Justice V.GIRI\n\n Dated :04\/02\/2008\n\n O R D E R\n                                  V.GIRI,J\n\n                      ---------------------------------\n\n                       W.P.C.No.3975 OF 2008\n\n                     ------------------------------------\n\n              Dated this the 4th day of January, 2008\n\n\n                                JUDGMENT\n<\/pre>\n<p>      Petitioner is the daughter of one Sri.K.Pushpakaran who died<\/p>\n<p>in   harness   while   working   as   driver   in   ICDS   Project   Office,<\/p>\n<p>represented by the third respondent herein.  Petitioner&#8217;s mother is<\/p>\n<p>the   first   wife   of   Sri.K.Pushpakaran   and   after   divorce<\/p>\n<p>K.Pushpakaran married one T.K. Geetha in whom he has a minor<\/p>\n<p>child aged 12 years.   Ext.P1 and P2 would show   that retirement<\/p>\n<p>benefits   due   under   the   account   of   K.Pushpakaran   has   been<\/p>\n<p>apportioned   between   the   second   wife   and   the   petitioner.\n<\/p>\n<p>Petitioner   is   qualified   to   be   considered   for   appointment   to   a<\/p>\n<p>ministerial   post   in   the   Government   and   Ext.P7   application   is<\/p>\n<p>submitted   in   the   prescribed   form.     This   is   followed   by   Ext.P8<\/p>\n<p>representation.\n<\/p>\n<p>      2.     I have heard learned counsel for the petitioner and the<\/p>\n<p>learned Government Pleader.\n<\/p>\n<p>      3.     The writ petition is disposed of in the following terms:\n<\/p>\n<p>      1)     Third respondent shall process Ext.P7 and forward the<\/p>\n<p>same   along   with   remarks   to   the   second   respondent   within   one<\/p>\n<p><span class=\"hidden_text\">WPC.No.3975\/08                         2<\/span><\/p>\n<p>month from the date of receipt of a copy of this judgment.\n<\/p>\n<p>       2)    Thereupon the second respondent shall issue notice to<\/p>\n<p>the   second   wife   of   K.Pushpakaran   namely   Smt.T.K.Geetha   and<\/p>\n<p>after conducting enquiries forward Ext.P7 to the first respondent<\/p>\n<p>along with his remarks within six weeks from the date of receipt<\/p>\n<p>of the application from the third respondent.\n<\/p>\n<p>       3)    Thereupon   the   first   respondent   shall     pass   orders   on<\/p>\n<p>the   petitioner&#8217;s   application   for   appointment   under   the   dying   in<\/p>\n<p>harness scheme in accordance with law, within two months from<\/p>\n<p>the date of receipt of the same.\n<\/p>\n<p>                                                         (V.GIRI, JUDGE)<\/p>\n<p>sv.\n<\/p>\n<p><span class=\"hidden_text\">WPC.No.3975\/08    3<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court O.P.Haseena vs State Of Kerala on 4 February, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 3975 of 2008(W) 1.
