The  respondent was a Superintendent of  Statistics  in<br \/>\nthe  Field  Operations\tDivision,  National  Sample   Survey<br \/>\nOrganisation,\tUnion  of  India   the\tappellants   herein.<br \/>\nCertain\t charges  were framed against him  for\tunauthorised<br \/>\nabsence\t and  an inquiry held.\tBy an order  dated  May\t 30,<br \/>\n1980, he was compulsorily retired from service as a  measure<br \/>\nof  penalty.   He  filed an appeal which  was  dismissed  on<br \/>\nAugust\t30,  1982.  It appears that thereafter\the  filed  a<br \/>\nreview\tbefore the appellate authority which is\t not  indeed<br \/>\nprovided  by  the rules.  This review petition\tcame  to  be<br \/>\ndismissed on July 9, 1985, whereupon he approached the\tHigh<br \/>\nCourt  by way of a writ petition.  While the  writ  petition<br \/>\nwas   pending,\tthe  Central  Administrative  Tribunal\t was<br \/>\nconstituted  and the writ petition was transferred  to\tthat<br \/>\nTribunal.  The Tribunal allowed the respondent&#8217;s application<br \/>\nby  its\t order\tdated November 4, 1991.\t  The  Tribunal\t has<br \/>\nallowed\t the  application  on two grounds,  viz.,  (1)\tnon-<br \/>\nfurnishing  of\tthe  report of the Enquiry  Officer  to\t the<br \/>\nrespondent   before   imposing\tthe   punishment   and\t (2)<br \/>\nirregularities in conduct of the inquiry.\n<\/p>\n<p>2.   So\t far  as the first ground is  concerned,  it  stands<br \/>\nnegatived  by the recent decision of this Court in  <a href=\"\/doc\/1190519\/\">Managing<br \/>\nDirector, ECIL, Hyderabad v. B. Karunakarl<\/a> , inasmuch as the<br \/>\norder  of  punishment is of the year 1980.  So\tfar  as\t the<br \/>\nsecond ground is concerned, a few facts need be stated.\t  An<br \/>\ninquiry was held, in the first instance, which was not found<br \/>\nto be in order by the disciplinary authority who directed  a<br \/>\nfresh  inquiry.\t  When\tnotices were issued  in\t the  second<br \/>\ninquiry,  they could not be served on the respondent.  On  a<br \/>\nlater date, the respondent sent an application stating\tthat<br \/>\nhe  is\tsuffering  from unsoundness of\tmind  and  that\t the<br \/>\ninquiry may be postponed till he regains his mental health.<br \/>\n1   (1993)  4 SCC 727: 1993 SCC (L&amp;S) 1184: (1993 )  25\t ATC<br \/>\n704: JT (1993) 6 SC 1<br \/>\n<span class=\"hidden_text\">520<\/span><br \/>\nThe  respondent\t also  states  that  he\t sent  his   medical<br \/>\ncertificate along with he is application. (Indeed, according<br \/>\nto  him,  he  sent not one but three  letters  to  the\tsaid<br \/>\neffect.)  The report of the Enquiry Officer,  however,\tdoes<br \/>\nnot  show that he paid any attention to these letters.\t If,<br \/>\nindeed,\t  the  letters\twere  not  accompanied\tby   medical<br \/>\ncertificates,  as is now asserted by Shri  Mahajan,  learned<br \/>\ncounsel\t for  the  appellants, the  proper  course  for\t the<br \/>\nEnquiry\t Officer  was  to have called  upon  the  respondent<br \/>\neither to produce a medical certificate or to direct him  to<br \/>\nbe  examined  by a medical officer specified  by  him.\t The<br \/>\ninquiry report does not even refer to the request  contained<br \/>\nin the said application nor does it mention why and for what<br \/>\nreasons did he ignore the said plea of the respondent.\t The<br \/>\nEnquiry\t Officer  proceeded ex parte, in spite of  the\tsaid<br \/>\nletters\t and made his recommendation on the basis  of  which<br \/>\nthe  aforesaid penalty was imposed.  It is evident from\t the<br \/>\nfacts  stated  above that the Enquiry Officer has  not\tonly<br \/>\nconducted the inquiry in a manner contrary to the  procedure<br \/>\nprescribed  by\tRule 14(2) of CCS (CCA) Rules  but  also  in<br \/>\nviolation of the principles of natural justice.\t The  result<br \/>\nof  this finding would have been to set aside the  order  of<br \/>\npunishment  and\t allow\tthe authority to  proceed  with\t the<br \/>\ninquiry\t afresh.   In  our opinion,  however,  this  is\t not<br \/>\nadvisable at this distance of time and also having regard to<br \/>\nthe  nature of the charges levelled against the\t respondent.<br \/>\nWe think that the more appropriate course would be to give a<br \/>\nquietus to the matter at this stage itself, at the same time<br \/>\nproviding for some measure of penalty to the respondent.  We<br \/>\nsuggested to the learned counsel for the respondent  whether<br \/>\nhe is agreeable to our suggestion, viz., that the respondent<br \/>\nshould forego the emoluments for the period commencing\tfrom<br \/>\nJune  1, 1980 to August 31, 1985 (approximating to the\tdate<br \/>\nof   punishment\t and  the  date\t on  which  the\t  respondent<br \/>\napproached  the\t High Court).  Learned\tcounsel,  Shri\tH.M.<br \/>\nSingh,\tagrees\tto  the said  course  after  consulting\t his<br \/>\nclient.\t  In  the circumstances, we dismiss the\t appeal\t but<br \/>\ndirect\tthat  the respondent shall not be  entitled  to\t any<br \/>\nemoluments  for the period June 1, 1980 to August 31,  1985.<br \/>\nThe  said  period shall, however, count\t for  seniority\t and<br \/>\nother\tpurposes.   The\t respondent  shall   be\t  reinstated<br \/>\nforthwith.\n<\/p>\n<p>3.
