Justice V.GIRI\n\n Dated :25\/03\/2009\n\n O R D E R\n                        V.GIRI, J\n                      -------------------\n                   W.P.(C).1538\/2008\n                     --------------------\n        Dated this the 25th day of March, 2009\n\n                      JUDGMENT\n<\/pre>\n<p>      Petitioner is a Senior Manager in the Punjab<\/p>\n<p>National Bank and he is currently stationed at the<\/p>\n<p>Regional office at Thiruvananthapuram.          Petitioner, a<\/p>\n<p>native of Kozhikode, was earlier posted at the Regional<\/p>\n<p>office, Rajkot in Gujarat.       Petitioner&#8217;s   wife     was<\/p>\n<p>working as Administrative Officer in the Divisional<\/p>\n<p>Office, Life Insurance Corporation of India at Rajkot.<\/p>\n<pre>\n\nLater during September, 2006,             the petitioner was\n\ntransferred       to  Kerala             and  posted       at\n\n<\/pre>\n<p>Thiruvananthapuram. He had requested for a posting<\/p>\n<p>in Kozhikode which is his native place. But his wife<\/p>\n<p>had to remain at Rajkot till May, 2007, when she was<\/p>\n<p>also transferred to Thiruvananthapuram               Division.<\/p>\n<p>Petitioner availed a Leave Travel Concession facility in<\/p>\n<p>accordance with the LTC            rules prevailing in the<\/p>\n<p>respondent    Bank, and     visited Darjeeling in October,<\/p>\n<p>2006.   He along with his wife           had  travelled from<\/p>\n<p>Thiruvananthapuram      to    Darjiling     and  back      to<\/p>\n<p>Thiruvananthapuram       by air by availing the          LTC<\/p>\n<p>W.P.(C).1538\/2008<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>facility. His wife had to remain at Rajkot till May,<\/p>\n<p>2007       when she was also          transferred to<\/p>\n<p>Thiruvananthapuram. According to the petitioner, if<\/p>\n<p>the family is not residing with him at the place of<\/p>\n<p>posting, family can travel from the place of domicile<\/p>\n<p>to join spouse    enjoying Leave Travel Concession<\/p>\n<p>facility and return back to the place of residence.<\/p>\n<p>In the present case, the claim for the charges<\/p>\n<p>incurred for the travel by the petitioner&#8217;s      wife<\/p>\n<p>from Rajkot to Thiruvananthapuram       and back to<\/p>\n<p>Rajkot,    was rejected by the Bank on the ground<\/p>\n<p>that the petitioner&#8217;s  domicile is Kozhikode and the<\/p>\n<p>LTC facility sought for in relation to his wife was<\/p>\n<p>for the travel from Rajkot to Thiruvananthapuram<\/p>\n<p>and back to Rajkot.     This has been challenged in<\/p>\n<p>the writ petition.\n<\/p>\n<\/p>\n<p>2.    I heard learned counsel for the petitioner and<\/p>\n<p>learned counsel for the Bank. Counter affidavit has<\/p>\n<p>been filed on behalf of the third respondent.<\/p>\n<p>3.    That the petitioner&#8217;s domicile is Kozhikode is<\/p>\n<p>W.P.(C).1538\/2008<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>not seriously disputed. LTC was availed by the<\/p>\n<p>petitioner and his wife, by accompanying him. They<\/p>\n<p>had undertaken      a trip to Darjeeling. Petitioner&#8217;s<\/p>\n<p>claim was rejected in relation to the expenses<\/p>\n<p>incurred on behalf of his wife because it was not a<\/p>\n<p>travel which was undertaken      from the place    of<\/p>\n<p>posting of the employee to the place of domicile. In<\/p>\n<p>these circumstances, the stand taken by the Bank<\/p>\n<p>does not warrant any interference.<\/p>\n<p>4.    Further I note that the petitioner&#8217;s wife is<\/p>\n<p>also      a fairly high placed employee, who was<\/p>\n<p>stationed at Rajkot,     in spite of the petitioner&#8217;s<\/p>\n<p>transfer    and posting   at Thiruvananthapuram for<\/p>\n<p>reasons of her own employment. I do not find any<\/p>\n<p>ground     to interfere with the stand taken by the<\/p>\n<p>Bank.
