by learned advocate,<br \/>\n\tMr.Paul, the Hon&#8217;ble Supreme Court has examined this very issue and<br \/>\n\thas observed in para 19 thus:\n<\/p>\n<p> The<br \/>\n\tterm  authority  used in Article 226, in the context, must<br \/>\n\treceive a liberal meaning unlike the term in Article 12. Article 12<br \/>\n\tis irrelevant only for the purpose of  enforcement of fundamental<br \/>\n\trights under Art.32. Article 226 confers power on the High Courts to<br \/>\n\tissue writs for enforcement of the fundamental rights as well as<br \/>\n\tnon-fundamental rights. The  words  any person or authority<br \/>\n\tused in Article 226 are, therefore, not to be confined only to<br \/>\n\tstatutory authorities and instrumentalities of the State. They may<br \/>\n\tcover any other person or body performing public duty. The<br \/>\n\tform of the body concerned is not very much relevant. What is<br \/>\n\trelevant is the nature of the duty imposed on the body. The duty<br \/>\n\tmust be judged in the light of positive obligation owed by the<br \/>\n\tperson or authority to the affected party. No matter by what means<br \/>\n\tthe duty is imposed. If a positive obligation exists mandamus cannot<br \/>\n\tbe denied.\n<\/p>\n<p>Thus,<br \/>\n\tit is clear that the scope of issuance of writ under Article 226 is<br \/>\n\twider and not restricted to issuance of writ against an authority<br \/>\n\tunder Article 12, but the person or authority must be imposed with<br \/>\n\tperformance of public duty. In the instant case, the respondent is a<br \/>\n\tPrivate Limited Company engaged in the business of advertising and<br \/>\n\tit cannot, by any stretch of imagination, be considered to be<br \/>\n\tengaged in performance of public duty. As such, no duty is imposed<br \/>\n\ton it least a public duty.\n<\/p>\n<p>The<br \/>\n\tgrievances that the appellants have against the respondent arise<br \/>\n\tonly out of a contract, may be contract of work or contract of<br \/>\n\temployment, but it does not arise out of failure on part of the<br \/>\n\trespondent in performing any public duty.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances, we do not find any substance in this appeal.<br \/>\n\tLearned Judge was justified in holding that the petition has to fail<br \/>\n\ton account of non-maintainability. The appeal must fail and stands<br \/>\n\tdismissed.
